APPEAL OF PLANNING COMMISSION DENIAL OF PROPOSED Hearing VESTING TENTATIVE TRACT MAP 46619 AND ASSOCIATED PERMITS, FOR THE PROPERTY LOCATED AT THE SOUTHERN TERMINUS OF LA SALLE CANYON DRIVE. APPLICANT: RICHARD P. HOVE, GAVIOTA, INC. - This item was continued from the City Council meeting of April 25, 1991, due to incomplete public noticing. All public notices are now in order. The above mentioned Tract is a request to subdivide 49.4 acres of real property into 27 single-family residential lots; Conditional Use Permit 88-281 would allow for lot -size averaging and grading of approximately 74,000 cubic yards of earth within a "hillside management" area; Oak Tree Permit 89-045 requests removal of 419 Coast Live Oak trees. The Environmental Impact Report found that significantenvironmental damage would occur if the project was approved as submitted at 27 lots. RECOMMENDED ACTION: Uphold Planning Commission Resolution No. P91-15, denying Proposed Vesting Tentative Tract Map 46619, Conditional Use Permit 88-281, and Oak Tree Permit 89-045 OR direct applicant to prepare a modified eight lot tract map and return to, the Planning Commission for action at the earliest possible date. -1- City Council Agenda May 14, 1991 COUNCIL ACTION 2. - PROPOSED ORDINANCE N0. 91-23 AMENDING THE SANTA CLARITA MUNICIPAL CODE TO ESTABLISH A REVIEW PROCEDURE BY THE PLANNING COMMISSION FOR PROPOSED BUILDINGS EXCEEDING A HEIGHT OF THREE STORIES OR 35 FEET - ORDINANCE NO. 91-23 - At the Planning Commission meeting of April 16, 1991, Planning Commission .recommended that the City Council adopt Ordinance No: 191-23.,This ordinance was, drafted in response to City Council's direction to the Planning Commission for a review of the current height standards in the C-3, C -M, M-1 and the M-1.5 zones. The draft ordinance does not set a new limit for building height, rather it provides a review procedure under a .- Conditional Use Permit .for buildings which exceed a height of three stories or 35 feet in the commercial and industrial zones described. RECOMMENDED ACTION: Pending public testimony, introduce Ordinance NO. 91-23,. waive further reading and pass to -second reading. ------------------------------------------------------------- 3. COMMUNITY DEVELOPMENT BLOCK GRANT .(CDBG) PROPOSED PROJECTS FOR FINAL STATEMENT, FISCAL YEAR 1991/92 For the period of July 1, 1988 through June 30, 1991, the City of Santa Clarita, has received a total CDBG grant allocation of $714,267, as a participating grantee in the Los Angeles Urban County program. In July of 1990, the Council directed staff to notify the County of Los Angeles, Community Development Commission of the City's desire to be excluded from the Los Angeles Urban County, CDBG program and its' intent to apply to become an Entitlement City beginning July 1, 1991. This item is on the agenda to permit all interested members of the community to comment on the City's CDBG program performance for projects approved as part of a comprehensive Neighborhood Revitalization program for the East Newhall area,, Fiscal Year 1988-91, and comment on the _. activities for the. forth coming year. RECOMMENDED ACTION: Pending public testimony on CDBG proposed projects and .funding levels for Fiscal Year 1991-92, approve staff's recommendation to fund $103,623 of FY . 1988-91 undesignated funds as Phase II, East Newhall public improvements construction and submit MOU to County of Los . Angeles,. approve FY 1991-92 CDBG activities and direct staff to complete the City's Final Statement and return on May 28, 1991 for Council hearing and adoption. -2- City Council Agenda May 14, 1991 COUNCIL ACTION UNFINISHED BUSINESS 4. ZONE CHANGE 90-007 FROM A-2-1 (HEAVY AGRICULTURAL ZONE, MINIMUM LOT SIZE 1 ACRE) TO R-1-6000. (SINGLE - FAMILY RESIDENTIAL, MINIMUM LOT SIZE 6,000 SQUARE FEET) OVER A PORTION OF A 32 -ACRE PARCEL, LOCATED IN THE VIA PRINCESS AREA, APPROXIMATELY 1,000 FEET WEST OF RAINBOW GLEN DRIVE, .NORTH OF. VIA PRINCESSA ROAD. ORDINANCE N0:"91=17 '--On"April, 23;-1991, Community - Development Department staff presented the proposed project to the Council. City Council opened the Public Hearing and requested