SUBJECT: TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD. CONTROL
DISTRICT (LACFCD)
TRACT NUMBER 32321, PRIVATE DRAIN NO. 1975

BACKGROUND
The construction of Private Drain No. 1975 has been inspected and approved by
the County Director of Public Works, who has sent a Notice of Completion to
the City. The storm drains were. constructed by the developer in accordance
with agreements and the Faithful Performance Bonds on file with the City Clerk
(see Exhibit "B: attached showing the location and extent of improvements).
The agreements also provide that the work shall not be deemed completed until
approved, accepted as complete, and transferred to LACFCD for maintenance.
The City and County entered into an agreement on March 14, 1989 recorded as
Document Number 89-1346418 which provides for the transfer of storm drains.
The City Council must approve a resolution authorizing the transfer to
complete the process. The transfer is then accepted and approved by the Board
of Supervisors for the LACFCD, who -operates and maintains the storm drains for
public use.
1. Adopt the attached resolution for the transfer and conveyance of the
storm drain improvements to the LACFCD for purposes of operation,
maintenance, repair and improvements.
2. Direct the City Clerk to transmit a copy of this report indicating the
date and action taken and three certified copies of the adopted
resolution to Mr. Stan Dixon at the County of Los Angeles.

RESOLUTION NO. 92-131
A RESOLUTION OF.THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA,
REQUESTING THE BOARD OF SUPERVISORS OF THE
LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE
STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID
DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROI
KNOWN AS PRIVATE DRAIN NO. 1975 IN THE
CITY OF SANTA CLARITA FOR FUTURE OPERATION,
MAINTENANCE, REPAIR AND IMPROVEMENT,
AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF
WHEREAS, there have been, dedicated to, or the City has otherwise
acquired, the storm drain improvements and drainage system known as Private
Drain No. 1975, described in Exhibit "A" attached hereto; and
WHEREAS, the City is authorized and empowered to transfer and convey to
the Los.Angeles County Flood Control District any storm drain improvements and
drainage systems for future operation, maintenance, repair, and improvement;
and
WHEREAS, the City and the Los Angeles County Flood Control District
entered into an agreement dated March 14, 1989, and recorded August 22, 1989,
as Document Number 89-1346418, of the Official Records in the office of the
County Recorder for the County of Los Angeles, whereby the City made certain
warranties about its future transfers and conveyances of Flood Control
facilities to the District; and
WHEREAS, the best public interest will be served by transfer and
conveyance of the storm drain improvements and drainage system described in
Exhibit "A" attached hereto from the City to the Los Angeles County Flood
Control District for future operation, maintenance, repair, and improvement.
NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the
Los Angeles County Flood Control District to accept the transfer and
conveyance of the storm drain improvements and drainage system described in
said Exhibit "A".
BE IT FURTHER RESOLVED that, subject to the acceptance thereof the Board
of Supervisors of the Los Angeles County Flood Control District, the City
Engineer is directed and ordered to prepare all necessary instruments and
documents, including ,deed, to effectuate said transfer and conveyance, and
that the Mayor is authorized and instructed to execute said deed and other
instruments and documents. District shall have no obligation or
responsibility to maintain said storm drain, improvements, and drainage until
all rights-of-way for said drain now vested in the City and all other
necessary rights-of-way therefore have been conveyed to and accepted by
District.

Reference is hereby made to District Drawing Nos. 43-F306.1-.7, the plans
and profile of said storm drain improvements and drainage system on file in
the office of the City Engineer and on file in the office of the Chief
Engineer of said District for further data as to the exact location, extent,
and description of said storm drain improvements and drainage system.
BE IT FURTHER RESOLVED thatthe transfer and conveyance hereby requested
are subject to each of the warranties described in the Agreement between the
City and the District dated March 14, 1989, and recorded August 22, 1989, as
Document Number 89-1346418, of the Official- Records in'the office of the
County Recorder for the County of Los Angeles. Such warranties by the City
are incorporated here by this reference.
The City Clerk shall certify to the adoption of this Resolution.

A reinforced concrete pipe storm drain system and appurtenant structures for
Tract Map No. 32321, filed in Book 1066, Pages 41 to 47, inclusive, of Maps,
Records of the County of Los Angeles, generally described as follows:
Line "A"
Commencing from existing storm drain per P.D. 1307, Station 11 + 92.76 located
within Sand Canyon Road right-of-way, north of Soledad Canyon -Road; thence
northerly and northwesterly to a variable width easement for storm drain and
storm drain ingress and egress purposes, which lies entirely within the
private drive of said tract; thence northwesterly, northerly, northeasterly,
northwesterly and northerly in last said mentioned easement to a variable
width easement for flood control purposes lying adjacent but not within the
private drive of said tract; thence northwesterly in last said mentioned
easement to an inlet structure, Station 15 + 84.60, a distance of 1,585 feet,
more or less.

westerly and northwesterly to a variable width easement for flood control
purposes; thence northwesterly to an inlet structure, Station 2 + 35.00, a
distance of 235 feet, more or less.

Commencing from an outlet structure, Station 0 + 00.00 located within Sand
Canyon Road future right-of-way; thence southwesterly; to a variable width
easement for storm drain and storm drain ingress and egress purposes; thence
southwesterly to a terminal catch basin, Station 1 + 98.71, a distance of 199
feet, more or less.
