SUBJECT: Placerita Canyon Property Owners Request for Clean-up Project
A request was received through the Mayor's office from the Placerita
Canyon Property Owners Association for City. assistance with the clean-up
of Placerita Creek. Staff reviewed the parcel maps and records for the
lots which Placerita Creek passes through, and discovered there were no
flood control easements for the creek and that the lots are private
property.
Placerita Creek in this area is an unimproved drainage with no recorded
flood control easements. The liability issues and the use of public funds
on private property made it difficult for staff to recommend City
participation in the requested clean-up project. Instead we requested
that the Placerita Creek Property, Owners Association work with a•private
contractor to clean up the creek. We further recommended that releases
should be obtained from each property owner prior to removal of materials
from the creek.
It was our understanding that the, Placerita Canyon Property, Owners
Association was willing to fund the project, and based on this information
recommended that they contract directly with a private firm to remove the
debris from the channel. Information for our recommendation was obtained
both from the City Attorney, Carl Newton, and Dick Kopecky, the Acting
City Engineer.

Dear Pat:
Our staff has reviewed your request for City assistance with
the clean up of Placerita Creek. I commend your associa-
tion's concern with our environment, and your willingness to
fund a clean-up project for Placerita Creek. However, our
review of the parcel maps and records for the lots which
Placerita Creek passes through indicate that there are no
flood control easements for the creek, and that the lots are
private. property.
This situation limits the City's ability to participate in
the project. Liability issues and the use of public funds on
private property make it difficult for us to approve City
participation. Instead, we would suggest that the Placerita
Creek Property Owners' Association work with a private con-
tractor to clean up the creek. Releases should be obtained
from each property owner prior to any removal of materials
from the creek.
Although we cannot participate in the clean up of the .creek
on private property, we applaud your efforts and wish you
success with the project.