staff to follow up on several issues regarding the number of units to be approved, the water situation, the impact on the roads, and others. RECOMMENDED ACTION: Review the information requested at the April 23, 1991 City Council meeting, approve the Negative Declaration and introduce Ordinance No. 91-17, waive further reading and pass to second reading. ------------------------------------------------------------- 5. GLADIOLUS DRIVE/PINETREE SCHOOL BUS LOADING ZONE - RESOLUTION NO. 91-45 - Mr. Jim Noonan of the Sulphur Springs School District has requested that the City install a bus. loading zone for the Pinetree Community School. The proposed loading zone would be located on the east side of Gladiolus Drive south of Lotusgarden Drive.. This area is directly adjacent to the west boundary line of the Pinetree Community School. RECOMMENDED ACTION: Adopt Resolution No. 91-45 authorizing the parking prohibitions on Gladiolus Drive and direct staff to install. appropriate signsor curb markings to effect the parking prohibitions. ------------------------------------------------------------- 6. DRAFT ORDINANCE RELATING TO PEDDLING OF HIGHWAYS AND LOCATION RESTRICTIONS - ORDINANCE NO. 91-25 - At the Council. meeting of December 11, 1990, Council discussed this item and then introduced Ordinance No. 91-25. On January 8, 1991, Council was due to adopt the ordinance. However, after receiving public testimony,. the Council directed staff to consider certain revisions to ordinance and bring the ordinance back to the Council at a. future date. The Ordinance regulates the location of catering trucks and all other temporary roadside businesses in the City. Required parking provisions of the previous draft have been deleted. RECOMMENDED ACTION: IntroduceOrdinanceNo. 91-25, waive further reading and pass to second reading. -3- City Council Agenda May 14, 1991 COUNCIL ACTION 7. AB 939 REPORT - At the Council study session of May 1st, a presentation was made by the City's consultant,- EcoSource, on the Draft Source Reduction and Recycling Elements Report. A subcommittee of Councilmembers Rlajic and .Heidt were appointed to review with staff the proposed alternatives to be incorporated 'in the: final draft report to - be filed with the State.'' RECOMMENDED ACTION:' 1)Adopt, the - recommendation submitted by the consultant and staff as those items to be identified to be in this City's AB 939 plan which will be implemented; 2) Submit the final draft report to the State in September, 1991, and staff conduct an out -reach program with the community.to provide a better understanding of the magnitude and impacts of the City's AB 939 plan; 3) Direct staff to proceed with the advertisement of the solid waste coordinator positions immediately: Appointments contingent upon authorization - of the positions during the budget process; and 4) Council consider purchase of a solid waste management resource van during 1991-92 budget deliberations. CONSENT CALENDAR All matters listed under the Consent' Calendar will be enacted by one motion unless a request -is made for discussion in which case, the item(s) will be removed from the Consent Calendar and will be considered separately following this portion of the agenda. 8. AMENDMENTS TO THE MANUFACTURED HOME RENT ' STABILIZATION ORDINANCE NO. 90-38 - On April 23rd, Council was presented with Ordinance No. 91-24 which would provide procedural changes to the current Manufactured Home Rental Adjustment Ordinance No. 90-38. Council reviewed the Ordinance and directed staff to distribute information regarding changes` to interested citizens and to schedule the proposed Ordinance for action on May 14th. RECOMMENDED ACTION: Council allow time.to receivefurther input regarding possible changes in the Ordinance and direct that the Ordinance be rescheduled for action on May 28; 1991. ------------------------------------------------------------- 9. DATES FOR GENERAL PLAN CONSIDERATION - The Planning Commission is currently conducting public hearings on the General Plan and is expected to finalize its recommendation in mid-May., Following Planning Commission recommendation, the City Council will, of course, be considering the General Plan. With the schedule for a June adoption date, we have developed the schedule for City Council consideration. RECOMMENDED ACTION: Council review and confirm the dates for review of the draft General Plan. -4- City Council Agenda May 14, 1991 COUNCIL ACTION 10. RADIUS REQUIREMENTS FOR PUBLIC HEARINGS.