PUBLIC HEARING
1. TRANSIT MITIGATION IN LIEU OF FEE - RESOLUTION NOS.
91-154 & 91-155 - ORDINANCE NOS. 91-46 i'91-47 -
This item is on the agenda as an urgency resolution
setting proposed $200.00 per dwelling unit fee as an
interim fee for transit -related projects. If
adopted, this fee would - apply only to new,
residential projects and would be in effect until
the development impact fee study and Ordinance is
completed. RECOMMENDED ACTION: Adopt Resolution
Nos. 91-154 and 91-155; adopt Ordinance No. 91-46 as
an urgency ordinance; introduce Ordinance No. 91-47,
waive further reading and pass to second reading.

COUNCIL ACTION
2. WATER CONSERVATIONORDINANCE RECOMMENDED CHANGES -
ORDINANCE NO. 91-48 - On September 24, 1991 the
Council reviewed four changes to the Water
Conservation Ordinance that were recommended by the
Drought Committee. The Council reviewed the.changes
and directed staff to bring back the Ordinance as
amended and set a Public Hearing on the matter.
RECOMMENDED ACTION: Conduct Public Hearing and
adopt Ordinance No. 91-48 as an Urgency Ordinance.

3. _ DEVELOPMENT AGREEMENT 91-003 (WESTON) - ORDINANCE
NO. 91-40 - VESTING TENTATIVE TRACT MAP 46626
LOCATED NORTH OF THE TERMINUS OF FO%LANE DRIVE,
TAMBORA DRIVE AND BAKERTON AVENUE - ORDINANCE NO.
41-40 - This is a Quasi -Judicial proceeding. This
item is a continued public hearing from September
24, 1991. The applicant is requesting a Development
Agreement to allow ten years for the build -out of
Vesting Tentative Tract Map 46626. Vesting
Tentative Tract Map 46626 consists of 201 homes on
80 acres located north of Whites Canyon Rd. and
Nadal Street, north of the terminus of Foslane
Drive, Tambora Drive and Bakerton Avenue.
.RECOMMENDED ACTION: Receive staff presentation and
-
public testimony, approve the Negative Declaration,
approve Development Agreement 91-003, introduce
Ordinance No. 91-40, waive further reading, and pass
to second reading.

4. DEVELOPMENT AGREEMENT 91-004 (AMERICAN LANDMARK) -
ORDINANCE NO. 91-41 - VESTING TENTATIVE TRACT MAP
47863 LOCATED NORTH OF WHITES CANYON RD. BETWEEN
NADAL STREET AND WILDWIND RD. - ORDINANCE NO. 91-41
This is a Quasi -Judicial proceeding. This item is a
continued public hearing from September 24, 1991.
The applicant is requesting a Development Agreement
to allow ten years for the build -out of Vesting
Tentative Tract Map 47863. Vesting Tentative Tract
Map 47863 consists of 80 homes on 32 acres and is
located north of Whites Canyon Rd. between Nadal
Street and Wildwind Rd. RECOMMENDED ACTION:
Receive staff presentation and public testimony,
approve the Negative Declaration, approve
Development. Agreement 91-004, introduce Ordinance
No. 91-004, waive further ,reading, and pass_ to
second reading.
UNFINISHED BUSINESS
5. TROPICAL TIMBER RESOLUTION - RESOLUTION NO. 91-91 -
At the May 28, 1991 meeting of the City Council,
several questions were raised regarding the
implementation of the proposed Resolution No. 91-91
restricting the City from purchasing items made from
rainforest hardwoods. Staff has researched the
questions brought up by the Council. RECOMMENDED
ACTION: Adopt Resolution No. 91-91 and direct staff
to enforce this resolution throughout the City's
departments.

COUNCIL ACTION
6. AGUA DULCE AIRPORT EXPANSION - On August 27, 1991,
Council received a report from staff concerning the
proposed acquisition and expansion of the Ague Dulce
Airport by Los Angeles County. The staff report
recommended that the City remain neutral on this
issue, as Agua Dulce is not within the City's
planning area. RECOMMENDED ACTION: Receive report.

