Harris/ DATE: May 14, 1991 SUBJECT: Radius requirements for public hearings DEPARTMENT: Community Development BACKGROUND At its meeting of April 9, 1991, the Council conducted public hearings on ordinances to unify the appeal periods of land use decisions, and the notice periods for public hearings. As part of its discussion, the Council requested that the staff bring back information regarding the mailing radius for notification to the Council at a later date. The staff has researched the code and the City's application submittal requirements resolution and found that the radius requirements are virtually uniform, at 500 feet. All entitlements that require a radius to be noticed by mail to the property owners require at least 500 feet. Only one entitlement, a cemetery permit, is different and may require a mile and one-half mailing radius in certain instances. Since State law only requires that a 300 -foot radius be notified as part of a public hearing, the City's standard of a 500 -foot radius is an additional 200 feet over and above the statutory minimum. If a public hearing is required, a radius notification is required. The following approvals require a public hearing: Subdivisions, zone changes, conditional use permits, variances, cemetery permits, mobilehome permits, subdivision directional signs, termination of nonconforming uses and structures, and modifications and revocations. . Other approvals may be made administratively and do not require a public hearing: Animal permits, explosives permits, parking permits, temporary use permits, and oak tree permits. Most of these permits have an option to hold a public hearing if such is deemed necessary, but a hearing is not mandatory. If a hearing is involved in any aspect of a project, the whole request is then subject to hearing notification requirements.