- At its meeting of April 9, 1991, the Council conducted public hearings on ordinances to unify the appeal periods of land use decisions, and the notice periods for public hearings. As part of its discussion, the Council requested that staff bring back information regarding. the, mailing radius for notification to the Council at a 'later --date. Staff has researched -,the'-- code .thecode and the City's application submittal, requirements resolution and -found that the radius requirements are virtually uniform, at 500 feet. All entitlements that require a radius to be noticed by mail to the property owners require at least 500 feet. Only one entitlement, a cemetery permit, is different and may require a mile and one-half mailing radius in certain instances. RECOMMENDED ACTION: Receive and file. ------------------------------------------------------------- 11. AWARD OF BID FOR SANTA CLARITA PARR POOL RENOVATION - The Parks and Recreation Department continued .the rehabilitation of older park facilities by opening bids for the renovation of Santa Clarita Park Pool on April 19, 1991. The renovation includes the installation of a new automated pool water filtering system, some new tile work, relocation of life guard chairs, expansion of existing storage facilities and other related improvements. RECOMMENDED .ACTION: Award the contract for the renovation to Western Waterfeatures in the amount of $69,953 and that a contingency of an additional $7,000 be encumbered for any change orders that may become necessary once the demolition and construction commences., ------------------------------------------------------------- 12. VALENCIA BOULEVARD AT CREEESIDE ROAD - PROJECT 89-12 BID AWARD - On March 26, 1991, the City Council authorized the advertisement of the subject project. This project provides for the installation of traffic signals at Valencia Boulevard and Creekside Road. This project is eligible for Federal funds and has been identified as FAU Project NO. M -Q064 (600) CRP -L089(518). RECOMMENDED ACTION: Award the contract for installation of traffic signals to Intersection Maintenance Service. -5- City Council Agenda May 14, 1991 COUNCIL ACTION 13. SOUTH SIDE OF SAN FERNANDO ROAD 535 FEET NORTHWEST OF MEADOWRIDGE DRIVE PARCEL MAP NO. 22643 APPROVAL OF THE MAP AND ACCEPTANCE OF THE OFFERS OF DEDICATION - The Tentative Map was originally approved by the County of Los Angeles (VTTM 40761). On February. 6, 1990, the Planning Commission . granted a time extension. with-, conditions.. .--This . property. ,.was_,,., originally approved as a 180 -unit condominium project and subsequently revised and approved by the Planning Commission as a 158 -unit apartment complex. The developer is subdividing 21.49 acres into two residential planned development parcels. The conditions of approval have been met, the fees have been paid as indicated on the Fact Sheet and the map has been checked to the satisfaction of the City Engineer. RECOMMENDED ACTION: Approve the map, accept the easements for slope and flood control, covered storm drain and sewers, approve work agreements and improvement securities, and instruct the City Clerk to endorse the Certificate on the .face of the map. ------------------------------------------------------------- 14. WINTERDALE DRIVE, ET AL - PROJECT NO. 90-01 - PROJECT ACCEPTANCE - On January 29, 1991, Council awarded a contract for the subject project to Roy Allan Slurry Seal, Inc. This project was completed to the satisfaction of :the Director of Public Works on April 2, 1991. RECOMMENDED ACTION: Accept the work performed,. direct the City Clerk to file the Notice of Completion for the project and direct staff to release the 10 percent retention 35 days after the Notice of Completion is recorded, provided no stop notices by law have been