A DRAFT ORDINANCE TO PROVIDE A UNIFORM 21 -DAY NOTICE PERIOD FOR ALL PUBLIC HEARINGS ON LAND USE ENTITLEMENTS. ORDINANCE NO. 91-18 - Presently, three different lengths of notice periods are established by ! the code or state law for entitlements which require a public hearing. The draft ordinance proposes to 9 create a uniform 21 -day notice period for all public hearings which will result in procedures + that are easier to administer, thereby, offering an improved service to the public. RECOMMENDED ACTION: Pending public testimony,.. introduce Ordinance No. 91-18, waive further reading and pass to second reading. ------------------------------------------------------ A DRAFT ORDINANCE THAT UNIFIES THE EFFECTIVE DATES, APPEAL PERIODS, AND PROTEST PERIODS OF DECISIONS OF THE DIRECTOR OF COMMUNITY DEVELOPMENT AND THE PLANNING COMMISSION - ORDINANCE NO. 91-19 - Presently, the zoning ordinance has an appeal procedure which establishes four different lengths of time in which an applicant may appeal a decision of the Directorof i Community Development and the Planning Commission. The draft ordinance proposes to change all appeal and protest periods to a uniform 15 -day period, and to establish the beginning of. these periods as the :date of action taken. RECOMMENDED ACTION: Pending public testimony, introduce Ordinance No. 91-19, waive further reading and pass to second reading. -1- City Council Agenda April 9, 1991 V 1: A DRAFT ORDINANCE THAT WILL AUTHORIZE THE CITY TO REQUIRE. WHERE NECESSARY, DEDICATION AND IMPROVEMENTS FOR STREET WIDENING WHEN CERTAIN TYPES. OF NEW CONSTRUCTION ARE PROPOSED AND FOR ALL PROJECTS IN THE R-1 and R-2 RESIDENTIAL ZONES - ORDINANCE NO, 91-20 - On individual lots, the City does not always have the ability to require dedications' and improvements' for street widening. This is most common in the R-1 Single Family Residential Zone. The draft ordinance proposes to reduce .the number of exceptions to three rather than the existing ten exceptions. RECOMMENDED ACTION: Pending public testimony, introduce Ordinance No. 91-20, waive further reading and pass to second reading. UNFINISHED BUSINESS ORDINANCE OF THE CITY OF SANTA CLARITA GRANTING A FRANCHISE TO SANTA CLARITA WATER COMPANY - ORDINANCE NO. 91-13 - Ordinance No. 91-13 was introduced at the Council meeting of March 26, 1991. This Ordinance grants a franchise to the Santa Clarita Water Co. RECOMMENDED ACTION: Waive further reading and adopt Ordinance No. 91-13. CONSENT CALENDAR All matters listed under the Consent Calendar will be enacted. by one motion unless a request is made for discussion in which case, the item(s) will be removed from the Consent Calendar and will be considered separately following this portion of the agenda. �! GILLIG CORPORATION 'SPIRIT' BUS CONTRACT - The City Council adopted Ordinance No. 90-25 last 'August, and determinedthat it is in the public interest and necessity to direct staff to work with the Foothill Transit Zone to combine our bus orders and negotiate a lower purchase price from the Gillig Corp. for the City order of 13 "Spirit" buses. Staff was directed by Council to draft a contract for the purchase. RECOMMENDED ACTION: Direct. Mayor to execute the contract between the City and the Gillig Corporation. 1 -2 City Council Agenda April 9, 1991 RESOLUTION NO. 91-54, A RESOLUTION TO APPROVE AND ORDER - ANNEXATION NO. 1990-10 -.This"annexation is a City -initiated proposal to annex approximately 56 acres of uninhabited territory to the City of Santa /. Clarita. The territory is located immediately adjacent and east of SierraHighway, adjacent and south of proposed State Highway 126, and west of State Route 14. RECOMMENDED_ ACTION: Adopt Resolution No. 91-54, approving and ordering Annexation No. 1990-10, and direct staff to transmit the resolution and --appropriate fees to the Executive Officer of.the LAFCO ---------------------------------7--------------- ISSUING THE NOTICE OF COMPLETION FOR THE NORTH OAKS PARK LIGHTING PROJECT - The construction for the North Oaks Park lighting project per the plans and specifications provided by Willdan and Associates has been completed to the satisfaction of .the Director of Parks and Recreation. RECOMMENDED\ACTION: Accept the work performed by National Electrical' Contractors, Inc. and authorize release of funds held for retention 35 days after acceptance with the exception of sufficient funds to coverstop notices which may be filed and direct the City Clerk - to record the Notice of Completion. --- ---------------------------------------------- ISSUING THE "NOTICE OF COMPLETION FOR THE PEPSI PLAY AREA' AT NEWHALL PARK - The construction of'the Pepsi Play Area at Newhall Park per the• plans and specifications provided by Willdan Associates