SUBJECT: LYONS AVENUE NORTH SIDE, EAST OF INTERSTATE 5, (PROJECT 89-13)

BACKGROUND
On November 27, 1990, the City Council authorized the advertisement *of the
subject project. The project consists of the widening of the north side of
Lyons Avenue, and includes the construction of curb, gutter, sidewalk, base,
pavement and a storm drain extension.
On Thursday, December 18, 1990, the following bids were received by the City
Clerk.

The Engineer's estimate for this project is $71,804.00. A total of $96,000 has
been budgeted under Account No. 25-96033-227 for design, contract
administration, inspection, and construction of this project.
Staff recommends that the project be awarded to Berry General Engineering
Contractors, Inc., the low bidder. Berry General Engineering Contractors Inc.
possesses the necessary States Contractor's license and is a member in good
standing. The bid of $52,711.90 was reviewed for accuracy and conformance to
the contract documents and was found to be complete. This Contractor has
performed similar work for other agencies in Southern California, including the
City of Oxnard, the City of San Buenaventura and Ventura Regional Sanitation
District, all of which indicated that he.performed work to their satisfaction.

When the project was approved for advertising, the Council directed staff to
investigate the potential for reimbursement of the work from the owner of the
adjacent undeveloped property. Based on comments from the City Attorney, the
fact that the owner has dedicated the right-of-way to the City at no cost to us,
and of delays four to six months in establishing an assessment district, we
recommend that this project proceed as originally proposed and budgeted by the
City. We are, however, reviewing all . future projects for potential
reimbursement to the City of subsequent capital projects benefitting adjacent
parcels.
Award the contract to the low bidder, Berry General Engineering Contractors,
Inc. in the amount of $52,771.90.