filed. ------------------------------------------------------------- 15. RAINBOW GLEN VICINITY - SOUTHERLY TERMINUS OF GILBERT DRIVE - PARCEL MAP NO. 22038 -- APPROVAL OF THE MAP AND ACCEPTANCE OF THE OFFERS OF DEDICATION - The Tentative Map was originally approved by the City of , Santa Clarita Planning Commission on August 7, 1990 by Resolution No. 90-30. The developer is subdividing 80.98 acres into three planned development parcels. The conditions of approval have been met, the fees have been paid, and the map has been checked to the satisfaction of the City Engineer. RECOMMENDED ACTION: Approve the map, and instruct the City Clerk to endarse.the Certificate. ------------------------------------------------------------- 16. BUS SHELTERS/NEGOTIATED BID - Proposals from firms to provide and maintain Transit Bus Shelters which would display revenue producing advertising, at no cost to the City, required submittal of the proposals to the City Clerk by 11:00 a.m., April 30, 1991. Only Bustop Shelters of California responded with a proposal but the company representative was delayed in reporting to the City and was unable to :meet the 11:00 a.m. deadline. RECOMMENDED ACTION: Direct staff to enter into negotiations with bus stop shelter providers and return with a recommendation and suggested contract. ROTUNDA DRIVE ET AL (PROJECT 90-7) - STREET IMPROVEMENTS - READVERTISE FOR BIDS - On March 13, 1991, Council authorized advertisement of the subject project. The project provides for resurfacing and structural repairs in order to extend the service life of streets. Bids received exceeded the Engineer's -estimate. „ by •.:20.. to-.., 30 ..;percent. • ,Staff.: recommends that the specifications be modified to include either Asphalt -Rubber Hot Mix or Asphalt Concrete pavement and require only the normal 1 year maintenance warranty. Readvertising with the modifications should encourage a more competitive bid process. RECOMMENDED ACTION: Reject all bids, approve the modified plans and specifications for the project, and authorize the readvertising for bids. ------------------------------------------------------------- is. CHERRY STREET ET AL (PROJECT 90-6) READVERTISE.FOR BIDS - On March 26, 1991, Council authorized advertisement of this project. COUNTY LIGHTING MAINTENANCE DISTRICT CONSENT AND JURISDICTION PROJECT 78-38 - RESOLUTION NO. 91-64 - This item is for the Council to consider granting consent and jurisdiction to the County Lighting Maintenance District to annex territory located in the City to the District. RECOMMENDED ACTION: Adopt Resolution No. 91-64. ------------------------------------------------------------- 20. COUNTY LIGHTING MAINTENANCE DISTRICT CONSENT AND JURISDICTION PROJECTS 314-117 AND 316-117 - RESOLUTION NUMBERS 91-69 AND 91-70 - This item is for the Council to consider granting consent and jurisdiction to the County Lighting Maintenance District to annex territory. located in the City to the District. RECOMMENDED ACTION: Adopt Resolution Numbers 91-69 and 91-70. ------------------------------------------------------------- 21. COUNTY LIGHTING MAINTENANCE DISTRICT CONSENT AND JURISDICTION PROJECTS - 219-86, 291-107, 55-21 - RESOLUTION NUMBERS 91-80, 91-81, and 91-82 - This item is for the Council to consider granting consent and jurisdiction to the County Lighting Maintenance District to annex territory located in the City to the District. RECOMMENDED ACTION: Adopt Resolution Numbers 91-80, 91-81 and 91-82. -7- City Council Agenda May 14, 1991 COUNCIL ACTION 22. PROPOSED RESOLUTION ADOPTING A POLICY DISCOURAGING FUTURE LOT SPLITS OF PROPERTY ANNOTATED FROM PRIOR SUBDIVISION MAP APPROVALS IN THE COUNTY - RESOLUTION NO. 91-77 - Planning Commission has recently conducted hearings on proposed subdivisions for properties which were previously subdivided in the County. .The ,;subject+parcels,:are,.presently:identified on their underlying tract maps by the following note: "We hereby dedicate to the County, the.. right to restrict the erection of more than one single-family residence and related accessory structures." This note has caused concern among the Commissioners as to the propriety of