Home My WebLink About1992-08-25 - AGENDA REPORTS - TRANS OF STORM DRAIN TO LACO (2)AGENDA REPORT City Manager Item to be presented CONSENT CALENDAR DATE: August 25, 1992 SUBJECT: TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD) TRACT NUMBERS 44320, 44321, 44322, AND 43593 PRIVATE DRAIN NO. 2154 Resolution Number: 92-156 DEPARTMENT: Community Development BACKGROUND The construction of Private Drain No. 2154 has been inspected and approved by the County Director of Public Works, who has sent. a Notice of Completion to the City. The storm drains were constructed by the developer. in accordance with agreements and the Faithful Performance Bonds on file with the City Clerk (see Exhibit "B" attached showing the location and extent of improvements). The agreements also provide that the work shall not be deemed complete until approved, accepted as complete, and transferred.to LACFCD for maintenance. The City and County entered into an agreement on March 14, 1989 recorded as Document Number 89-1346418 which provides for the transfer of storm drains. The City Council must approve a resolution authorizing the transfer to complete the process. The transfer is then accepted. and approved by the Board of Supervisors for the LACFCD, who operates and maintains the storm drains for public use. 1. Adopt the attached resolution for the transfer and conveyance of the storm drain improvements to the LACFCD for purposes of operation, maintenance, repair and improvements. 2. Direct the City Clerk to transmit a copy of. this report indicating the date and action taken and three certified copies of the adopted resolution to Mr. Stan Dixon at the County of Los Angeles. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit "A." RESOLUTION NO. 92-156 Page 2 BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including -deed, to effectuate. said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore- have been conveyed to and accepted by District. Reference is hereby made to District Drawing Nos. 337-F146.1-.9, the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to teach of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles.