7. COMMISSION APPOINTMENTS - ORDINANCE NO. 91-49 -
Adoption of ordinance relative to commission
appointment process. RECOMMENDED ACTION: Waive
further reading and pass to second reading.

8. ZONE CHANGE 90-013 AND TENTATIVE PARCEL MAP 22539,
MASTER CASE NUMBER 90-177 (HAL GOOD) - ORDINANCE NO.
91-42 - The applicant is requesting approval for a
zone -change from A-1-2 to A-1-1 to allow for the
subdivision of a 2.68 acre parcel into two single
family residential lots consisting of 1.43 and 1.25
acres, respectively. RECOMMENDED ACTION: Adopt
Ordinance No. 91-42.

9. DEVELOPMENT 'AGREEMENT 91-001 (P & V) - ORDINANCE NO.
91-43 - The applicant is requesting a Development
Agreement (91-001) to allow ten years for the
build -out of Vesting Tract Map 45416. Vesting
Tentative Tract Map 45416 contains 253 homes on 121
acres and is located at the Western Terminus. of
Canvas Street and southerly of Sierra Hwy.
RECOMMENDED ACTION: Waive further reading and adopt
Ordinance No. 91-43.
10. DEVELOPMENT AGREEMENT 91-002 (P. & V) - ORDINANCE NO.
91-44 - The applicant is requesting a Development
Agreement (91-002) to allow ten years for the
build -out of Vesting Tract Map 48108. Vesting
Tentative Tract, Map 48108 consists of 161 homes and
a Junior High School site on 80 acres southerly of
Via Princessa and Easterly of Rainbow Glen Drive.
RECOMMENDED ACTION: Waive further reading and adopt
Ordinance No. 91-44.

11. RESOLUTION 91-161 FORMALLY DENYING THE APPLICANT'S
APPEAL REQUEST OF THE PLANNING COMMISSION'S 'DENIAL
OF CONDITIONAL USE PERMIT '90-032 (SHELDON POLLACK
Pursuant to the Council action of September "24,
1991, staff has prepared a draft resolution of
denial for the construction of a 30,740 sq.ft. auto
service center which fronts on Soledad Canyon Rd.,
approx. 100' west of the northwest corner of Soledad
Canyon Rd. and Langside Dr. Zone Change 90-014 will
be referred back to the Planning Commission.
RECOMMENDED ACTION: Adopt Resolution No. 91-161,
formally denying Conditional Use Permit 90-032.

COUNCIL ACTION
All matters listed under the Consent Calendar will be
enacted by one motion unless a request is made for
discussion in which case,' the .item(s) will be removed
from the Consent Calendar and will be considered
separately following this portion of the agenda.
12. COMMUNITY DEVELOPMENT BLOCK GRANT FAIR HOUSING
SERVICES PROGRAM AGREEMENT - On July 23, 1991, the
City entered into an agreement with the United
States Department of Housing and Urban Development
(HUD) to receive $522,000 in CDBG program revenues
for fiscal year 1991-92. The Fair Housing Services
program was approved by City Council and submitted
to HUD as part of the City's final statement. This
program satisfies the City's HUD requirement to
affirmatively further fair housing in the City.
RECOMMEND ACTION: City Council to direct staff to
enter into an agreement with the Fair Housing
Council of San Fernando Valley for extension
services retroactive to July 23, 1991 through
October 23, 1991, authorize payment of $5,000 for
and approve continuation of services through June
30, 1991 at a cost of.$10,000.

13. AWARD BID FOR THE NEWHALL PARR RESTROOM AND
CONCESSION FACILITY - The Parks and Recreation
Department has completed the bidding process for the
Newhall Restroom and Concession Facility as
authorized by Councilat its August 27, 1991
meeting. Bids were publicly opened by the. City
Clerk on September 24, 1991. RECOMMENDED ACTION:
Award the contract to McAlpine and Salyer
Construction, Inc. and transfer an additional
$20,000 from Account 25-99013-2272 to Account
25-990011227 for any change orders which may become
necessary.

14. AWARD OF TREE PEST CONTROL, WEED ABATEMENT AND
FERTILIZATION CONTRACT - On September 3rd, the City
Clerk opened three bids for tree pest control, weed
abatement and fertilization of approximately 8500
trees. RECOMMENDED ACTION: Council award
contract to the low bidder, Arbor Tree Surgery and
authorize the City Manager to execute the contract
after the required bonds and insurance forms have
been submitted by the contractor.

