This item is on the agenda for the City of Santa Clarita to take a, position on
AB3001.
This measure would establish a planning and approval process for the siting of
solid waste facilities in the "post -gap" period, after approval by the Waste
Management Board of Countywide Integrated Waste Management Plans.. In its
current form, AB3001 provides that landfills and transformation facilities
that are not included in a countywide integrated waste management plan must be
approved by the county and the majority of the cities with a majority -of the
incorporated population. Materials recover facilities, processing facilities
and composting facilities that are not included in the plans must be reviewed
and commented on by the Local Task Force, with particular attention given to
the relationship between the jurisdiction to achieve the AB939 goals, and the
regional impacts of the facility.
Current law requires integrated waste management plans to identify areas for
disposal and transformation facilities, but does not require commensurate
identification of transfer stations, material recovery facilities and other
non -disposal oriented facilities. The law nonetheless prohibits the siting of
both disposal and transfer or material recovery facilities unless they are in
conformance with an adopted and California Integrated Waste Management Board
(CIWMB) approved integrated waste management plan. This ambiguity in the law
has resulted in proposed regulations being issued by the CIWMB which would
require local agencies to identify areas for all solid waste facilities in
their siting elements. AB3001 is intended to eliminate unnecessary burdens on
local agencies.and waste disposal companies.
RECOMMENDATION
Support AB3001 and transmit letters on position to Santa Clarita State leaders
of delegation.
