SEPTEMBER 30, 1992
Called to order at 7:04 p.m.
Recessed to closed session at 7:05 p.m. to discuss items of pending or
potential litigation.
Reconvened at 7:38 p.m.
Item 1 - Introduction of new City employees
Employees introduced and Council received presentation.
Item 6 - County Monitoring Project - Westridge
City Attorney made a brief report from the closed session.

Council discussion:
Motion made by Boyer and seconded by Heidt to waiver the City Attorney/
client privilege. No objections, so ordered.
City Attorney summarized the closed session further. He reported on the
lawsuit and outlined areas which the City might consider -by way of
challenge. Specific areas are: (a) adequacy of CEQA documents;'
(b)challenge under the DMS of the County; (c) challenge on the procedures
and policies of the SEATAC.
Council discussion: NL&F settle problems with Fish & Game; cannot afford
to spend money on litigations; not to pursue litigation. Motion made by
Darcy and seconded by Heidt not to pursue litigation and not to enter into,
a joint venture with any other persons. On roll call vote: Ayes: Boyer,
Darcy, Heidt, Pederson. Noes; Klajic. Motion carried 4-1.

Item 92 --Development Impact Fee Study
Lynn introduced Dick Recht, consultant, from Recht Hausrath Assoc. who
gave the report on the study and made a slide presentation.

Council discussion: Performing Arts Center to be included; concerned about
depression of home values; work with County on school fees; fees should be
a graduated level; compare Quimby fees; high costs of standard office,
retail commercial and industrial; whether or not we can phase the fees;',
run down of alternate sources to pay for existing deficiencies; community'
center could be income for the City and to include this in report;
investigate a 50 meter pool which could be a joint venture with the. high
schools, a sports complex for a team or program, youth center which could
be a cooperative effort between the youth organizations; facilities needed
to support the population of the future.
Council received the presentation, discussed the draft development impact
fee study; directed staff to meet with citizens who may need questions
answered; return to Council in 1993; and directed staff to have more
public participation on the fees.
Item 13 - Solid Waste Fees
Jeff Kolin introduced consultant from Hilton, Frankopf and Hobson who
explained the solid waste fees and presented slides pertaining to
collection costs. The consultant recommended the City collect' the
franchise fees from the haulers ($452,000); increase single family rates
on 1/1/93 by $1.13 and multi -family by 6.62, to pass through hauler cost
increases for disposal and PPI; consider implementing a "wheel -out" charge
that should be accompanied by a reduction in the basic bin charges; and
establish a formal rate review procedure for future rate charges. He then
explained some rate setting alternatives.
It was also recommended Council allow staff to bring changes to Council
next month, adjust rates, direct staff to work on the multi -family
structure. Jeff Kolin stated green waste program to be introduced soon.
Council discussion: a portion of the franchise fees accrued be directed to
fight Elsmere; senior discount not significant; no discussion on variable
can rates; portion of franchise fees accrued goes to AB939 which will be
used for education to fight Elsmere; would like an enterprise fund;
recommendation 05 (staff develop the Council's rankingsand priorities
into a systematic approach for managing commercial disposal and waste
diversion) to be handled by the waste management committee for their
recommendations to Council; investigate commercial trash through the City;
investigate using City contracts for haulers; City should regulate fees;
investigate 3 yard bins for single family homes.
City Manager comments: would like to see City up in the 20% range within a
year; 5 year plan concerns him.

Motion made by Klajic and seconded by Pederson to direct staff to return
to Council on 10/13 with a resolution amending the schedule of rates to
reflect an increase of 6.3Z on single family households and 6.6X on
multi -family accounts and to include a discount rate for seniors; direct
City Manager to collect the $452,000 from the haulers; direct City Manager
to execute MOU between City and franchised haulers to collect franchise
fees 15 days after the end of each calendar month to begin January, 1993,'
with the first payment due February 15, 1993 and establish the date of the
next annual rate review as January, 1994; direct staff to return to
Council with a resolution amending franchise agreement to include an
annual rate adjustment procedure based on projectedrevenues and costs and
to add provisions for senior discounted rates; to direct the waste
management committee to recommend to Council rankings and priorities on a
systematic approach for managing commercial disposal and waste diversion;
following recommendation from waste management committee, Council to hold
a public hearing; directed staff to research enterprise funding.

Item 15 - Unified Develoument Code and Zoning Map
Council directed staff to continue this matter to another study session
and to continue with the public hearing scheduled for October 27, 1992.

Item 14 - Arroyo Seco Assoc./Municipal Resources Consultants Evaluation of
City Transit Fees
Jeff Kolin presented the consultants to Council. The consultant explained
the study and presented slides to Council. He explained revenues for
fixed route transit, Dial -a -Ride, and commuter services.
Jeff Kolin explained actions being undertaken by staff for Dial -a -Ride:
conducted customer training for transit employees and the City; developed
a draft no-show and cancellation policy; formalized curb -to -curb service;
will be reducing the reservation time; will be installing a telephone
recording system which allows all incoming calls to be recorded;
developing a quarterly report; working on a printed driver's handbook and
rule book; begin reducing 40Z unproductive driver time; ATE hired
additional telephone operators from 6-8 a.m.; installed recording devices
to call in cancellations 24 hrs.
Council discussion. subsidizing people so much and tolerating increases
without problems; cost of service; quantity of public benefit that comes
from a particular mode of transit and cost recoveries; begin a' cost
monitorship an 10/1/92; too many Dial -a -Ride problems; what are
contractual impediments;

Council directed staff to look into bid requirements and purchasing laws
both State and Federal; a report from staff for policy of discontinuing
DAR; reduce 40Z dead time; get proposal from B. Berens; look at an
ancillary service.
Motion was made by Boyer and seconded by Darcy to adjourn the study session.
No objections. Study session adjourned at 12:17 a.m.