COUNCIL ACTION
15. SOLEDAD CANYON ROAD AT SANTA CLARA RIVER BRIDGE
WIDENING PROJECT 91 -03 -ENGINEERING SERVICES. - The
subject project consists of widening the bridge on
Soledad Canyon Road west of Camp Plenty Road to
provide three lanes for traffic in each direction.
When complete, this project will support restriping
of Valencia Blvd./Soledad Canyon Rd, to provide
three lanes for traffic in each direction between
I-5 and Sand Canyon Road. Thirteen firms responded
to the City's Request for Proposal. RECOMMENDED
ACTION: Approve budget transfer of $350,000 from
Contingency Account 01-4101-290 to Capital Project
Account 25-95003-227 with the understanding funds to
be returned once Public Financing Authority revenue
bond monies are available and enter into
negotiations with Dokken Engineering for engineering
services.

16. NORTH SIDE OF VIA PRINCESSA BETWEEN SIERRA HIGHWAY
AND STATE ROUTE 14 - PRICE' CLUB - TRACT MAP NO.
50484, PHASE I OF PARENT TRACT 50151 APPROVAL OF THE
HAP AND ACCEPTANCE OF THE OFFERS OF DEDICATION - The
Tentative Map was originally approved by ,the City
Planning Commission on December 18, 1990 by
Resolution 90-57. The developer is subdividing
15.78 acres into two commercial lots. The
conditions of approval have been met, the fees have
been paid as indicated on the Fact Sheet and the map
has been checked to the satisfaction of the City
Engineer. RECOMMENDED ACTION: Approve the map,
accept the dedication for streets, sewers, and other
dedications, approve the work agreements and
improvement securities required; make findings on
project, instruct the City Clerk to endorse the
Certificate on the face of the map which embodies
the approval of said map and the acceptance of the
dedications.

17. TRANSFER OF STORM 'DRAIN TO LOS ANGELES COUNTY FLOOD
CONTROL DISTRICT (LACFCD) - 'TRACT NUMBER 43115,
PRIVATE DRAIN 1989 - RESOLUTION NO. 91-158 - The
construction of Private Drain 1989 has been
inspected and. approved by the County Director- of
Public Works, who has sent a Notice of Completion to
the City. The storm drains were constructed by the
developer in accordance with agreements and the
Faithful Performance Bonds on file with the City
Clerk. RECOMMENDED ACTION: Adopt the resolution,
direct the City Clerk to transmit a copy of the
report indicating the date and action taken and
three certified copies of the resolution to Mr. Stan
Dixon at the County of Las Angeles.

PORTION OF PRIVATE DRAIN 2001 UNIT II - RESOLUTION
NO. 91-159 - The construction of Private Drain 2001
Unit II has been inspected and approved by the
County Director of Public Works, who has sent a
Notice of Completion to the City. The storm drains
were constructed by the developer in accordance with .
agreements and the Faithful Performance Bonds on
file with the City Clerk. RECOMMENDED ACTION:
Adopt the resolution, direct the City Clerk to
transmit a copy of the report indicating the date
and action taken and three certified copies of the
resolution to Mr. Stan Dixon at the County of. Los
Angeles.

36300 AND 42466, P.D. 1674 - RESOLUTION NO. 91-160 -
The construction of Private Drains 1123 and 1674
have been inspected and approved by the County
.Director of Public Works, who has sent a Notice of
Completion to the City. The storm drains were
constructed by the developer in accordance with
agreements and the Faithful. Performance Bonds on
file with the City Clerk. RECOMMENDED ACTION:
Adopt the resolution, authorize the Mayor to execute
the Quitclaim Deed for the easements to the LACFCD,
and direct the City Clerk to transmit a copy of this
report indicating the date and action taken, three
certified copies of the unrecorded Quitclaim Deed
property executed and acknowledge, and three
certified copies of the resolution to Mr. Stan Dixon
at the County of Los Angeles.

