Nisicb42ns SUBJECT: SOLEDAD CANYON ROAD INTEGRATED FINANCING ASSESSMENT DISTRICT NO. 92-4 Resolution Numbers: 92-143 6 92-144 DEPARTMENT: Community Development BACKGROUND As a part of the conditions of approval, for various new developments in the area of .Soledad Canyon Road and Sand Canyon Road, a funding mechanism is required so that each of the developers would share in the cost of widening Soledad Canyon Road from Sand Canyon Road to the eastern.City boundary at Shadow Pines Boulevard. Since none of the developers has decided to establish the funding mechanism to construct the improvements at this time, the City has opted to move ahead with the project. The City may fund and.construct the street improvements and be reimbursed as each development proceeds through the establishment of an integrated financing district. The proposed .reimbursement district, using: the Integrated Financing Act and the Municipal Improvement Act of 1913, will be formed to place these construction' costs on the undeveloped, properties which benefit from this project. The contract for these improvements was awarded February 25, 1992. The initial phase of the district has begun by adopting a resolution which authorizes the work to proceed and direct Willdan Associates to provide assessment engineering and Burke, Williams, and Sorensen as special counsel for these proceedings. The cost for establishment of the district have been included in the budgetfor the project and will be reimbursed to the City as development proceeds. The Engineer's Report, expected to be heard at this meeting, gives details concerning the boundaries, improvements, costs and method of assessment. Further steps include a public hearing, ordinance creating district, and final recording of assessments. The costs placed on the individual developers will be reimbursed to the City through the building permit process. City Council ("City Council") of the City of Santa Clarita, California ("City") has requested the institution of proceedings for the construction of certain improvements and payment of incidental expenses by creation of its Soledad Canyon Integrated Financing Assessment District No. 92-4 ("District"), as shown on that certain map designated "Proposed Boundaries of Soledad Canyon Integrated Financing Assessment District No. 92-4", attached hereto and incorporated herein as Exhibit "A"; and WHEREAS, the City Council of the City has considered all matters relating to the proposed financing and construction of certain public improvements in the vicinity of Soledad Canyon Road pursuant to the Integrated Financing District Act ("Financing District Act") and the Municipal Improvement Act of 1913 ("Improvement Act"), and specifically for the levy of contingent assessments ("Assessments") against properties within the District, a description of the rate and method of apportionment for such Assessments being attached hereto and incorporated herein as Exhibit "B"; and WHEREAS, the City previously provided funds to finance said improvements by the execution and delivery of "Certificates of Participation (Capital Improvement Projects) Evidencing A Proportionate Interest Of The Owners Thereof In Lease Payments To.Be Made By the City of Santa Clarita (Los Angeles County, California) to the Redevelopment Agency of the City of Santa Clarita" ("Certificates") dated October 1, 1991, in the original principal amount of $22,940,000; and WHEREAS, the City has determined that the public interest and convenience require construction of certain improvements described in Exhibit "C" attached.hereto and incorporated herein at an estimated cost of $3,000,000, and proposes to proceed with construction of said, improvements with a portion of the proceeds of the Certificates; and WHEREAS, the City finds that it is in the best interest of the City, is in the public interest and is for the public benefit that the City seek full or partial payment or reimbursement of certain lease payments related to the Certificates from the proceeds of the Assessments; and 15282.1 WHEREAS, the Financing District Act provides an alternative method of financing the improvements, by authorizing the Assessments which are contingent upon the development of land and which may be made payable at the time of approval of a tentative subdivision map, vesting tentative subdivision map, final subdivision map, zoning change, or upon receipt of a building permit for any parcels which have already received all other required approvals for development; and WHEREAS, the Financing District Act authorizes proceedings to create an integrated financing district to be combined with formation proceedings under the Improvement Act; and WHEREAS, the City Council intends that a public hearing on the formation of the District under the Financing District Act will be combined with the public hearing required pursuant to the Improvement Act, with notice of the hearing to be made in the manner required by the Improvement Act; and NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND DECLARED by the City Council of the City of Santa Clarita, California as follows: SECTION 1. The.above recitals are all true and correct. SECTION 2. The public interest, convenience and necessity require, and it is the intention of the City Council pursuant to the provisions of the Financing District Act and the Improvement Act, to order the construction of improvements within the District boundaries shown in Exhibit "A". SECTION 3. The City Council has determined to proceed in forming an integrated financing district pursuant to the Financing District Act and the Improvement Act. SECTION 4. The area to be benefitted by said improvements and to be assessed to pay the costs and