HomeMy WebLinkAbout1991-08-13 - RESOLUTIONS - STORMDRN IMPROV DRAIN 2065 (2)RESOLUTION NO. 91-115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT THE TRANSFER AND CONVEYANCE OF THE STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO. 2065; IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage systems known as Private Drain Nos. 2065; described in the corresponding Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control .� District entered into an agreement dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit A attached hereto from the City to the Los Angles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage systems described in said Exhibit A. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, r-- improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore have been conveyed to and accepted by District. Resolution 91-115 Page 2 Reference is hereby made to District Drawings Nos. 43-F332.1-.4; the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated here by this reference. The City Clerk shall certify to the adoption of this Resolution. Grindey, C ty Clerk EXHIBIT "A" PRIVATE DRAIN N0. 2065 A reinforced concrete pipe storm drain system and appurtenant structures for Tract Map No. 31024, filed in Book 1088, pages 79 to 88, inclusive of maps, records of the County of Los Angeles, generally described as follows: LINE "A" Commencing from an existing storm drain per P.D. No. 1194 within a variable width easement to the County of Los Angeles for storm drain purposes, located approximately 175 feet north of the center line of Sierra Highway, 550' feet east of the center line intersection of Rainbow Glen Drive and Sierra Highway; thence southerly and westerly within an existing 12 -foot -wide easement to the Los Angeles County Flood Control District for covered storm drain and appurtenant structures and ingress and egress purposes; thence southerly in Sierra Highway to a variable width easement for flood control purposes; thence southerly within last said easement to an inlet structure, Station 5 + 94.74, a distance of 572 feet, more or less. LATERALS "A-2," AND "A-4.1- Connector A-4."Connector pipes from the existing storm drain per P.D. No. 2065 Line "A" to an existing concrete swale and debris tower. LINE "B" Commencing from a manhole structure per Line "A," Station 4 + 14.91 (Station 1 + 50.00 Line "B") located approximately 80 feet north of the center line of Sierra Highway and 240 feet east of the center line intersection of Rainbow Glen Drive and Sierra Highway thence easterly, northerly and easterly, within a 15 -feet -wide easement to the Los Angeles County Flood Control Department for covered storm drain and appurtenant structures and ingress and egress purposes; thence northerly within Azure Field Road to a catch basin. LATERAL "B-1" Connector pipe from existing storm drain per P.D. No. 2065 Line "B" to an existing catch basin. LINE "C" Commencing from an existing storm drain per P.D. No. 1453, Station 4 + 87.23, located within a 10 -foot -wide easement to the Los Angeles County Flood Control District for covered storm drain and appurtenant structures and ingress and egress purposes approximately 240 feet west of the terminus of Crimson Court; thence easterly within said easement to a catch basin, Station 3 + 38.30, a distance of 238 feet more or less.