!0. SECO CANYON AND PAMPLICO, VICINITY OF QUITCLAIM
STORM DRAIN EASEMENT - TRACT NO. 45284, PRIVATE
DRAIN 2155 - This item is on the Council agenda for
the Council to authorize the Mayor to execute the
quitclaim deed for storm drain easements on behalf
of the City. It is standard procedure in the case
of storm drain transfer for the City to quitclaim to
the Flood Control District certain easements for
storm drain maintenance. RECOMMENDED ACTION:
Approve the quitclaim of storm drain easement for
Private Drain No. 2155 Tract No. 45284 and authorize
the Mayor to execute the attached quitclaim deed on
behalf of the City and send three copies to Stand
Dixon at the County of Los Angeles.

COUNCIL ACTION
21. SOLEDAD STREET; STILLMORE STREET; WHITES CANYON ROAD
ET AL (PROJECT 90-13) - PROJECT ACCEPTANCE - On May
14, 1991, Council awarded a contract for the subject
project to Pavement Coatings Co. This project was
completed to the satisfaction of the Director of
Community Development on, September 20, 1991. This
project was completed approximately- three weeks
ahead of schedule and within the budget forannual
maintenance projects. RECOMMENDED. ACTION: Council
accept the work performed by Pavement Coating Co.,
direct the City Clerk to file the Notice of
Completion for the project, and direct staff to
release the 10 percent retention 35 days after the
Notice of Completion is recorded.

22. FUND REQUEST FOR SANTA CLARA RIVER ENHANCEMENTS -
The Valencia Company recently pleaded no contest to
misdemeanor charges that the developer illegally
altered the. beds of the Santa Clara. River and
Bouquet Creed. Thesealterations are viewed as
potentially impacting critical habitat to the
unarmored threespine stickleback and the least
Bell's vireo. RECOMMENDED ACTION: Transmit a
letter to the Director of California Dept. of Fish
.and Game requesting that $90,000 restitution paid by
the Valencia Company be spent locally in connection
with improvements to the Santa Clara River.

NEW BUSINESS
26. ENTERTAINMENT ATTRACTION CONCEPT REQUEST FOR
PROPOSAL (RFP) - On April 27, 1991, the City's first
strategic planning process occurred. At the
meeting, City officials and community members met to
assess the needs of the community. The attraction
of an entertainment center was targeted to address
the shortage of leisure activities in the Santa
Clarita Valley. Staff has completed the preliminary
work for attracting :new family-oriented amusement
industries. RECOMMENDED ACTION: Review the RFP,
make any necessary changes, direct staff to proceed
with RFP solicitation, and return to the City
Council with the results of the attraction efforts.

COUNCIL ACTION
27. LOS ANGELES COUNTY PARK. BEACH AND RECREATION'ACT OF
1992 - The Los Angeles County Park,. Beach and
Recreation Act of 1992 will provide a substantial
source of park development and requisition funds if
approved by the electorate. The Mountains
Recreation and Conservation Authority is requesting
agencies to submit proposals for specific regional
projects. RECOMMENDED ACTION: Council approve the
priority list for the proposed specific regional
projects for the Los Angeles County Park, Beach and
Recreation Act. of 1992 and authorize the City
Manager to submit them to the Mountains Recreation
and Conservation Authority for possible inclusion in
the Los Angeles County Park, Beach, and Recreation
Act of 1992.

28. SPHERE OF INFLUENCE, DALE POE DEVELOPMENT - On
October 1, 1991, Jeff Stevenson, from. Dale Poe
Development, requested to meet with the Community
Development Director as a follow-up to a previous
meeting where a dialogue had begun aimed at gaining
this developer's neutrality or support for our
sphere of influence request. RECOMMENDED ACTION:
Review memo and give direction to staff on how to
structure a response.

29. TEAM BUILDING SESSION - Previously Council expressed
an interest in conducting team building. sessions
every six months. Given that the.last session was
held in February of this year, it is now appropriate
to calendar the next session if desired.
RECOMMENDED ACTION: Discuss potential dates for the
next team building session and direct staff to
coordinate.

This time has been set aside for the public to address
the City Council on any item on the agenda except for the
public hearings. The public may also address the Council
on items not on the agenda but those items will not be
acted upon by Council at this meeting other than to
review and return without action or direct staff.