has been completed to the satisfaction of the Director of Parks. and Recreation. RECOMMENDED ACTION: Accept the work performed by JDC General Engineering Contractor and authorize release of funds held for retention 35 days after acceptance with the exception of sufficient funds to cover. stop notices which may be filed and direct the City Clerk to record the Notice of Completion for the project. -3- City Council Agenda April 9, 1991 • y^ 9. HOUSING ASSISTANCE PLAN - Prior to applying for Housing and Urban Development (HUD) for Entitlement Status beginning in the Fiscal year 1991/92, and receiving its annual Community Development Block Grant (CDBG) allocation of $522,000, the City must comply with pre -submission application requirements as ' regulated by the Housing and Community Development Act of 1987. one of the- critical requirements for the City is to submit a Housing Assistance Plan (HAP). RECOMMENDED ACTION: Adopt the Housing Assistance Plan for the period of July 30,1991 through September 30, V--SOLEDAD 1991andstaff to submit HAP to HUD. - - ---------------------------------------- STREET: STILLMORE--- STREET: WHITES - CANYON ROAD ET AL (PROJECT NO. 90-13) - ADVERTISE FOR BIDS - A , study by the Public Works Department has determined. that the streets is the subject area are , in satisfactory structural condition but need corrective maintenance. Project No. 90-13 provides a slurry seal coat composed of liquid asphalt and sand to properly maintain and extend the service life of those streets identified. RECOMMENDED ACTION: Approve the plans and specifications for the project. -and authorize the advertising for bids. �. - --------------------------------------------- STREHT DEDICARION, BRACT N0. 36723, 38832 and 38840 - SAN FERNANDO ROAD BETWEEN DRAYTON STREET AND CIRCLE J RANCH ROAD - RESOLUTION NO. 91-55 - The subject tracts were approved by Los Angeles County in 1980, 1981 and 1982. Streets were constructed to County standards, and a five-foot future street was retained along the west side of San Fernando Road for future development. The City intends to widen and improve San Fernando Rd. within the 5 -foot future streets. RECOMMENDED ACTION: Adopt Resolution No. 91-55 accepting the future streets for Tract No. 36723, Tract No. 38832 and Tract No. 38840 along San Fernando Road. CALGROVE BLVD -VALENCIA -BLVD--- (PROJECT N0. 90 -11) --- BID AWARD - On March 13, 1991, the City Council authorized the advertisement of the. subject project. On Tuesday, April 2, 1991, bids were opened by the City Clerk with the apparent low bid being Roy Allan Slurry Seal, Inc. RECOMMENDED ACTION: Award. the contract to Roy.Allan Slurry Seal, Inc. -4- Y 1 City Council Agenda April 9, 1991 11. WHITES CANYON ROAD PHASE II - NOISE LIMIT VARIANCE - In order to proceed with construction of the extension of Whites Canyon Road Phase II, it is necessary to reconnect the existing Southern Pacific Transportation Company (SPTC) railroad tracks to the recently realigned SPTC railroad tracks. It will be necessary to work continually for - 48. hours making this i reconnection. The. City's ordinances regarding construction and noise prohibit such work during the nighttime hours. Both ordinances allow- exemptions when the City determines that there is an emergency or a public need that requires the restoration of • service. RECOMMENDED ACTION: Direct staff to -inform the County that we will permit the construction of the SPTC area connection on a continuous basis on April 18 and 19, 1991 and to inform the public of this work. �, DRAFT HCONOMIC DEVELOPMENT STRATEGY - The creation of the Economic Development-rStrategy is in response to a „specific action item task outlined in the City's Internal Strategy Plan, and in response to Council's request for definition of Santa Clarita's new Economic Development Program. The Strategy is based on input )' from two public information resource group meetings; a City Council Study Session held in February, and review and comments from City staff and others throughout the community. RECOMMENDED ACTION: Review draft Economic Development Strategy and direct staff to -reschedule for adoption at next City Council. meeting. AWARD OF BID FOR T-BALL/SOFTBALL UNIFORMS = Formal bids were requested for T-Ball/Softball uniforms to be opened on February 21, 1991. The only bid received was from Astro Sportswear in the amount of $15,851.73. Staff has. used this vendor in the past and have been satisfied with the quality of the product and timely service. RECOMMENDED ACTION: Award the bid for the acquisition of T-Ball/Softball uniforms to Astra Sportswear in the amount of $15,851.73. -------------------------------------------------------- RESOLUTION NO. 91-56 - Demand Warrant 16. RECOMMENDED