expenses thereof and to be known as Soledad Canyon Integrated Financing Assessment District No. 92-4 shall be that part of the District having exterior boundaries as shown on Exhibit "A", which map is on file in the office of the City Clerk. Reference hereby is made to that map and exhibit for a full and complete description of the proposed assessment district, and "Exhibit A" shall govern all details as to the extent of the boundaries of the proposed District. SECTION 5. The Engineer of Work shall furnish to the City Council a report in writing pursuant to Section 10204 of the Improvement Act, presenting the following: (1) Plans and specifications of the proposed project; and (2) An estimate of the costs of the proposed project, including incidental costs and expenses in connection therewith; and 15282.1 -2- (3) A diagram showing the proposed assessment district, which diagram also shall show the boundaries and dimensions of the subdivision of land within the District, each of which subdivision shall be given a separate number upon said diagram; and (4) A proposed assessment of the total amount of the cost and expenses of the proposed improvement upon the subdivisions of land within the proposed assessment district in proportion to the estimated benefits to be received by such subdivisions, respectively, from said improvements. The assessment shall refer to such subdivisions upon the diagram by the respective numbers thereof. (5) The total amount, as near as may be determined, of the total principal sum of all unpaid special assessments and special assessments required or proposed to be levied under any completed or pending assessment proceedings, other than that contemplated in the instant proceedings, which would require an investigation and report against the total area proposed to be assessed. (6) The total true value, as near as may be determined, of the parcels of land and improvements which are proposed to be assessed. Total true value may be estimated as the full cash value of the parcels as shown upon the last equalized. assessment roll of Los Angeles County. Alternatively, total true value may be determined by other reasonable means, including, but not limited to, by adjusting the value shown on the last equalized assessment roll to correct for deviations from market value due to Article XIII A of the California Constitution. SECTION 6. Each contract shall be let to the lowest responsible bidder. The City Clerk shall publish notice inviting sealed proposals for each contract pursuant to Government Code Section 6066, or by such posting as the City may provide. The time fixed for the opening of bids shall not be less than fourteen (14) days after the first publication or posting of the notice. SECTION 7. The public interest, convenience and necessity require that certain land, rights-of-way, easements and improvements be obtained in order to fulfill the purposes proposed for the assessment district. For a general description of the location and extent of the easements or -lands necessary to be acquired, reference is made to Exhibit "A" on file with the City Clerk. SECTION 8. If any excess shall be realized from the assessment, it shall be used, in such amounts as the City Council may determine, in accordance with the provisions of law, for one or more of the following purposes: 13282.1 -3- A. Transfer to the general fund of the City; provided that the amount of any such transfer shall not exceed -he lesser of One Thousand Dollars ($1,000.00) or five percent (5%) of the total from the Improvement Fund (as defined herein); B. As a credit upon the assessment and any supplemental assessment; or C. For the maintenance of the improvement. SECTION 9. A special improvement fund identified and designated by the name of Soledad Canyon Integrated Financing Assessment District No. 92-4 Improvement Fund hereby is established (the "Improvement Fund"), and into said fund monies may be transferred at any time to expedite the making of the improvements herein authorized, and any such advance of funds is a loan and shall be repaid out of the Assessments asauthorized by law. SECTION 10. The City Engineer, whose telephone number is (805) 259-2489, hereby is designated by the City Council to answer inquiries regarding the hearing procedures for the Resolution of Intention and to answer inquiries relative to any hearing or proceedings concerning this project where it is required by statute that such agency and telephone number be so designated and provided. SECTION 11. All public agency property in the use and performance of a public function shall be omitted from assessment in these proceedings unless expressly provided and listed here. SECTION 12. As authorized by the Financing District Act, after formation of the District the City intends to execute a Reimbursement Agreement ("Reimbursement Agreement") to repay funds taken from the proceeds of the Certificates to fund the improvements. The Reimbursement Agreement will be executed pursuant to the terms of Section 53190.5 of the Financing District Act. SECTION 13. The public hearing required by Section 53183 of the Financing District Act shall be combined with the public hearing required by the Improvement Act. At the time and place to be designated for the public hearing, any owner of property liable to be assessed pursuant to this Resolution of Intention may make a written protest, which shall be heard and passed upon by the City Council. Reference is made to Section 53183 of the Financing District Act for further particulars, the terms of which are incorporated herein by reference. SECTION 14. Cily of Santa Clarita EXHIBIT "B" REPORT OF ENGINEER FOR CITY OF SANTA CLARITA INTEGRATED FINANCING ASSESSMENT