Home My WebLink About1993-02-09 - AGENDA REPORTS - ANNEX RESIDENTIAL REFUSE AGMT (2)AGENDA REPORT CONSENT CALENDAR City Manager Apprc Item to be presented DATE: February 9, 1993 v SUBJECT: ANNEXATIONS TO THE RESIDENTIAL REFUSE FRANCHISE AGREEMENT Resolution No. 93-14 DEPARTMENT: Public Works On November 4, 1992, a certificate of completion was executed by the Los Angeles County Local Agency Formation Commission annexing a certain uninhabited territory designated as Annexation No. 1990-04 into the City of Santa Clarita. To achieve the goals mandated by the California integrated Waste Management Act (AB939), it is imperative that this area be included into the City's refuse collection and recycling program. Through the City's residential franchise, the necessary mechanisms are in place to address newly annexed areas and provide them with the levels of services consistent with the remainder of the City. The City has the following options: 1. Grant a franchise for the said territory to any qualified hauler. 2. Grant a franchise for the said territory to one of the City's existing franchised haulers. 3. Add the said territory to the existing franchised hauler currently servicing the adjacent area in the City. The subject area incorporated .064 -square miles which is uninhabited. Santa Clarita Disposal currently services the adjacent households to the area and offers the levels of service required by the City's residential franchise. RECOMMENDATION Add Annexation Number 1990-04 to the franchised area granted to Santa Clarita Disposal for a granting fee of $1,000 and adopt Resolution 93-14. WHEREAS, the Legislature of the State of California, by enactment of the California Integrated Waste Manauement Act of 1989 ("AB 939"), has declared, that it is within the public interest to authorize and require local agencies to make adequate provisions for solid waste handling within their jurisdictions; and WHEREAS, pursuant to Public Resources Code Section 40059(a)(1), the City Council of the City of Santa Clarita has determined that the public health, safety and well-being require that exclusive franchises be awarded to qualified solid waste enterprises for integrated waste management, including collection and recovery of recyclables, green wastecollectionand composting, and solid waste disposal for residential areas in the -City of .Santa Clarita; and WHEREAS, the Santa Clarita Municipal Code authorizes the City Council of the City of Santa Clarita to award exclusive franchises for refuse collection in designated franchise arehs for all or a portion, of residential properties in the City; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Santa Clarita as follows: SECTION 1. The City Council of the City of Santa Clarita hereby finds, determines, and declAres that the public convenience and necessity are served by the award of exclusive franchises to ATLAS DISPOSAL,. BLUE BARREL DISPOSAL AND SANTA CLARITA DISPOSAL for the collection, transportation, recycling, composting and disposal of solid waste, green wastes and recyclables. SECTION 2. The franchise agreements by which, on February 12, 1991, the City granted exclusive franchises for designated franchise areas to ATLAS DISPOSAL, BLUE BARREL DISPOSAL AND SANTA CLARITA DISPOSAL are hereby ratified, confirmed and approved and are attached hereto and are -1- apc/RES195222 hereby incorporated into this resolution by reference as if fully and accurately included herein. SECTION 3. All prior resolutions and parts of resolutions in conflict with this resolution are hereby rescinded. WHEREAS, the number of service area customers will change as annexations or rezonings are approved by the actions of the City Council. NOW, THEREFORE, the City Council of Santa Clarity does hereby resolve, determine and order as follows: Section 1. The attached "Exhibit A-92" represents the revised service area boundaries for Santa Clarita Disposal Company to include Oak Springs Canyon (Annexation Number 1990-03). Service areas for Blue Barrel Disposal and Atlas Disposal remain unchanged. Subsequent annexations and rezonings which are approved by the City Council may be reflected as changes on Exhibit A-92. Section 2. This Resolution No. 92-181 supersedes Resolution No. 91-29 delineating service area boundaries for the collection, recycling and disposal of solid waste. Section 3. The effective date of this Resolution shall take immediately upon adoption of Council Resolution No. 92-181 for the collection, transportation, recycling and disposal of solid wastes, green wastes and recyclables.