ACTION: Adopt. -5- City Council Agenda_ April 9, 1991 r 1 ij�./ TRANSIT OPERATIONS RFP - The City's Five -Year Transit Plan, adopted by the Council last April, alters and significantly improves transit service to Santa Clarita Valley residents. The existing contracts with Antelope Valley Bus, Mark IV Charters will be retained on a month-to-month contract after June 30, 1991 and terminated when the City puts into service its own buses. A Request for Proposal (RFP) for Transit Operations has been prepared and will provide efficient and effective local, commuter and - Dial -a -Ride services. RECOMMENDED ACTION: Direct staff to notice the attached RFP for Transit t(Operations which include local, commuter and Dial -a -Ride as an option to the .City. ------------------------------------------------------------ 8. RESOLUTION NO. 91-50, A RESOLUTION TO IMPLEMENT THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) AND STATE GUIDELINES AT THE LOCAL LEVEL; AND AN ORDINANCE AMENDING THE SANTA CLARITA MUNICIPAL CODE RELATING TO BUILDING PERMIT LIMITATION - ORDINANCE NO. 91-22 - The Resolution establishes local guidelines, procedures, and lines of responsibility for implementation of the California Environmental Quality Act (CEQA). The Ordinance amends the Santa Clarita Municipal Code relating to building permit limitations. RECOMMENDED ACTION: Adopt Resolution No. 91-50; waive further reading of Ordinance No. 91-22 and pass to second reading. rr------------------------------------------ 7-------------- 45� DEVELOPMENT IMPACT FEE STUDY - The consultant firm of 1111 Recht, Hausrath and Associates has recently been retained by the City to conduct a Development Impact Fee Study. The consultant will be providing an overview of the study and their approach and would like to obtain initial input from the City Council on this subject. RECOMMENDED ACTION: Receive the report and provide input as appropriate; appoint one or two Councilmembers to a development impact fee study task force; and, direct staff to send a letter to the County inviting participation in the study. - --S-----F----ERNANDO------ROAD ----------S-TA----TE/C----ITY ----DR --------------TI--VE- AN T COOPERA AGREEMENT - DESIGN - The City has been .working with Caltrans over the 'last year and one-half to accomplish the widening of San Fernando Road. To date, the plans and specifications had been submitted to Caltrans, and :.they are in the process of giving the City approval to begin advertising. Part of this process is the need for a Cooperative Agreement between the State _ (Caltrans) and the City setting forth duties relating to the project. RECOMMENDED ACTION: Approve and authorize the Mayor to sign, the Cooperative Agreement approved by the City Attorney for the subject project. -g- City Council Agenda r April 9, 1991 COUNCIL ACTION 21. ADOPTION OF RESOLUTION NO. 91-52 'APPROVINGMASTER LEASE AND OPTION TO PURCHASE AGREEMENT NO.. 1991-1 AND RESOLUTION NO. 91-53 APPOINTMENT OF CITY CONSULTANTS - At the meeting of January 8, 1991, City "Council directed staff to facilitate the financing and issue a purchase order to the Gillig Corp. for the issue of thirteen "Spirit" buses. ' As a pre -requisite to this, the Council must adopt- two Resolutions before such a purchase can be finalized. RECOMMENDED ACTION: Review and adopt Resolution No. 91-52 and Resolution No. 91-53. A copy. of the full master lease is available in the City Clerk's Office. -------------------------------------------------------- 2. CITY MOBIL EHOME PARS RENT ADJUSTMENT ORDINANCE - Over a period of approximately ten months, commencing February 1990, City staff, under the direction of. City Council, formed a working committee comprised of Mobilehome Park resident representatives, Mobilehome Park owner representatives, and staff, including attorney assistance. The purpose of these meetings and subsequent negotiations to develop the above - referenced ordinance was to afford local City protection to existing mobilehome park residents from excessive rent increases.. Since the adoption of the ordinance, much confusion and misunderstanding about the intent and purpose of the ordinance has occurred. i Staff feels it is appropriate to identify those areas i which seem to be generated the most disappointment and confusion for possible Council consideration • of amendment. RECOMMENDED ACTION: Council discuss and give possible direction to staff, the Manufactured Home Rent Adjustment Panel, and the previous committee for areas of possible future amendments to this ordinance. The public may also address the Council on items not on the agenda but those. items will not be acted upon by Council at this meeting other than to review and return without action or direct staff.
