Progress Report on Manufactured Home Rent Stabilization -
Maintenance of Annual Registration Fee

The City Clerk is empowered by the Manufactured Home Rent Stabilization
Ordinance No. 90-38 to require re -registration of all manufactured home parks
as necessary, and it is expected that re -registration and collection of fees
will occur on an annual basis. The purpose of the registration fee is to
defray the costs associated with the administration of the regulations of the
Ordinance. The registration fee is shared equally between the park owner and
the park tenant, and the fee shall not be included as part of the rent. At
its meeting. on January 24, 1992, the Manufactured Home Rent Stabilization
Panel unanimously directed staff to initiate theannual registration process
for 1992 at $12.00 per rental space by bringing this item to the City Council.
Last year, the City Council adopted Resolution 91-7 which established the
registration fee and penalty for calendar year 1991. The registration fee was
set at $12.00 per rental space and the penalty was determined to be an
additional ten percent (102) of the registration fee for each month overdue.
Towards the end of the year, there was concern whether the registration fee
should be increased for calendar year 1992 due to the 'rising costs of
implementing the Ordinance. On September 23, 1991, staff sent a memo to the
Panel in the form of a registration fee analysis (attached), supporting the
continuance of the $12.00 registration fee for 1992.
In the analysis, it was estimated that the total annual cost for staff
services and supplies would be $39,971.24. Of the 2,635 rental spaces in the
City, 2,151 are non-exempt and subject to the registration fee. The cost per
rental space translates to $18.58 annually. There is a difference of $6.58,
from the prior registration fee of $12.00 per space. It is important to note,
however, that the data gathered for this fee analysis was based on information
from the first quarter of Fiscal Year 1991/92, a time when staff, as well as
park owners and park tenants, were just becoming familiar with the
implementation. procedures and policies of the Rent Stabilization Ordinance.

park.
RECOMMENDATION
1. Maintain the $12.00 registration fee for each manufactured home park
rental space and a penalty of ten percent (10X) for each month that the
registration fee, is overdue, as specified in Resolution 91-7.
