SUBJECT: SAN FERNANDO ROAD UNDERGROUND UTILITY.DISTRICT NO. 91-1

BACKGROUND
As part of the current construction project. to widen San Fernando Road, all
overhead utilities are being undergrounded. This will involve any private
businesses whose services currently are fed by overhead lines.
On September 25, 1991, a public hearing was held and Resolution No. 90-159
adopted to establish an underground utility district under the City Ordinance
Chapter 13.32. The portion of the underground work within the City
rights-of-way will be funded using Southern California Ed�son's Rule -20A
monies while all on-site work will be split 50 percent with the City and
50 percent with the affected property owners.
The proposed assessment district will be formed using the 1911 Act of the
California Streets and Highways Code and will create a contractual assessment
program in which the property owner consents and contracts with the City to
perform the assessment work.
Currently only the portion of San Fernando Road from Drayton Street south to
Placerita Creek Bridge is under. construction. The remainder of the work will
be done in conjunction with the County's portions of the widening -project.
Eventually all overhead utilities from Magic Mountain Parkway south to Lyons
Boulevard will be undergrounded.
Further steps, in addition to the contracts with property owners, will be to r
adopt resolutions approving the engineer's report and setting the public
hearing.
RECOMMENDATION
Adopt Resolution No. 92-118 making professional appointments and directing
that certain acts be taken in furtherance of the district.

RESOLUTION NO. 92-118
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA CLARITA MAKING CERTAIN PROFESSIONAL APPOINTMENTS
FOR ITS PROPOSED SAN FERNANDO ROAD UNDERGROUND
UTILITY DISTRICT NO. 91-1 AND DIRECTING
THAT CERTAIN ACTS BE:TAKEN IN FURTHERANCE OF
THE DISTRICT'S FORMATION
WHEREAS, the City Council of the City of Santa Clarita (the "City") has
considered all matters relating to the proposed undergrounding of certain
public utilities pursuant to the Improvement Act of 1911, commencing with
California Streets and Highways Code Section 5000, and for the levy of
contractual assessments against properties within a proposed district to be
designated as City of Santa Clarita, San Fernando Road Underground Utility
District No. 91-1 (the "District"); and
WHEREAS, the City is proposing to proceed with• undergrounding- said
utilities, to be partially funded with the amounts collected from contractual
assessments; and
WHEREAS, the public interest and convenience requires the undergrounding
ofsaid utilities, as previously stated in Resolution No. 90-159 of the City
adopted September 25, 1990.
NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND DECLARED by the
City Council of the City of Santa Clarita, California, as follows:
SECTION 1: That the firm of Willdan & Associates is hereby designated
and appointed Engineer of Work and employed to do and perform all engineering
work necessary and in for the proceedings, including, but not limited to,
preparation of the description of improvements, the boundary map, and. the
estimate of costs and the Assessment Diagrams, pursuant to its existing
contract for services with the City.
SECTION 2: That the firm of Burke, Williams, Sorensen & Gaar, Attorneys
at Law, is hereby designated and appointed special counsel with respect to the
proceedings and is employed to perform all legal work relating to said
proceedings. Fees, costs and the scope for such work shall be as set forth in
the letter agreement dated September 11, 1991.
SECTION 3: That Anthony J. Nisich is hereby appointed Superintendent of
Streets for all purposes with respect to the District. As Superintendent of
Streets, he is. authorized and directed to do and perform all duties imposed
upon the.Superintendent of Streets pursuant to the Improvement Act of 1911, as
amended, excepting those duties and responsibilities which have been or will
be assigned to -the Engineer of Work. All certificates or documents required
to be signed by or kept on file by the Superintendent of Streets for said
project shall be kept on file with the City Clerk.
SECTION 4: The City Clerk shall certify the adoption of this resolution
and.thenceforth and thereafter same shall be in full force and effect.