allowing further subdivision of such parcels. RECOMMENDED ACTION: Adopt Resolution No. 22 modifying subdivision application procedures. ----------------------------------------- ------------------- 23. AMENDMENTS TO THE COMMUNITY DEVELOPMENT DEPARTMENT APPLICATION SUBMITTAL REQUIREMENTS - RESOLUTION NO. 91-65 - On June 26, .1990, the City Council adopted Resolution No. 90-118 establishing the Community .Development Department application submittal requirements. The Resolution provides for . information required for the processing of various zoning -and subdivision applications. , Subsequently, the Planning. Commission has developed procedures regarding processing applications for subdivisions to require a certification prior to public hearing that the subject property is free from all encumbrances, including dedications of the right to further. subdivide. RECOMMENDED ACTION: Adopt Resolution No. 91-65 amending the Community Development Dept. submittal requirements. ------------------------------------------------------------- 24. TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD) - TRACT NUMBERS 32306 AND 44846, PRIVATE DRAIN 2106 - RESOLUTION NUMBER 91-66 - The construction of Private Drain 2106 has been inspected and approved by the County Director of Public Works, who has sent a Notice of Completion to the City. The storm drains were constructed by the developer in accordance with agreements and the Faithful Performance Bonds on file with the City Clerk. RECOMMENDED ACTION: Adopt Resolution No.. 91-66 and direct the City Clerk to transmit a copy of the report,. and three certified copies of the Resolution to the County of Los Angeles. M -L City Council Agenda May 14, 1991 COUNCIL ACTION 25. TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD) - TRACT NO. 45284, PRIVATE DRAIN 2155 - RESOLUTION NO. 91-67 - The construction of Private Drain 2155 has been inspected and approved by the County Director of Public Works, who has sent a Notice of Completion to the City. The storm drains were constructed by the developer,. in accordance "with agreements and the Faithful Performance Bonds on file with the City Clerk. RECOMMENDED ACTION: Adopt Resolution No. 91-67, authorize the Mayor to execute the Quitclaim Deed and direct the City Clerk to transmit a copy of the report, three certified copies of the Resolution, and three signed copies of the Quitclaim Deed to the County of Los Angeles. ------------------------------------------------------------- 26. TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD) - TRACT NO. 44378, PRIVATE DRAIN 2045 - RESOLUTION NO. 91-68 - The construction of Private Drain 2045 has been inspected and approved by the County Director of Public Works, who has sent a Notice of Completion to the City. The storm drains were constructed by the developer in accordance with agreements and the Faithful Performance Bonds on file with the City Clerk. . RECOMMENDED ACTION: Adopt Resolution No. 91-68, direct City Clerk to transmit a copy of the report and three certified copies of the Resolution to the County of Los Angeles. ------------------------------------------------------------- 27. SAN FERNANDO ROAD - STATS/CITY DRAFT COOPERATIVE AGREEMENT - CONSTRUCTION - The City -has been working with Caltrans over the last' year and one-half to accomplish the widening of San Fernando Road. To date, the plans and specifications have been submitted to them, and they are in the process of giving the City approval to begin advertising. The Cooperative Agreement for consideration is to stipulate the responsibilities of the construction phase. RECOMMENDED ACTION: Adopt Resolution No. 91-61 and authorize the Mayor to sign the agreement after funding amounts have been entered. ------------------------------------------------------------- 28. SOLEDAD STREET; STILLMORE STREET; WHITES CANYON ROAD ET AL (PROJECT 90-13) - BID AWARD - At the meeting of April 9, 1991, Council authorized the advertisement of this project which were received by the City Clerk on May 7th. The project provides for a slurry seal coat composed of .liquid asphalt and sand to properly maintain and extend the service life of the streets. RECOMMENDED ACTION: Award contract to Pavement Coatings Co. in the amount of $88,143.43. 