City Manager Approval Item to be presented by: City Clerk SUBJECT: CERTIFICATION OF SUFFICIENCY OF PETITIONS FOR RESIDENTIAL CONTROL SYSTEM DEPARTMENT: City Clerk BACKGROUND On August 9, 1991, a citizen group, filed with the City Clerk a Notice of Intention to circulate petitions for a residential growth control system in the City of Santa Clarita. On November 12, 1991, the citizen group completed the circulation and filed the petitions with the City Clerk for verification. Verification of the signatures was completed on December 4, 1991, with 6644 signatures verified. In order to.qualify for the ballot on April 14, 1992, the signatures required were 1OX of the registered voters. Therefore, this petition was required to have 5757 signatures verified. Elections Code 3707 states that the City Clerk must' certify the sufficiency of the petitions to the City Council at the next regular meeting. Attached is the certification for Council acceptance. One of these figures should be used in determining the number of signatures required for petition certification in accordance with Elections Code Section 4008. On December 5, 1991, the City Clerk received from the County.of Los Angeles Registrar/Recorder's Office all petitions verified. Of 'the 9839 signatures, 6644 qualified as valid signatures of registered voters of the City. The validated signatures constitute 11.52 of the voters of the City according to the last report of registered voters by the County Clerk to the Secretary of State. The City Clerk will certify the sufficiency of the signatures at the, December 10, 1991, regular Council meeting as stated in Section 3707 of the Elections Code. The City Council has three alternatives as to their action: 1. Introduce the ordinance without alteration at the regular meeting at which it is presented or within 10 days after it is presented. (Election Code Section 4011) 2. Submit the ordinance without alteration to the voters at the.next regular municipal election (Election Code Section 4011) 3. Refer the initiative measure to any City agency or agencies for a report on any of the following: (a) its fiscal impact (b) its effect on the internal consistency of the City's general or specific plans including the housing element, consistency between planning and zoning (c) any other matters Council requests in the report The report shall be presented to the Council within the.time prescribed by the Council, but no later than 30 days after the City Clerk certifies to the Council the sufficiency of the petition. (Election Code Section 4009.5, attached) If Council requests a staff report pursuant to Election Code Section 4009.5, they will need to adjourn to a meeting no later than January 9, 1992, which is the 30 day limit. At that time, the City Council would take an action pursuant to numbered paragraph I or 2 above.
