Staff has conferred with legal counsel regarding the use of the word "Proposal" in the Bid
Notification. Legal counsel has determined that since all other documents and procedures were
in accordance with formal bid procedures, this procedure qualifies as a Formal Bid.
Although there are several "Non -Responsive" bids, legal counsel determined that division of
the requirements was not an option in the bid specifications, and sufficient complete bids were
submitted to make an award based on competitive bids.
Pleion Corporation has submitted the lowest, most -qualified bid, and has performed well for
the City in past.
Award the bid to Pleion as the lowest, most -qualified bidder per
staff's statements above.
