HomeMy WebLinkAbout1992-01-28 - AGENDA REPORTS - VESTING TRACT 48117 ACCEPT GVR (2)NEW BUSINESS DATE: SUBJECT: DEPARTMENT: BACKGROUND AGENDA REPORT City Manager Item to be Pr January 28, 1992 QI VESTING TRACT NO. 48117 APPROVAL OF THE MAP AND ACCEPTANCE OF THE OFFERS OF DEDICATION FOR GOLDEN VALLEY ROAD, SOUTHEASTERLY OF GREEN MOUNTAIN DRIVE Community Development The Vesting Tentative Tract Map was originally approved by the Planning Commission on 11/7/89. A condition of the map was to participate in the funding of Golden Valley Road from Sierra Highway to State Route 14 (Antelope Valley Freeway). Five developers have agreed to improve the entire roadway within one year of occupancy of the development or three years of final map approval and form an assessment district on their properties to pay for the roadway costs (see attached district map). Based on the current low -housing market, the uncertain time to start for the other four developers, and the substantial improvement of the property by this developer, the Planning Commission agreed on January 7, 1992 to allow this development to proceed without a specific time for completion of Golden Valley Road on this project. On this same agenda is a Funding and Acquisition Agreement which commits this developer to pay into a fund its proportionate share of. the cost of completing Golden Valley Road between Green Mountain Drive and Sierra Highway. In addition, the developer is required to complete the widening and improvement of Golden Valley Road adjacent to its property, i.e., between Green Mountain Drive and State Route 14, the Antelope Valley Freeway. The agreement also provides that the City must form the district and assess the properties when sufficient land value exists in the other four properties to support the district in accordance with the City's Public Financing Policy. This agreement must be approved by the Council as a precursor to approval of the map. The developer is subdividing 19.96 acres into 104 residential and 7 common area lots for the benefit of the residents within the subdivision. The conditions of approval have been met, the fees have been paid as indicated on the Fact Sheet and the map has been checked to the satisfaction of the City Engineer. The map is ready for the Council's approval and acceptance of the dedications. APPROVED agenda item: I VESTING TRACT NO. 48117 Page 2 RECOMMENDATION Part 1. Approve the map. Part 2. Accept on behalf of the public, the offers of dedication for streets, sewers, storm drains and other dedications as stated on the map. Part 3. Approve and accept work agreements and improvement securities including the funding and acquisition agreement required as a condition of recordation of the map. Part 4. Make findings as follows: a. That this project will not violate any of the provisions of Sections 66474, 66474.1 and 66474.6 of the Subdivision Map Act. b. That the proposed subdivision, together with the provisions for its design and improvement, is consistent with the general plan required by Article 5 (commencing with Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific plan adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of Division of the Government Code. c. That the development of the property in the manner set forth on the subject division of land will not unreasonably interfere with the free and complete exercise of any public entity and/or public utility rights-of-way and/or easements within the .subject division of land, pursuant to Section 66436(a)(3)(A)(i-vii) of the Subdivision Map Act. Part 5. Instruct the City Clerk to endorse the Certificate on the face of the map of Tract No. 48117, which embodies the. approval of said map and the acceptance of the dedications shown thereon.
