Harris%// ttkh L.G� SUBJECT: MAGIC MOUNTAIN PARKWAY - RIGHT-OF-WAY ACQUISITION DEPARTMENT: Community Development The City has been embarking on a project to widen San Fernando Road and Magic Mountain Parkway from Valencia Boulevard* to Lyons Avenue. A portion of the San Fernando Road project is currently under construction and is scheduled for completion within 16 months. The Magic Mountain Parkway portion was expected to be constructed at this same time; however, funding for this project did not materialize for this fiscal .year. Although Caltrans has agreed to fund the project, they indicated that funds would not be available until fiscal year '93/94. Before we were notified of the delay in funding, the City Council began rights-of-way acquisition through condemnation proceedings for San Fernando Road and Magic Mountain Parkway. We are currently in. the process of finalizing the amounts to be paid for this right-of-way and the acquisition of final easements through the courts. Since there was a delay in the funding for Magic Mountain Parkway, staff is seeking concurrence from the Council to continue processing right-of-way for Magic Mountain Parkway. We have recently been notified through Caltrans that the Governor is attempting to free funds in various roadway construction accounts to construct projects which are ready for bidding. Magic Mountain Parkway -is one of those projects and has been submitted to the Governor through Caltrans. The commitment of funds will not be fully known until the later part of the '91/92 state fiscal year. We expect that the Magic Mountain Parkway project will.be approved by Caltrans in June of 1992. In order to take advantage of these funds, the City must have the right-of-way acquisition completed and certified in order to proceed. Because this is a very important project to the City's residents and its circulation system, we feel that continuing with the right-of-way acquisition at this time is a prudent approach. In addition, based on the current economic situation, this right-of-way.may be the best price that we could obtain in the foreseeable future. RECOMMENDATION Direct the City Attorney's office and the Community Development department to continue processing right-of-way acquisition for Magic Mountain Parkway as originally directed by the Council on March 13, 1991. hds:584 APPRE-3 Ago , Item:
