HomeMy WebLinkAbout1991-08-13 - RESOLUTIONS - STORMDRN IMPROV DRAIN 2085 (2)RESOLUTION NO. 91-115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT THE TRANSFER AND CONVEYANCE OF THE STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO. 2085, IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated to, or the City' has otherwise acquired, the storm drain improvements and drainage systems known as Private Drain No. 2085; described in the corresponding Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit A attached hereto from the City to the Los Angles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit A. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore have been conveyed to and accepted by District. Resolution 91-115 Page 2 Reference is hereby made to District Drawings Nos. 43-F24.1-.5; the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated here by this reference. The City Clerk shall certify to the adoption of this Resolution. Grindey, City Clerk NED:487 EKE BIT "A" Private Drain No. 2085 A reinforced concrete pipe and box storm drain system and appurtenant structures for Tract Map No. 43114, filed in Book 1091, pages 55 to 58 inclusive, of Maps, Records of the County of Los Angeles, generally described as follows: Line "A" Commencing from an existing Caltrans concrete Trap Channel south of Soledad Canyon Road and west of Oak Spring Canyon Road; thence northeasterly to variable width easement for covered storm drain, appurtenances and ingress and egress; thence northerly, northwesterly, and northerly in last mentioned easement to a variable width easement for flood control purposes; thence northwesterly in last said mentioned easement to an inlet structure, Station 6 + 33.94, a distance of 439 feet, more or less. Lateral "F" A connector pipe from Line "A" to catch basin within a 60 -foot wide easement. Line "B" Commencing from an existing Caltrans concrete Trap Channel south of Soledad Canyon Road and west of Oak Spring Canyon Road; thence northeasterly and easterly within Soledad Canyon Road to a series of catch basins, Stations 3 + '.. 04.28 and 3 + 64.28, a distance of 204 feet, more or less. Line "C" Commencing from a manhole structure per Line "A," Station 3 + 80.17 (Station 1 + 00.00, Line C) located within a 12 -foot wide easement for covered storm drain, appurtenances and ingress and egress; thence northeasterly within last said mentioned easement to a variable width easement for flood control purposes, Station 2 + 57.55, a distance of 122 feet, more or less. Line "D" Commencing from a manhole structure per Line "A", Station 4 + 92.19 (Station 1 + 00.00, Line "D"), located in a variable width easement for covered storm drain, appurtenances and ingress and egress; thence southwesterly and westerly within last said mentioned easement, to a variable width easement for flood control purposes; thence westerly to an inlet structure, Station 2 + 13.70, a distance of 113 feet, more or less. Line "S" Commencing from an existing concrete rectangular channel, at the intersection of Soledad Canyon Road and Oak Spring Canyon Road; thence northerly within Soledad Canyon Road and Oak Spring Canyon Road to a terminal catch basin, Station 2 + 85.04, a distance of 185 feet, more or less. All as shown on District Drawing Nos. 43-F324.1 through 43-F324.5.
