Final Statement Amendment Policy

BACKGROUND
Beginning with Fiscal Year 1991-92, the City of Santa Clarita receives Community
Development Block Grant (CDBG) funds as an entitlement grantee from the U.S.
Department .of Housing and Urban Development (HUD). Federal regulations govern
the administration of the CDBG program.
For the purposes of complying with HUD regulations Title 24 CFR, Section
570.305, there is a need for the City to develop a policy for amending its final
statement for the CDBG program. The policy must provide citizens with
reasonable notice of, and.opportunity to comment on such proposed changes in its
use of funds. Additionally, the City must develop and make public its criteria
for what is considered a substantial change.
City staff has developed a policy for amending its final statement for Council
to consider.. The policy outlines the City's amendment process and defines the
City's criteria of a substantial change.
In summary, the City's -policy for amending its final statement for the CDBG
program will be initiated whenever the City decides not to carry out an activity
not previously described, to carry out an activity not previously described, or
to substantially change the purpose, scope, location or beneficiaries of a
project activity. An increase or decrease in proposed funds, beneficiaries
served, .and/or project scope for a specific activity of more than 25 -percent
will be considered a .substantial change. Council approval of proposed changes
is necessary to amend the City's Final Statement for CDBG.
City Council adopt policy and direct staff- to make public its criteria for
substantial change.

FINAL STATEMENT AMENDMENT PROCESS
STANDARD MANAGEMENT PROCEDURE
I. Purpose:
The purpose of this Standard Management Procedure is to define and
establish the procedure to be followed to amend the City's Final
Statement of Community Development Objectives and Projected Use of
Funds for the City's Community Development Block Grant (CDBG)
Program, referred to as the City's.Final Statement for CDBG.
II. Procedure:
The City's Final- statement for CDBG Program may be amended if
statutory requirements of 24 CFR Part 570.305 of the U.S.
Department of Housing and Urban Development (HUD) Handbook 6500
regarding the Community Development Block Grant (CDBG) Program
(September 1988) are met. As part of Section 570.305, the City
shall develop and make public its criteria .for what constitutes a
"substantial change" for the CDBG Program.
Prior to amending the City's Final Statement, the grantee shall
provide citizens with reasonable notice of, and opportunity to
comment on, such proposed changes in its use of funds. The City
shall consider any such comments and, if the City deems
appropriate, modify the changes.
In accordance with 24 CFR, Part 570. 305, the City shall amend its
final statement whenever the City decides:
1) not to carry out an activity described in the City's
Final Statement for CDBG.
2) the City 'decides to carry out an activity not previously
described in it Final Statement or
3) to substantially change the purpose, scope, location, or
beneficiaries of an activity
For purposes of a definition of substantial change, the City of
Santa Clarita will consider a substantial change to occur under
the following conditions:
1. The amount to be expended for an activity level of
beneficiaries served and project scope is proposed to be
increased .or decreased from the amount in the City's Final
Statement by more than 25 -percent;
2. The location of the activity is changed from the location
as described in the City's Final Statement;

3. An addition of a proposed activity which was not adopted by
City Council in the City's final statement; or
4. A deletion of a proposed activity which was adopted by City
Council and described in the City's final statement.
In cases where it is determined the City's definition of
substantial change applies and the amendment is of substantial
change, the City's citizen participation requirements must be met
and citizen comments considered prior to the City's amendment of
its final statement. Council adoption of proposed changes is
necessary to amend the City's.Final Statement for CDBG.
The City will meet the following procedure and citizen
participation requirements and consider comments prior to amending
its final statement:
1. The City will publish a notice of proposed substantial
changes in a newspaper whose primary circulation is within
the City.
2. The City will post notices at the City Clerk's Office, Santa
Clarita Post Office, and Valencia, Canyon Country and
Newhall libraries.
3. The notice of proposed substantial changes will be published
once and written comments received for a period of seven
days to allow an opportunity for citizens to comment on
proposed changes.
4. Written comments provided by citizens regarding notice of
proposed substantial changes may be mailed to the Department
of Parks and Recreation. Citizen comments will be
considered and if the City deems appropriate, modify the
changes.
5. City Council may adopt or deny proposed changes.
6. The City will maintain supporting documentation that citizen
participation requirements have been met.
7. The City will formally amend its final statement by
transmitting a letter to U.S. Department of ,Housing and
Urban Development (HUD) indicating that the City has
conducted its amendment process and fulfilled its citizen
participation requirements. The letter will describe any
changes adopted by the City Council and be signed by the
City Manager or his designated representative.
8. The City shall make available to the public a description of
changes adopted by publishing a notice in a newspaper whose
primary circulation is within the City.

9. The Department of Parks and Recreation, upon completion of
the amendment process will be able to implement the
substantial change and if applicable initiate the transfer
of CDBG funds in accordance with the City's established
budget amendment and transfer procedures outlined in the
City's Standard Management Procedure Manual, VII -1,
effective May 1, 1989.
