SUBJECT: County Monitoring: Westridge Project: Consideration of Appeal

As was previously reported to Council (March 10, 1992), on February 12th, the
Regional Planning Commission (RPC) directed Regional Planning staff to prepare

findings and conditions for approval of the proposed "Westridge" project, and
to respond to the Commission's concerns regarding the project. The
configuration as approved is:
Project area: 798 acres
SEA 64 area: 306 acres
Impacted SEA 64 area: 200
1868 total residential units
Project amenities:
Elementary school and park site
Golf course
Commercial areas
211 of 1296 oak trees are proposed to be removed.
Among the Commission's concerns were: reducing the project's impact on SEA 64,
"scaling down" the project, preservation of existing topography, relocating
trees, justification of the golf, course in the SEA, and justification of
commercial development in the SEA. On June 17, the RPC will have adopted the
findings and conditions for approval. (The conditions of approval were
delivered to the City at 4:15 p.m. on Thursday, June 11, and are under review
by City staff; any noteworthy conditionswill be presented to Council in the
oral report.) However, the following changes (which appear toincrease the
project's impacts) have apparently been incorporated into the project:
- The number of units has increased from 1868 (as shown on 12/15/91)
tentative map) to 1890. (1890.units were analyzed in the Supplemental
Environmental Impact Report.)
- The number of oak trees to be removed has increased from 211 to 232
(includes 152 in the SEA).
- The total number of oak trees on the site has decreased from 1296 to
1291.
The City has consistently requested that the County protect and preserve SEA
64 (Resolutions 91-19 and 91-167). On March 10, Council considered three
approaches for action on the Westridge project, and directed staff to pursue
an "active approach" and appeal the decision to the Board of Supervisors,
subject to the nature of the conditions. Staff has been informed by Regional
Planning staff that no. changes have been made to the tentative map; without
changes to the map, the City's concerns'may not be addressed satisfactorily.

It is staff's understanding that the appeal period for the project is June 18
- 27; the appeal fees are $3,490.40 . (includes $3,230.40 for the Conditional
Use Permit and the Oak Tree Permit, and $260:00 for the tract map). The
public hearing before the Board of Supervisors for the plan amendment and zone
change has not been scheduled. to date; when it is scheduled, the appeal
hearing will occur at the same time.
RECOMMENDATION
Receive report, authorize staff to pursue the appeal of the project to the
Board of Supervisors, including payment of necessary fees.
