Harris��/ • lV�L2� SUBJECT: Amendments to the Manufactured Home Rent Stabilization Ordinance No. 90-38 DEPARTMENT: Community Development BACKGROUND: On April 23, 1991, the City Council was presented with Draft Ordinance No. 91-24 which would provide procedural changes to the current Manufactured Home. Rental Adjustment Ordinance No. 90-38. The City Council reviewed the draft ordinance at that meeting and directed staff to distribute information regarding changes to interested citizens and to schedule the. proposed Ordinance No.91-24 for action on May 14, 1991. Community Development Staff has mailed information regarding proposed changes in the Manufactured Home Rental Adjustment Ordinance to interested parties as requested by City Council. In reviewing the responses to our mailout, staff feels that there may be additional changes proposed to make the ordinance more effective and -is reviewing these items with the City Attorney's Office. RECOMMENDATION: Staff .recommends that the City Council allow time to receive further input regarding possible changes in the Manufactured Home Rental Adjustment Ordinance and direct that the draft ordinance be rescheduled for action on May 28,1991. I believe this has now been postponed until May 28th for first reading. There are three additional items in the Ordinance that I would like to submit for change: 8.57.030 H - Quorum The Panel's first meeting in April was cancelled because the park owners were not represented. we have had several meetings and training sessions since then and the park owners had not selected a second Member as of last Friday night's Panel Meeting. Also, thepark owners representative said that they were having no luck in filling the second seat on the Panel as no one wanted to serve. He also stated that if the amendments to the Ordinance were passed, he would find it difficult to remain "neutral." Because of lack of a concerned effort and the lack of a second park owner represen- tative after several weeks, I believe that we must change the quorum to: "Three (3) members.shall constitute a quorum so long as such quorum consists of two Panel members and the member selected by the alternate strike method." As the Ordinance reads now, if the park owners representative does not attend, the Panel does not have a quorum. I strongly urge that this change be made on an emergency basis.. If the park owners representative(s) wish to participate, then they will have to take the initiative --they are not being excluded by any means. I believe that we cannot allow the park owners to have ultimate control over the Panel. MRY-14-'91 13:57 Page 2 80. 57.L20 AM IM MRSTEY / USA TEL NO:E05-257-9203 #610 P03 Standards of Reasonableness To Be Applied To Space Rent Adjustments Consumer Price Index (CPI) adjustment should be based on the final calendar year. This figure is the base rate for Social Security increases, many wage increases, etc. If.we do not pick a one figure standard, the rate increase will fluctuate between parks by,different months. It would be much better to have one figure in effect for the calendar year. Add A(6) We need to have a cap as to the dollar amount allowable to be passed through to the residents of a park. When you consider the condition of some of the parks in the Santa Clarita Valley, you are aware that it is a distinct possibility that.an owner will.use an unlimited cap for park upgrade/upkeep and pass these overdue improvements on to the residents. This is especially true since the State of California is conducting the inspection of mobilehome parks. As a note, the City of Los Angeles has a new policy that some Capital'Improvements are only allowed to be passed through at 50% cost to the residents. I will be at the Council meeting tonight in any case. Thank you again for your time and consideration.
