Medina DATE: February 26, 1991 SUBJECT: RIO VISTA ROAD r GRADE SEPARATION AGREEMENT DEPARTMENT: Public BACKGROUND The County of Los Angeles submitted an application to the Public Utilities Commission for a grade crossing on Rio Vista Road southerly of Soledad Canyon Road at the Southern Pacific Transportation Company's tracks. The. application was submitted on behalf of the developer for Tract 32262 - this is the same property the City recently purchased. The developer was conditioned to construct Rio Vista Road from Soledad Canyon Road southerly to the end of this property, approximately one-half mile. This construction included an underpass beneath the Southern Pacific Transportation Company's tracks. The.County would have been the owner of Rio Vista Road when it was constructed. The application was filed in July of -1987 by the County, but the decision by the Public Utilities Commission to allow this undercrossing was not made until March 9, 1988, shortly after the City Incorporated. The County continued with the application naming the City as the agency that would ultimately provide the necessary maintenance and operation of the underpass. The application was for a period of three years and will expire on March 9, 1991. It would be much easier -to request an extension for additional time to construct the underpass than to permit' the application to run out and apply for a new application later. Therefore, we are recommending the City Council authorize staff to apply for an extension from the Public Utilities Commission. The approval by the Public Utilities Commission would not, in any way, require the City to install the grade separation at that location or at all if the Council, at a later date, decides to move Rio Vista Road or does not construct it. With that in mind, we feel that the most prudent approach is to preserve the City's right to construct the grade separation if and when it chooses to..do so. The location of the undercrossing did not change by the Council's recent action to consider rerouting Rio Vista northerly of Soledad Canyon Road.- Thus, this action would not affect the proposed rerouting. RECOMMENDATION The City Council authorize staff to seek maximum extension of Application 87-07-010 in the matter of a proposed grade separation of Rio Vista Road under the Southern Pacific Transportation Company El Paso Line. /ce Appfloffl Agenda Item:
