HomeMy WebLinkAbout1992-02-25 - AGENDA REPORTS - SOLEDADCYN PROJ 91 04 CONDEM (2)NEW BUSINESS DATE: SUBJECT: DEPARTMENT: BACKGROUND AGENDA REPORT City Manager item to be v February 25, 1992 SOLEDAD CANYON ROAD WIDENING PROJECT NO. 91-04 CONDEMNATION PROCEEDINGS Resolution Number: 92-34 Community Development City staff was instructed to make an offer to purchase the road easement required to be obtained for public street purposes, located on the north side of Soledad Canyon Road, 970 feet westerly of Oak Springs Canyon Road, in the City of Santa Clarita, as shown on the attached map marked Exhibit "B". This road easement is necessary to install the improvements along Soledad Canyon Road east of Sand Canyon which are currently out for bids. The City made an initial offer of $1,470 to purchase the road easement pursuant to Section 7267.2 of the California Government Code. This offer was the full amount determined by an appraisal to be just compensation for the road easement across the property. Although discussions have been amicable with the property owners, a settlement agreement has not been reached for the acquisition of the road easement and, therefore, the City must initiate eminent domain proceedings at this time in order to construct the public improvements, to wit: a public street. On February 4, 1992, the Canyon Breeze Village Company, of February 25, 1992. The letter was on February 7, 1992. ANALYSIS City notified the property owners, the condemnation hearing to be held on received by Canyon Breeze Village Company As to the findings of the proposed Resolution of Necessity, City staff have the following comments: Necessity: The City has heretofore approved a public street improvement project involving the widening of Soledad Canyon Road. Obtaining possession of the. right-of-way by March 15, 1992 is necessary for .the project to proceed on schedule. The road easement to be acquired is essential for the implementation of the project. Adopted:�a w ,0153 ('tm`t81i1: Soledad Canyon Road Widening Project No. 91-04 Condemnation Proceedings February 11, 1992 Page 2 Public Good Versus Private Injury It has been determined by the City staff that the public interest, convenience, and necessity require the acquisition, of the road easement interest in and to the property for the construction of the project; that the project is planned and located in the manner that will be most compatible with the greatest public good and least private injury; and that the road easement to be acquired is necessary for the project. The area in which the street improvements are to be constructed is vacant and will not be adversely affected. The street improvements will enhance the property by. solving the surface erosion and adverse drainage condition that exists. RECOMMENDATION Open the hearing, review, facts, accept comments, close the hearing and adopt the Resolution of Necessity to initiate eminent domain proceedings against the property on the north side of Soledad Canyon Road, 970 feet westerly of Oak Springs Canyon Road to allow construction of Soledad Canyon Road which will require widening of the existing pavement. ATTACHMENTS Resolution 92-34 Exhibit "A" Exhibit "B" hds:601 RESOLUTION NO. 92-34 RESOLUTION OF THE CITY OF SANTA CLARITA FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF A CERTAIN ROAD EASEMENT FOR PUBLIC PURPOSES (SOLEDAD CANYON ROAD WIDENING PROJECT) THE. CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES resolve as follows: Section 1. The City of Santa Clarita (hereinafter "City") finds, determines and declares: (1) That the public interest, convenience and necessity require the acquisition of a road easement by said City of certain interests in and to certain hereinafter 'described real property ("Property") for the public purposes and all uses appurtenant thereto as hereinafter described; (2) That the project is planned or located in the manner that will be most compatible with the greatest public good and least private injury; (3) That the taking of the road easement interests in and to the Property is necessary for such public uses, and is authorized by Section 19, Article I of the California Constitution, Sections 40404 et seq., and 37350.5 et seq., of the California Government Code, Section 1240.010 at seq., of the California Code of Civil Procedure, and other applicable law; (4) That the offers to purchase required by California Government Code Section 7267.2 have been made to the owners of the Property and that said offers were rejected by the perspective property owners. Section 2. The City hereby declares that it is the intention of said City to acquire interests in and to the Property by a road easement, as described in Exhibit "A", in its name in accordance with the provision of the laws of the State of California with reference to condemnation procedures. Section 3. That if any of'the Property has been appropriated to some public use, the public use to which it is to be applied and taken under this proceeding is a more necessary and paramount public use. Section 4. The interests in and to the Property, the acquisition of which is required by said public interest, convenience, and necessity for the purposes set forth in Section One hereof, is located in the City of Santa Clarita, County of Los Angeles, State of California, and is more particularly described in Exhibit "A" which is attached hereto and incorporated herein by reference and made a part hereof. The specific nature of the public uses for which the said interests in and to the properties are to be acquired as set forth in said Exhibit "A". A map showing the general location of the Property is marked Exhibit "B attached hereto and incorporated herein by reference and made a part hereof. RESOLUTION NO. 92-34 Page 2 Section 5. The City Attorney and the firm of Burke, Williams & Sorensen are hereby retained as special counsel and are authorized and directed to prepare, institute, and prosecute in -the name of the City such proceedings in the proper court having jurisdiction thereof as may be necessary for the acquisition of the road easement interests in and to the Property described herein. Said counsel is also authorized and directed to obtain an Order of Court granting to said City the right of immediate possession and occupancy of said road easement. Section 6. DESCRIPTION OF SERVICES o Improvements to be provided within the District are generally described as follows: o Road improvements and all improvements to support the road, along Soledad Canyon Road from Sand Canyon Road east to Shadow Pines Boulevard.. o I have assessed the costs and expenses of the works of improvement as constructed in place in the District upon the parcels of land in the District benefited thereby in direct proportion and relation to the estimated benefits to be received by each of said parcels. For particulars of identification of the parcels, reference is made to the Diagram (see below). o A Diagram, attached as Exhibit "A", showing the District, as well as the lines and dimensions of each parcel of land within the District as they existed at the time of the passage of the Resolution of Intention. Each parcel of land has been given a separate number on the Diagram and in the Assessment Roll. o The subdivisions and parcels of land and their numbers shown on the Diagram correspond with the numbers appearing on the Assessment Roll, attached as Exhibit "C". o In addition to or as a part of the assessment lien levied against each parcel of land within the District, each parcel of land shall also be subject to an annual assessment to pay costs incurred by the City and not otherwise reimbursed which result from the administration and collection of assessments or from the administration or registration of any bonds and/or reserve or other related funds. The costs and incidental expenses to improve Soledad Canyon Road will be spread throughout the developments according to their benefit received The total costs of construction for Soledad Canyon Road will be separated into two zones for reimbursement purposes; Zone A, the portion of construction from Sand Canyon Road to Oak Springs Canyon Road and Zone B, the portion from Oak Springs Canyon Road to Shadow Pines Boulevard. These costs will be placed under the Integrated Financing District to be paid through a reimbursement process as the conditioned tracts develop. The Municipal Improvement Act of 1913 provides that the costs and incidental expenses of a project be assessed in proportion to the estimated "benefit' received by each of the lots or parcels of land within the assessment district. The Act, however, does not provide a specific benefit formula, hence that determination is made by the Assessment Engineer for consideration by the legislative body. For example, when Tract 47324 develops, their revised number sequence will be 800 to 872. In making the analysis, it was necessary to identify the benefits that the public improvements rendered to the properties within the boundaries of the Assessment District and to determine that the properties received a direct and special benefit distinguished from that of the general public. It was determined that the improvements are necessary and required for the development of the properties within the Assessment District. The properties within the District have been conditioned as a result of the development process to establish a reimbursement mechanism to construct Soledad Canyon Road. For residential property, the benefit to each property as a result of the construction of Soledad Canyon Road is the right for each property owner to construct a specific number of dwelling units. The benefit to a property with twice as many units would be to benefit twice as many future owners who would use Soledad Canyon Road. Therefore, benefit is based on the number of units each developer is allowed to construct. For commercial property the benefit to each property would be based on the number of vehicle trips generated by the development. 7/14/92 21 Preliminary Zones Since some properties were conditioned for the portion of Soledad Canyon Road from Sand Canyon Road to Oak Springs Canyon Road, they will be in Zone A. Zone B, which will be from Oak Springs Canyon to Shadow Pines Boulevard will involve Tract No. 46005. Those developers within Zone A which is largely undeveloped will be assessed on a per unit basis while the single tract in Zone B will be assessed their portion of traffic volume of the developed area bounded by Shadow Pines Boulevard, the Antelope Valley Freeway, Oak Springs Canyon Road and Sierra Highway. Figures used to determine the costs of improvements were obtained from the engineer of work and reflect costs at the time of the award of bid. The assessment engineer then reviewed the costs for completeness and eligibility under the 1913 Act proceedings. The actual costs incurred by the developer to construct the improvements will be reviewed through a documentation process which will include submittals of invoices and associated payment records for review by City staff. After review of these documents, these preliminary project cost and incidentals estimates presented herein will be adjusted to reflect the true cost of the construction of these improvements. Zone A All residential development will be assessed based on their equivalent number of developable units. All commercial development will be assessed based on their equivalent traffic counts.
