HomeMy WebLinkAbout1992-07-14 - RESOLUTIONS - STORMDRN IMPROV DRAIN 1975 (2)RESOLUTION NO. 92-131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO. 1975 IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as Private Drain No. 1975, described in Exhibit "A" attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the .-. County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit "A" attached hereto from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit "A". BE IT FURTHER RESOLVED that, subject to the acceptance thereof the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorised and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore have been conveyed to and accepted by District. RESOLUTION NO. 92-131 Page 2 Reference is hereby made to District Drawing Nos. 43-F306.1-.7, the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated here by this reference. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 14th day of July , 1992. Gri dey, City C r ffiIBIT "A" Private Drain No. 1975 A reinforced concrete pipe storm drain system and appurtenant structures for Tract Map No. 32321, filed in Book 1066, Pages 41 to 47, inclusive, of Maps, Records of the County of Los Angeles, generally described as follows: Line "A" Commencing from existing storm drain per P.D. 1307, Station 11 + 92.76 located within Sand Canyon Road right-of-way, north of Soledad Canyon Road; thence northerly and northwesterly to a variable width easement for storm drain and storm drain ingress and egress purposes, which lies entirely within the private drive of said tract; thence northwesterly, northerly, northeasterly, northwesterly and northerly in last said mentioned easement to a variable width easement for flood control -purposes lying adjacent but not within the private drive of said tract; thence northwesterly in last said mentioned easement to an inlet structure, Station 15 + 84.60, a distance of 1,585 feet, more or less. Laterals "C," "D," "G," and "H" Connector pipes from Line "A" to catch basins. Line "B" Commencing from the intersection of Line "A," Station 0 + 55.70; thence northerly and northeasterly within Sand Canyon Road right-of-way to a terminal catch basin, Station 3 + 95.99, a distance of 396 feet, more or less. Line "F" Commencing from the intersection of Line "A," Station 8 + 49.54 located within a variable width easement for storm drain and storm drain ingress and egress purposes; thence northerly to a 12 -foot wide easement for storm drain purposes; thence northwesterly in last said mentioned easement to a 26 -foot and variable width easement for storm drain and storm drain ingress and egress purposes; thence westerly, northwesterly, and northerly and northwesterly to a variable width easement for flood control purposes; thence northwesterly within the last mentioned easement to an intake structure. Station 7 + 86.93, a distance of 787 feet, more or less. Line "B" Commencing from the intersection of Line "A," Station 5 + 22.98 located within a variable width easement for storm drain and storm drain ingress and egress purposes; thence northwesterly to a ten -foot and variable width easement for storm drain and storm drain ingress and egress purposes; thence northwesterly, westerly and northwesterly to a variable width easement for flood control purposes; thence northwesterly to an inlet structure, Station 2 + 35.00, a distance of 235 feet, more or less. Line "R" Commencing from an outlet structure, Station 0 + 00.00 located within Sand Canyon Road future right-of-way; thence southwesterly to a variable width easement for storm drain and storm drain ingress and egress purposes; thence southwesterly to a terminal catch basin, Station 1 + 98.71, a distance of 199 feet, more or less.