DISTRICT NO 92-4 SOLEDAD CANYON ROAD SAND CANYON ROAD TO,SHADOW PINES BOULEVARD METHOD OF ASSESSMENT Soledad Canyon Road is a required condition, placed on nine developers which will extend from Sand Canyon Road east to Shadow Pines Boulevard. The costs and incidental expenses to improve Soledad Canyon Road will be spread throughout the developments according to their benefit received. The total costs of construction for Soledad Canyon Road will be separated into two zones for reimbursement purposes; Zone A, the portion of construction from Sand Canyon Road to Oak Springs Canyon Road and Zone B, the portion from Oak Springs Canyon Road to Shadow Pines Boulevard. These costs will be placed under the Integrated Financing District to be paid through a reimbursement process as the conditioned tracts develop. The Municipal Improvement Act of 1913 provides that the costs and incidental expenses of a project be assessed in proportion to the estimated "benefit" received by each of the lots or parcels of land within the assessment district. The Act, however, does not provide a specific benefit formula, hence that determination is made by the Assessment Engineer for consideration by the legislative body. The formula used should be one that reflects benefit received by each parcel and results in the most equitable proration of the costs to each of the lots or parcels within the assessment district. For example, when Tract 47324 develops, their revised number sequence will be 800 to 872. In maldng the analysis, it was necessary to identify the benefits that the public improvements rendered to the properties within the boundaries of the Assessment District and to determine that the properties received a direct and special benefit distinguished from that of the general public. It was determined that the improvements are necessary and required for the development of the properties within the Assessment District. The properties within the District have been conditioned as a result of the development process to establish a reimbursement mechanism to construct Soledad Canyon Road. For residential property, the benefit to each property as a result of the construction of Soledad Canyon Road is the right for each property owner to construct a specific number of dwelling units. The benefit to a property with twice as many units would be to benefit twice as many future owners who would use Soledad Canyon Road. Therefore, benefit is based on the number of units each developer is allowed to construct. For commercial property the benefit to each property would be based on the number of vehicle trips generated by the development. Page 2 of 3 _0% Since some properties were conditioned for the portion of Soledad Canyon Road from Sand Canyon Road to Oak Springs Canyon Road, they will be in Zone A. Zone B, which will be from Oak Springs Canyon to Shadow Pines Boulevard will involve Tract No. 46005. Those developers within Zone A which is largely undeveloped will be assessed on_a per unit basis while the single tract in Zone B will be assessed their portion of traffic volume of the developed area bounded by Shadow Pines Boulevard, the Antelope Valley Freeway, Oak Springs Canyon Road and Sierra Highway. Figures used to determine the costs of improvements were obtained from the engineer of work and reflect costs at the time of the award of bid. The assessment engineer then reviewed the costs for completeness and eligibility under the 1913 Act proceedings. The actual costs incurred by the developer to construct the improvements will be reviewed through a documentation process which will include submittals of invoices and associated payment records for review by City staff. After review of these documents, these preliminary project cost and incidentals estimates presented herein will be adjusted to reflect the true cost of the construction of these improvements. All residential development will be assessed based on their equivalent number of developable units. All commercial development will be assessed based on their equivalent traffic counts. The general description of work consists of the construction of storm drains, street lights, traffic signals, median landscaping, certain grading, clearing and grubbing, asphalt concrete paving, including acquisition of necessary rights-of-way together with appurtenances and appurtenant work necessary to accomplish the above improvements to the specified widths and dimensions and all said work and acquisition is located in all or a portion of the following listed street or easements and as shown on the boundary map and diagram (reduced) included herein as Exhibit "A": SOLEDAD CANYON ROAD SAND CANYON ROAD EAST TO SHADOW PINES BOULEVARD The public interest, convenience, and necessity require that certain land, rights-of-way or easements be obtained in order to allow the works or improvement as proposed for the Assessment District to be accomplished. RESOLUTION NO. 92- 144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA PASSING ON AND PRELIMINARILY APPROVING THE ENGINEER'S REPORT AND SETTING A PUBLIC HEARING ON THAT REPORT WITH RESPECT TO ITS SOLEDAD CANYON INTEGRATED FINANCING ASSESSMENT DISTRICT NO. 92-4 WHEREAS, the City Council ("City Council") of the City of Santa Clarita, California ("City") has instituted proceedings for the construction of certain improvements and payment of incidental expenses by creation of its Soledad Canyon Integrated Financing Assessment District No. 92-4 ("District"); and WHEREAS, the City Council of the City has considered all matters relating to the proposed financing and construction of certain public improvements in the vicinity of Soledad Canyon Road pursuant to the Integrated Financing District Act ("Financing District Act") and the Municipal Improvement Act of 1913 ("Improvement Act"), and specifically for the levy of contingent assessments ("Assessments") against properties within the District; and WHEREAS, there has been prepared and filed with the City Council a report of the Engineer ("Engineer's Report") as provided for in Section 10204 of the Improvement Act, and the Engineer's Report has been presented for consideration; and WHEREAS, a Resolution of Intention has been adopted as of the date hereof regarding the District, and the Engineer's Report shall stand as the Engineer's Report for the purpose of subsequent proceedings hereunder; and WHEREAS, the Financing District Act authorizes proceedings to create an integrated financing district to be combined with formation proceedings under the Improvement Act; and WHEREAS, the City Council intends that a public hearing on the formation of the District under the Financing District Act will be combined with the public hearing required pursuant to the Improvement Act, with notice of the hearing to be made in the manner required by the Improvement Act; NOW, THEREFORE, ITIS HERESY RESOLVED, DETERMINED AND DECLARED by the City Council of the City of Santa Clarita, California as follows: SECTION 1. The above recitals are all true and correct. SECTION 2. The Engineer's P.eport referred to hereinabove is considered adopted, passed upon, and preliminarily approved, as follows: (1) That the plans and specifications for the proposed improvements to be made, contained in said Engineer's Report be, and they are hereby preliminarily approved and adopted; (2) That Engineer's estimate of the itemized and total costs and expenses of said construction, where necessary, and improvements, and of the incidental expenses in connection therewith, contained in said Report, be, and each of them are, hereby preliminarily approved and adopted; (3) That the diagram showing the District referred to and described in said Resolution of Intention, and also the boundaries and dimensions of the respective subdivisions of land within said District, as the same existed at the time of the passage of said Resolution of Intention, as contained in said Engineer's Report, be, and hereby are preliminarily approved and adopted; (4) That the proposed Assessment upon the several subdivisions of land in said District, in proportion to the estimated benefits to be received by such subdivisions, respectively, from said acquisition and improvements, and of the incidental expenses thereof, as contained in said Engineer's Report, be, and they are hereby preliminarily approved and adopted; (5) That the maps and descriptions of the lands and easements to be acquired, as contained in said Engineer's Report be, and the same are hereby preliminarily approved; (6) That said Engineer's Repo shall stand as the Engineer's Report for the purpose of all subsequent proceedings fa pursuant to said Resolution of Intention. SECTION 3. NOTICE HEREBY IS GIVEN THAT ON AUGUST 25, 1992 AT 7:30 P.M AT THE CITY COUNCIL CHAMBERS, 23920 VALENCIA BOULEVARD, SANTA CLARITA, CALIFORNIA, ANY AND ALL PERSONS HAVING ANY OBJECTIONS TO THE PROPOSED WORK, OR ASSESSMENT, OR EXTENT OF THE DISTRICT MAY APPEAR AND SHOW CAUSE WHY SAID WORK SHOULD NOT BE DONE OR CARRIED OUT IN ACCORDANCE WITH THE RESOLUTION OF INTENTION AND THE ENGINEER'S REPORT. 20854.1 -2- SECTION 4. The above -referenced public hearing required by Section 53183 of the Financing District Act shall be combined with the public hearing required by the Improvement Act. At the time and place to be designated for the public hearing, any owner of property liable to be assessed pursuant to.this Resolution of Intention may make a written protest, which shall be heard and passed upon by the City Council. Reference is made to Section 53183 of the Financing District Act for further particulars, the terms of which are incorporated herein by reference. SECTION 5. The City Clerk is hereby directed to give notice of said public protest hearing by causing to be conspicuously posted on all open streets within the District, not more than 300 feet apart on each street so posted, but not less than three (3) in all, notice of the passage of the Resolution of Intention and of this Resolution, all in accordance with provisions of the Improvement Act. SECTION 6. The City Clerk is hereby directed to give notice of said public protest hearing and of the passage of the Resolution of Intention and this Resolution by causing such notice to be published in accordance with Government Code Section 6066, in an adjudicated newspaper of general circulation within the water district. SECTION 7. The City Clerk is hereby directed to mail notice of said public protest hearing and the adoption of the Resolution of Intention and of the filing of the Engineer's Report to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for Los Angeles County taxes prior hereto, or as known to said City Clerk, and to all other persons as prescribed in accordance with the provisions of the Improvement Act. SECTION 8. The above notices of said public protest hearing shall include a statement of the total principal amount of unpaid assessments already levied against all property proposed to be assessed, as computed in the Engineer's Report, in accordance with Streets and Highways Section 2961(c). SECTION 9. The City Clerk is hereby further directed to file a copy of the proposed boundary map in the Office of the Los Angeles County Recorder, within fifteen (15) days of the adoption of the proposed boundary map; said boundary map to be in the manner and form as set forth in Division 4.5 of the California Streets and Highways Code commencing with Section 3100. SECTION 10.
