SUBJECT: STREET AND DRAINAGE IMPROVEMENTS IN EAST NEWBALL,
CDBG NO. D90-0633
PROJECT NO. 90-17 - BID AWARD

BACKGROUND
On November 12, 1991, Council authorized the advertisement of the subject
project, which provides for the construction of drainage improvements in the East
Newhall area (see attached map). This project is funded by the Community
Development Block Grant (CDBG) program.
On Tuesday, December 10, 1991, the following bids were received by the City
Clerk:
It should be noted that the bid by the second low bidder, Excel Paving Company,
contained an irregularity. Staff recomputed Excel Paving Company's bid at
$168,447.35 which would make them the apparent low bidder. Excel Paving notified
Staff that this discrepancy was a clerical error, and requested to be relieved
of their .bid. The error consisted of indicating a unit bid price of $4.89
instead of $40.89 on unclassified excavation. Their total bid - price of
$186,411.35 used the $40.89 figure.
Section 5101 of the California Public Contract Code provides the guidelines by
which bidders may request to be relieved of their bid.- If Council does not agree
to the withdrawal of the bid, the contractor's remedy is to seek the Court's
concurrence under Section 5101. Staff has reviewed Excel Paving's request and
is of the opinion that the explanation for the error seems factual. Staff
therefore recommends that Council accept Excel Paving's request to relieve them
of their bid. The Los Angeles County Community Development Commission (CDC), the
agency- administering the CDBG funds for this project, concurs with this
recommendation.

Staff recommends that the project be awarded to Payne Engineering, Inc. in the
amount of $177,478.47. The Los Angeles County Community Development Commission
also concurs with this recommendation. Payne Engineering, Inc. possesses the
necessary State Contractor's license and is a member in good standing. Payne has
performed similar work for the County of Los Angeles and the City of Westlake,
both of whom indicated satisfactory performance.
1. Consent to Excel Paving Company's request to be relieved of their bid,
reject said bid.
2. Award the contract to Payne Engineering, Inc. in the amount of
$177,478.47.
