BACKGROUND
Funding for the third phase of the Whites Canyon Road project has been
challenging for both the City and the County. At your last meeting, the
Council agreed to contribute 2.0 million dollars to move the project forward.
Recently the County has indicated that they have reached a tentative agreement
with Newhall Land and. Farming Company (NLF) which would save $1,500,000 of
project costs. Without this savings, the project could not move forward
toward construction at this time.
The substance of this agreement is that NLF will donate street easements
across their property at no costs in exchange for the City's release
(vacation) of unnecessary street easements across NLF property and our support
of their proposed zone change. Since the existing street easement is along
the old roadway alignment and is not necessary for any future uses and the
General Plan identifies the property suggested for a zone change as business
park, both the release of the easement and the zone change are consistent with
the City's future plans. Consistency with future planning, the saving of $1.5
million in right-of-way costs, and the assurance of project implementation are
in the best interest of the City, the County, and the community.
The right-of-way release can be accomplished by. the Council's adoption of a
resolution of summary vacation. This summary vacation is allowed by state law
without a public hearing whenever the Council finds that the street easement
has not been used for what it was intended, it is superseded by other
rights-of-way, and no access to properties is affected by the vacation. These
facts all relate to this property and summary.vacation is appropriate.
A related issue to the project is the Council's acceptance of rights -o£ -way
offered for dedication of Via Princessa in 1987. This offer of dedication was
required in anticipatiod of the connection of Via Princessa with Whites Canyon
Road. The Council can effectuate this portion of the right-of-way by
adopting Resolution No. 92-12.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, SUMMARILY VACATING WITHOUT RESERVATIONS -A PORTION OF
NEWHALL RANCH ROAD AND VIA PRINCESSA PURSUANT TO CALIFORNIA STREETS
6 HIGHWAYS CODE SECTION 8330, ET SEQ.
BE IT RESOLVED by the City Council of!the City of Santa Clarita that it
is hereby found and determined that portions of Newhall Ranch Road and Via
Princessa, in the northwest quarter of Section 28, T. 4 N., R 15 W., northwest
of Sierra Highway and the appurtenant slope easements, legally described in
Exhibit "A" and as shown by the map in Exhibit "B" attached hereto and
incorporated herein by this reference, which real property, located in the
vicinity of Santa Clarita, in the County of Los Angeles, State.of California,
are no longer needed for present or prospective use based upon the following
facts: That the subject rights=of-way have been superseded by relocation and
the proposed vacation does not cut off all access to the properties of any
persons which prior to such relocation adjoined the highways and does not
terminate a public service easement, that the subject excess rights-of-way
have not been used for the purpose for which it was dedicated or acquired for
five consecutive years immediately preceding the proposed vacation; that the
subject rights-of-way are excess rights-of-way not required for street or
highway purposes and that the subject right-of-way is not required for general
public access or circulation or for a bicycle path or trail. -
BE IT FURTHER RESOLVED that the public easements in, over and across said
property for street and highway purposes legally described in Exhibit "A"
attached made by deed recorded on March 6, 1986 Official Records Document
No. 86-287609 are hereby vacated pursuant to Chapter 4, Part 3, Division 9 of
the Streets and Highways Code, State of California commencing with
Section 8330.
AND BE IT FURTHER RESOLVED that the Executive Officer -Clerk of the City
Council be instructed to record the certified original resolution in the
office of the Registrar -Recorder of the County of Los Angeles, at which time
the area vacated will no longer be public easements.

Township 4 north, Range 15 west, S.B.M., in the City of Santa Clarita, County
of Los Angeles, State of California, which lies within those certain parcels
of land described as Parcels 4A and 4B in deed to County of Los Angeles,
recorded on March 6, 1986, as Official Records Document No. 86-287809, in the
office of the Recorder ofsaidCounty.
Excepting therefrom that portion. thereof which lies within a strip of land
180 feet wide, lying 90 feet on each side of the following described center
line:
Beginning at a point in the westerly line of said section distant
south 0024127" east thereon 336.45 feet from the northwesterly corner of said
section; thence south 66"24'55" east to the southeasterly boundary of that
certain 100 -foot strip of land described in deed to Southern Pacific Railroad

RESOLUTION NO. 92-113
RESOLUTION ACCEPTING DEDICATION OF FUTURE STREET
VIA PRINCESSA
WHEREAS, an "irrevocable offer to dedicate" to the County of Los Angeles
an easement for public road and highway purposes was recorded on March 13,
1987 Official Records Document No. 87-380724, in the office of the
Registrar -Recorder of the County of Los Angeles, and
WHEREAS, a portion of the area covered by said offer to dedicate is now
necessary for the improvement of Via Princessa, and
WHEREAS, upon incorporation, the City of Santa-Clarita is the successor
in interest to the County of Los Angeles by operation of law under the
provisions of Section 989 of the Streets . and Highways Code of the State of
California and acquired all rights, title and.interest of the County over said
area.
NOW THEREFORE BE. IT RESOLVED, pursuant to Section 66477.2 of the
Government Code of the . State of California, that a portion of said offer to
dedicate be accepted for public use for the improvement of Via Princessa as
described in Exhibit "A" attached hereto and incorporated herein by this
reference.
and BE IT FURTHER. RESOLVED,. that the Clerk of the City be instructed to
record the certified original resolution in the office of the
Registrar -Recorder of the County of Los Angeles.
