BACKGROUND
At the City Council Study Session of September 30, 1992, Council approved staff's
recommendations to amend the schedule of rates in the existing refuse recycling franchise
agreement to reflect an increase in rates of 6.3 % on single family households and a 6.6%
increase on multifamily bin accounts; to include a senior discount rate program; to collect
franchise fees retained by the haulers for the calendar year 1992; and to execute a
Memorandum of Understanding (MOU) between the City and the franchised haulers to
collect franchise fees as specified in the franchise agreement on a monthly basis beginning in
January 1993.
Rate Adjustments
The residential refuse franchise agreement provides for rate modifications based on changes
in landfill tipping fees and the Producer Price Index (PPI). The findings of the rate review
analysis showed that incremental changes in both landfill tipping fees and the PPI reflect a
rate increase of 6.3% to single family households and 6.6% to multifamily bin accounts.
The attached Resolution No. 92-193 includes the amended schedule of rates.
The adjustments will take effect as of January 1, 1993. The next annual rate adjustment
would occur in January of 1994. However, increased landfill tipping costs assessed to the
haulers can be passed on to customers in the interim period. The haulers' contracts with the
landfill expire in May, and could quite likely result in increased costs for disposal.
Senior Citizen Discount Program
The haulers have agreed to include a discounted rate for service to qualifying senior citizens.
Resolution No. 92-194 amends the franchise agreement to add subsection 5J "Senior Citizen
Discount Rate Program."

Senior Citizen Discount - Single Family Units
A ten percent (10%) reduction of the approved rates shall be available to all
qualifying senior citizens who own and occupy or rent single family housing units.
Senior Citizen Discount - Multifamily Units/Senior Citizen Communities
A ten percent (10%) reduction in rates shall be available to all qualifying multifamily
senior citizen housing complexes which are owned, operated and approved by
Federal, State or local public entities; or communities designated as senior citizen
communities and meet the qualifications specified in Resolution 92-194.
Senior Citizen Discount - Mobile Home Parks
A ten percent (10%) reduction in rates shall be available to all qualifying single billed
mobile home parks who have proof of a 90% senior citizen occupancy rate.
Individually billed senior -occupied mobile home units shall also be eligible for the
10% discounted rate. l
Payment of Franchise Fees - Memorandum of Understandin
Under the provisions of Section 7 of the Franchise Agreement, the haulers were required to
pay the City a franchise fee of 10% of their gross revenues 15 days after the end of each
calendar month to have begun in January 1992. The haulers had retained these fees since a
pass-through of the increased costs due to the landfill tipping fees and the PPI had not been
approved. The haulers had indicated that increases in costs incurred by them would offset
the fees due to the City.
A thorough comparison analysis of the haulers disposal expenses resulting from increased
tipping fees and the PPI for a period of 20 months (May 1991 - December 1992) versus the
total franchise fees owed to the City over the same time interval clearly shows that a total of
approximately $452,000 in franchise fees are due to the City from the three haulers.
The attached Memorandum of Understanding specifies the exact amounts of past fees due to
the City from each hauler payable on January 1, 1993 and also establishes provisions for
payment of future fees.
RECOMMENDATION
Adopt Resolution No. 92-193 which amends the schedule of rates in the franchise agreement
to reflect a 6.3 % increase in rates for single family households and a 6.6% increase for
multifamily bin accounts, to become effective on January 1, 1993.
Adopt Resolution No. 92-194 which amends the franchise agreement to add subsection 5J
."Senior Citizen Discount Rate Program."

Authorize the City Manager to execute a MOU between the City and the haulers to collect
the balance due to the City of franchise fees less pass through costs; to reestablish the
payment schedule for future franchise fees due to the City; and to set the next annual rate
adjustment to occur on January 1,,1994.

