SUBJECT: MODIFICATIONS TO THE DROUGHT ORDINANCE

BACKGROUND
The City Council has directed the staff to prepare the attached draft Ordinance
01-32 to modify the current Drought Ordinances (91-12 and 91-16) to -incorporate
recommendations from the Drought Committee. There are four modifications
contained in the new Ordinance.
1. All residential lawns and landscaping may not be watered between the hours
of 8:00 a.m. and 6:00 p.m.;
2. Lawns and landscaping may now be watered every day, but each watering
station may run for no more than 10 minutes;
3. New sod or seeded lawns may not be installed during the months of June
through September; and
4. Bottles and cans which are to be recycled as a part of the City of Santa
Clarita's waste ,recycling program need not be thoroughly washed before
placing them in approved recycling collection containers.
It is recommended that Ordinance 91-32 be adopted as an urgency measure, and the
Ordinance contains the following findings necessary to make such a determination:
"The State of Californiais still suffering from the effects of a
five-year drought, and the deliveries of State Project water to
local water agencies are being reduced. This Ordinance restricts or
prohibits.certain types of water usage. The immediate enactment of
this Ordinance is therefore necessary to ensure the adequacy of the
water supply for the City of Santa Clarita and is hereby directly
related to public health, safety and welfare. Therefore, this
Ordinance shall be effective immediately upon adoption."
It is recommended that the City Council introduce Ordinance No. 91-32 and set a
public hearing for August 13, 1991, at which time Ord. 91-32 will be adopted as an
urgency Ordinance.

AN ORDINANCE OF THE CITY OF SANTA CLARITA
AMENDING CHAPTER 9.38 TO TITLE 9
OF THE SANTA CLARITA MUNICIPAL CODE
WHEREAS, the City Council of the City of Santa Clarita has enacted
Ordinance No. 91-16 establishing restrictions on the use of water within the
City of Santa Clarita; and
WHEREAS, the City Council of the City of Santa Clarita has .appointed
a Drought Committee in accordance with the provisions of Ordinance No. 91-16;
and
WHEREAS, the Drought Committee has made certain recommendations .to
the City Council regarding proposed modifications to Ordinance No. 91-16.
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1, The Santa Clarita Municipal Code, Chapter 9.38 of Title 9
relating to water conservation is amended to read as follows:
9.38.015.B.2 Watering of Lawns and Landscaping
a. No person shall water or cause to be watered any residential lawn
or landscaping between the hours of 8:00 a.m. and 6:00 p.m.
b. Lawns and landscaping shall be watered for no more than 10
minutes per watering station per day.
Section 2. The Santa Clarita Municipal Code, Chapter 9.38 of Title 9
relating to water conservation is amended, adding Paragraphs 9.38.015.B.7.c,
9.38.015.B.8.a and 9.38.030.B to read as follows:
9.38.015.B.7 Landscaping and.Irrigation Plans
c. New sod or seeded lawns shall not be installed during the months
of June through September.
9.38.015.B.8 Other Water Conservation Regulations
a. Bottles .and cans which are to be recycled as a part of the City
of Santa Clarita's waste recycling programs need not. be
thoroughly washed before placing them in approved recycling
collection containers.
9.38.030 Ordinance 91-12 Amended
B. Ordinance 91-12 as amended by Ordinance No. 91-16, is hereby
amended to conform to the amendments and additions to Ordinance 91-16 as
specified in this Ordinance No. 91-32.
Section 3. The City Council hereby declares that the provisions of
this Ordinance are severable and if for any reason a court or competent
jurisdiction shall hold any sentence, paragraph or section of this Ordinance
to be invalid, such decision shall not affect the validity of the remaining
parts of this Ordinance.
Section 4. This Ordinance is adopted as an urgency measure. The
facts of the urgency are these: The State of California is currently
suffering from the effects of a five-year drought, and the deliveries.of State
Project water. to local water. agencies- are being reduced. This Ordinance
restricts or,prohibits certain types of water usage. The immediate enactment
of this Ordinance is therefore necessary to ensure the adequacy of the water "
supply for the City of Santa Clarita and is hereby directly related to public
health, safety and welfare. Therefore, this. Ordinance shall be effective
immediately upon adoption.
Section 5. The City Clerk shall certify to the passage of. this
Ordinance and shall cause it to be published in the manner prescribed by law.
