HomeMy WebLinkAbout1992-06-09 - RESOLUTIONS - NRR VIA PRINCESSA VACATE (2)RESOLUTION NO. 92-112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, SUMMARILY VACATING WITHOUT RESERVATIONS A PORTION OF NEWHALL RANCH ROAD AND VIA PRINCESSA PURSUANT TO CALIFORNIA STREETS 6 HIGHWAYS CODE SECTION 8330, ET SEQ. BE IT RESOLVED by the City Council of the City of Santa Clarita that it is hereby found and determined that portions of Newhall Ranch Road and Via Princessa, in the northwest quarter of Section 28, T. 4 N., R 15 W., northwest of Sierra Highway and the appurtenant slope easements, legally described in Exhibit "A" and as shown by the map in Exhibit "B" attached hereto and incorporated herein by this reference, which real property, located in the vicinity of Santa Clarita, in the County of Los Angeles, State of California, are no longer needed for present or prospective use based upon the following facts: That the subject rights-of-way have been superseded by relocation and the proposed vacation does not cut off all access to the properties of any persons which prior to such relocation adjoined the highways and does not terminate a public service easement; that the subject excess rights-of-way have not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation; that the subject rights-of-way are excess rights-of-way not required for street or highway purposes and that the subject right-of-way is not required for general public access or circulation or for a bicycle path or trail. r^ BE IT FURTHER RESOLVED that the public easements in, over and across said property for street and highway purposes legally described in Exhibit "A•' attached made by deed recorded on March 6, 1986 Official Records Document No. 86-287609 are hereby vacated pursuant to Chapter 4, Part 3, Division 9 of the• Streets and Highways Code, State of California commencing with Section 8330. AND BE IT FURTHER RESOLVED that the Executive Officer -Clerk of the City Council be instructed to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles, at which time the area vacated will no longer be public easements. Gria ey, City C DLS:658 EXHIBIT "A" Part A: Those portions of Newhall Ranch Road, in the northwest quarter of Section 28, Township 4 north, Range 15 west, S.B.M., in the City of Santa Clarita, County of Los Angeles, State of California, which lies within those certain parcels of land described as Parcels 4A and 4B in deed to County of Los Angeles, recorded on March 6, 1986, as Official Records Document No. 86-287809, in the office of the Recorder of said County. Excepting therefrom that portion thereof which lies within a strip of land 180 feet wide, lying 90 feet on each side of the following described center line: Beginning at a point in the westerly line of said section distant south 0°24'27" east thereon 336.45 feet from the northwesterly corner of said section; thence south 66"24'55" east to the southeasterly boundary of that certain 100 -foot strip of land described in deed to Southern Pacific Railroad Company, recorded as Document No. 27, on April 26, 1890, in Book 643, Page 250, of Deeds, in the Office of the said Recorder. Part B: That portion of Via Princessa in the above-mentioned northwest quarter, in the �. above-mentioned City, which lies within that certain parcel of land described as Parcel 3 in the above-mentioned deed to the County of Los Angeles, recorded on March 6, 1988. Part C: That portion of that certain slope easement and appurtenant structures in the above-mentioned northwest quarter, in the above-mentioned City, which lies within that certain parcel of land described as Parcel 5 in the above-mentioned deed to the County of Los Angeles, recorded on March 8, 1986. Excepting from the above-described Part C that portion thereof which lies northeasterly of the southwesterly line of the above-described 180 -foot strip of land. Part D: That certain slope easement and appurtenant structures in the above-mentioned northwest quarter, in the above-mentioned City, which lies within that certain parcel of land described as Parcel 6 in the above-mentioned deed to the County of Los Angeles, recorded on March 6, 1986. Part E: r+ That portion of that certain slope easement and appurtenant ppurtenant structures is the above-mentioned northwest quarter, in the above-mentioned City, which lies within that certain parcel of land described as Parcel 7 in the above-mentioned deed to the County of Los Angeles, recorded on March 6, 1986. A EXHIBIT "A" Page 2 Excepting from the above-described Part E that portion thereof which lies within a strip of land 100 feet wide, lying 50 feet on each side of the following described center line: Commencing at the northerly terminus of that certain 1,369.95 foot radius curve in the center line of that certain 105 -foot strip of land described in Part A of deed to the County of Los Angeles, for whites Canyon Road, recorded on August 5, 1987, as Official Records Document No. 87-1249913, in the office of the above-mentioned Recorder; thence southerly and southwesterly along said certain curve and its southwesterly continuation 1,053.99 feet to a point, a radial of said curve to said point bears south 30007146" east, said point also being the true point of beginning; thence south 35.07146" east 73.58 feet to the beginning of a tangent curve concave to the northeast and having a radius of 1,200 feet; thence southeasterly along said last-mentioned curve through a central angle of 33"51'39" a distance of 709.18 feet; thence south 68059125" east tangent to said last mentioned curve 2,067.99 feet to the beginning of a curve concave to the southwest, having a radius of 1,200 feet, tangent to said last-mentioned course and tangent to the northeasterly boundary of that certain parcel of land described as Parcel 1 in the above-mentioned deed to the County of Los Angeles, recorded on March 6, 1986; thence southeasterly along said curve 219.25 feet.
