SUBJECT: Manufactured Home Rent Stabilization Ordinance Amendments

The City Counciladopted the Manufactured Home Rent Stabilization Ordinance
with the intent to protect manufactured home park: tenants from unreasonable:
rent increases while -at the same time recognizing, the need of Park Owners to.
receive a fair and full return on their property:.
Both Panel and Staff believe that changes to the Rent, Stabilization Ordinance
have become necessary in order to` meet the Ordinance objectives and'. for the
Manufactured Home Rental Adjustment Panel to carry out their duties. Under
the Panel's direction, the City Attorney has prepared'a draft -Ordinance -with
proposed amendments., The proposed amendments include:
1.' The calculation of the average annual Consumer Price Index figure. would
change from a calendar year.to October 1 through September 30.
i2. Rent 'adjustments for a capital replacement or improvement would be
considered by the Panel.when determining if an increase above the maximum
allowable adjustment is. reasonable. This increasewouldbe included in
the rent and not charged as a separate amortized assessment.
3. A requirement in Section 6.02.110 providing that the Panel's decisions and
findings by the.Panel be transmitted to,the park owners and park residents
before the next Panel meeting.
Once approved, the Ordinance would become effective 30. days from City Council:
approval; with the exception of Section 1, 'which would. be effective, October I,-
1992.

RECOMMENDATION
Adopt Ordinance 92-11, amending sections of.the Rent Stabilization Ordinance._
