SUBJECT: Sign Enforcement

BACKGROUND
During the month of September, the City Council gave direction to the Code
Enforcement staff and the Sheriff's Department to begin enforcing the City
regulations that prohibit the posting of subdivision directional (developer)
signs that are placed within the City at different locations on weekends.
Some of the areas where these signs are posted are: center parkway medians,
streets, lightpoles, traffic signals and parkway trees.
Complaints directed to the City Council from residents prompted .the
enforcement of these sign regulations.
A joint enforcement effort with the Sheriff was initiated to addressthis
problem. A two phase enforcement program was started. First, an effort to
educate the public by way of distributing copies of our sign code regulations
and advising residents on how to properly place signs legally was made.
Second, after a few weeks of educating the public, the actual issuance of
citations to code violators would begin.
In addition, during our educational phase of the enforcement program, ""garage
sale" type signs were found within the aforementioned, prohibited areas. The
owners of these signs were also given copies of our sign codes. Current sign
code regulations do not make a distinction between "garage sale" signs and
developer signs, and for this reason they were also included as part of the
enforcement effort.
As a result, many residents complained to the City Council about the
enforcement of sign codes as they apply to garage sale signs. The City
Council, based on the complaints from residents, opted to exempt these garage
sale signs from the enforcement effort. This created an awkward position for
Code Enforcement and the Sheriff because current regulations do not provide
for any exceptions for "garage sale" signs. Concerns were raised that the
continued enforcement of these regulations only for developer signs was going
to be selective, rather than uniform and consequently, the enforcement effort
was discontinued.
Currently, the status of enforcement efforts regarding developer signs is
entirely. complaint based. No proactive -effort by the Code Enforcement or the
Sheriff's Department is being undertaken.
