The Council recited the following advantages to the extension: 1) The .extension will provide..an all weather alternative access for emergency vehicles for residents of Oak Springs Canyon Road. 2) The extension will provide a safer and improved travel route to Sand Canyon Road for Oak Springs Canyon residents and can be incorporated into the ultimate circulation plan for the Sand Canyon area. The driveway would extend from Comet Way (a public street) through private property to Oak Springs Canyon Road (a private street). This driveway would be constructed on both private property and property previously offered for private and future roadway purposes. The driveway design has been reviewed and approved by the City's Engineering Division. No gate was considered or approved during the public hearings. The driveway will accommodate two-way traffic and have concrete swales on both sides. The City requested that the connection to Oak Springs Canyon Road be designed at a 90 degree angle, and this necessitates a divergence from the previously offered private and future right-of-way area. Construction of the driveway is expected soon. A majority of the residents of Oak Springs Canyon Road want the connection to Comet Way to be available for their daily use. The residents of Comet Way originally asked that this connection be available only during emergencies, but have recently suggested that it be available at all times, but -be gated. Presently, approximately half of the residents of Oak Springs Canyon Road are using the unimproved access as a way to their homes. Complaints from both. the Oak Springs and Comet Way residents have been filed with the City and Sheriff's Department. Recently, staff conducted a mediation meeting with the residents of the Oak Springs Canyon area and Comet Way concerning the usage of the extension and future City actions. This meeting was unsuccessful in reaching a consensus. A majority of the 68 households on Oak Springs Canyon Road are in favor of unrestricted access as originally envisioned by the City. A- majority of the 15-20 households on Comet Way prefer that the access be gated. Agenda Item: Page 2 Goals and policies of the General Plan support roadway systems that provide through access. Therefore the City Planning and Engineering Divisions are proceeding on the following courses of action: 1) Staff will issue an encroachment permit. This action will permit the connection of the private driveway with Comet Way (a public street). 2) Upon completion of the driveway, staff will conduct a field inspection of the improvement verifying it has been constructed in compliance with the approved design. 3) Staff will not approve a gate as a part of the improvement. 4) Staff will work with the Comet Way developer to ensure that a gate will not be constructed. RECONNaIDATION Staff recommends that the City Council: Receive the staff report and file. As previously mentioned, we have nothing on record that indicates this is a legal private access. Whatever the case, your request to have a local contractor. upgrade this roadway is un- acceptable to Southern Pacific Transportation Company. After a discussion with our Field Engineer who investigated this request, we are of the opinion that local government agencies are al- lowing this area to develop without regard to you or your neighbors' concerns involving adequate ingress and egress. It is not the re- sponsibility of SPT Co. to provide for this. Furthermore, the increasing traffic volume created by residen- tial development in this area, as well as emergency vehicle access, is the responsibility of local government and the developer, not SPT Co. • B-441.19/Humphreys Page 2 Monterey Park, January 28, 1992 Based on the extensive future development in this area, our recommendation would be for you to pursue the extension of Comet Way (an existing internal street in this area) the short distance required to connect it with Oak Springs Canyon Road, thus creating the "public" access this area should have.