50 City. Council Agenda May 14, 1991 COUNCIL ACTION 29. PERFORMING ARTS CENTER FEASIBILITY STUDY. - Many organizations in the Santa Clarita Valley have expressed an interest in developing additional performing arts facilities to meet the needs for performing arts venues in our community. Earlier this year the City facilitated a meeting with several —organizationsParticipants . all - agreed that additional performing arts facilities would be needed in the Santa Clarita Valley. RECOMMENDED ACTION: Authorize staff to proceedwith a performing arts center feasibility study, and transfer $5,000 form the City Council contingency fund, account number 01-4101-290, to account number 01-9000-227. ------------------------------------------------------------- 30. VICINITY OF WHITES CANYON RD. SUMMARY VACATION OF SLOPE EASEMENT — RESOLUTION NO. 91-74 - The property owners adjacent to Whites Canyon Rd. and Soledad Canyon Rd. have requested a vacation of the portion of the slope easement bordering their property. The easement has been made unnecessary by the subsequent construction of the Whites Canyon Rd. improvements (including a retaining wall). RECOMMENDED ACTION: Adopt Resolution No. 91-74 summarily, vacating the slope easement bordering Whites Canyon Rd. ------------------------------------------------------------- 30a. NEW COUNTY TAX ON SOLID WASTE 'DISPOSAL FEES - RESOLUTION NO. 91-83 - On January 22, 1991, the L.A. County Board of Supervisors adopted County Ord. 91-0017 which imposed a 1OZ tax (10Z per ton) on tipping fees collected at landfills in the unincorporated County area. This action has a direct impact on this City's refuse rates since our haulers use the Chiquita Canyon Landfill. This County tax will increase residential refuse rates by 96C per home. -Rates will be increased from $16.85 to $17.81 starting June 1, 1991. RECOMMENDED ACTION: Adopt Resolution No. 91-83 replacing Resolution 91-28 Schedule of Refuse Rates. ------------------------------------------------------------- 31. RESOLUTION NO. 91-78 - Demand Warrant #8. RECOMMENDED ACTION: Adopt. -10- City Council Agenda May 14, 1991 COUNCIL ACTION NEW BUSINESS 32. VETERANS FLAG MEMORIAL AT CANYON COUNTRY PARE: (PROJECT NO. 90-21) - BID.AWARD - Council previously approved the concept of a veterans flag memorial at the regularly scheduled Council meeting of April 23, 1991. Subsequently, at the Council Study Session of May .1, r1991,_Council• authorize -staff -to solicit -bids ..' for the construction of this memorial:. Council further authorized that the funds not to exceed 1/2 of the total cost of this memorial or $40,000, whichever is less, be set aside in Capital Projects Acct. 25-99016-227. The bid opening is scheduled for May 14, 1991. The bid results and staff - recommendation for proceeding with the project will be provided orally at this Council meeting. RECOMMENDED ACTION: Receive an oral report . concerning the status, of this memorial, and direct staff. ------------------------------------------------------------- 33. VALENCIA COMMERCE CENTER: REPORT AND RESOLUTION IN SUPPORT OF PROJECT AND REQUESTING THAT THE COUNTY MITIGATE INFRASTRUCTURE AND TRAFFIC IMPACTS TO THE CITY OF SANTA CLARITA - RESOLUTION NO. 91-79 - On May 23rd, the L.A. County Board of Supervisors will conduct a public. hearing regarding the Valencia Company's proposed Commerce Center. The project was approved by the .Regional Planning Commission on October 24, 1990. A citizen's group will be appealing the Commission's decision on the 23rd. RECOMMENDED ACTION: Adopt Resolution No.91-79 and direct staff to transmit it with cover letter to Board of supervisors at the public hearing on this project .on May 23, 1991. ------------------------------------------------------------- 34. POLICY REGARDING THE USE OF COUNCIL CHAMBERS - At the Council meeting of August 22, 1989, Council adopted Resolution No. 89-112 setting forth the policy for the use of the Council Chambers. It has been brought to the attention of the staff that the policy should be discussed by the Council.