A RESOLUTION OF THE CITY OF SANTA CLARITA, CALIFORNIA
ESTABLISHING A SERVICE FEE SCHEDULE FOR THE
COLLECTION, RECYCLING AND DISPOSAL OF SOLID
WASTES, GREEN WASTES AND RECYCLABLES
WHEREAS, the City of Santa Clarita has adopted Resolution No. 91-27 relating to
the granting of an exclusive franchise for the collection, recycling and disposal of solid
wastes, green wastes and recyclables within the City limits; and
WHEREAS, the City Council has entered into an agreement with Santa Clarita
Disposal Company, Blue Barrel Disposal and Atlas Refuse Removal Company to collect,
pick up and remove, recycle and dispose of solid wastes, green wastes and recyclables from
all single family residences and all multi -family residences in the City of Santa Clarita, and
WHEREAS, from time to time the landfill tipping fees fluctuate and the franchise
grantees should be compensated for those increases over which they have no control; and
WHEREAS, on September 24, 1992 results of the City's rate review analysis
confirmed increases in landfill tipping fees which reflect an increase in rates of four and four
tenths percent (4.4%) to single family households accounts and four and seven tenths percent
(4.7%) to multi family accounts, and
WHEREAS, the City's franchised residential haulers currently utilize the Chiquita
Landfill, such action will impose a direct impact upon all City residents, and
WHEREAS, Section 21B of the City's residential refuse and recycling franchise
agreement provides for annual modification and adjustment of rates due to changes in the
Producer Price Index, and
WHEREAS, increases due to incremental changes in the Producer Price Index
reflect an increase of one and nine tenths percent (1.9%) to both single family households
and multifamily bin accounts, and
WHEREAS, Resolution No. 91-193, hereinafter superseding Resolution No. 91-85,
authorized to impose fees necessary for collection services of solid wastes, green wastes and
recyclables to all Santa Clarita residents. `
NOW, THEREFORE BE IT RESOLVED. by the City Council of the City of Santa
Clarita, as follows:
Section 1. The attached Exhibit A-92 represents the revised service fee schedule
for the collection, recycling and disposal of solid wastes, green wastes and recyclables, as of
January 1, 1993.
Section 2. Landfill tipping fees that are increased less than 25 percent may
increase the.service rate to each customer and shall be apportioned on a pro -rata basis. The
increased service rate shall be implemented 15 days after notifying the City Manager and
pursuant to Section 21D, Residential Solid Waste Franchise Agreement.
Section 3. The effective date of this Resolution shall take effect immediately upon
adoption of Resolution No. 92-193 for the collection, transportation, recycling and disposal
of solid waste, green wastes and recyclables.

WHEREAS, the City of Santa Clarita has adopted Resolution No. 91-27
relating to the granting of an exclusive franchise for the collection, recycling and disposal of
solid wastes, green wastes and recyclables within the City limits; and
WHEREAS, the City Council has entered into an agreement with Santa Clarita
Disposal Company, Blue Barrel Disposal and Atlas Refuse Removal Company to collect,
pick up and remove, recycle and dispose of solid wastes, green wastes and recyclables from

WHEREAS, the attached Exhibit 92-194A represents qualifications for senior
citizen standing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita,
amend the franchise agreement toincludeSubsection 57 as follows:
SECTION 5 - SERVICES PROVIDED BY GRANTEE
J. Senior Citizen Discount Program
a. Senior Citizen Discount - Single Family Units
A ten percent (10°%0) reduction of the approved rates shall be available
to all qualifying senior citizens who own and occupy or rent single
family housing units.
b. Senior Citizen Discount - Multifamily Units/Senior Citizen
Communities
A ten percent (10%) reduction in rates shall be available to all
qualifying multifamily senior citizen housing complexes which are
owned, operated and approved by Federal, State or local public entities;
or communities designated as senior citizen communities and meet the
qualifications specified in Resolution No. 92-194.
c. Senior Citizen Discount - Mobile Home Parks
A ten percent (10%) reduction in rates shall be available to all
qualifying single billed mobile home parks who have proof of a 90 %
senior citizen occupancy rate. Individually billed senior -occupied
mobile home units shall also be eligible for the 10% discounted rate.
The effective date of this Resolution shall take effect immediately upon
adoption of Resolution No. 92-194 for the collection, transportation, recycling and disposal
of solid waste, green wastes and recyclables.

This is a Memorandum of Understanding (MOU) between the City of Santa Clarita and
SANTA CLARITA DISPOSAL COMPANY to recover past due franchise fees pursuant to
Resolution 91-27 in the amount of $142.212.
I. PAYMENT SCHEDULE
Payment of these past -due franchise fees shall be due to the City in payments
fifteen (15) days after the end of each calendar month beginning on
November 15, 1992, and thereafter until such time that past due fees are paid
in full. Any past due fees unpaid as of February 15, 1993 shall accrue
maximum interest as permitted by California State law.
H. FUTURE PAYMENTS OF FRANCHISE FEES
A franchise fee of ten percent (10%) of gross revenues shall be paid in, full by
Santa Clarita Disposal Company to the City fifteen (15) days after the end of
each calendar month beginning on February 15, 1993 and thereafter during the
term of the Franchise Agreement and any extensions.
A. Failure to Pay
Failure or neglect of the Grantee to make payments within 30 days of
the due date as required in the franchise agreement and this MOU
shall result in assessment of the cash bond for the amount of the
payment and interest at the highest rate permitted by California State
law.
