Is a resolution to be adopted by the City Council to approve findings on written protests and to approve and order Annexation No. 1990.06 (the "Copperhlll Annexation"). Annexation No. 1990-05 is a proposal to annex approximately 210 acres of Inhabited land located In the Saugus area, north and east of the existing City limits, south of Copperhill Drive, and west and east of Haskell Canyon Road. (See attached map.) The Copperhlll Annexation was Initiated In early 1991 by Copperhili area residents seeking the benefits, representation and services of cityhood. In addition, the City wished to form a more logical City boundary. The City Council adopted a Resolution of Application (Resolution No. 92.180) for this proposal on July 14, 1992, requesting that the LAFCO Initiate annexation proceedings for the Copperhili Annexation area. Annexation No. 1990-06 was submitted to the LAFCO for processing on August 25, 1992. On March 25, 1993, the City Council adopted Ordinance No. 93-7, approving the prezoning of the proposed annexation area to City Residential Low and Residential Moderate; and adopting related environmental documents. The City Is also proposing to enter Into an annexation agreement with Cucamonga Development Co. to vest Cucamonga's permits to construct 24 single-family residential units on approximately 43 acres, approved by Los Angeles County In 1991. The annexation agreement will give Cucamonga Development certainty that It can finish the project In the City and ensure its support for the annexation. The LAFCO approved the annexation on November 10, 1993, subject to the condition that an annexation agreement with Cucamonga Development Co. is pending. ANALYSIS The attached resolution states the direction given to Council by the LAFCO to proceed with a duly noticed public hearing; and sets forth the reasons for the annexation, the terms and conditions established for the annexation by the LAFCO, exhibits identifying the site, and other required recitals. If the annexation and associated annexation agreement proceed as scheduled, the annexation agreement will be reviewed and approved by the Planning Commission on November 16,1993; the Council will review the agreement on December 14, 1993, and pass the ordinance for approval to Adopted: / 9-n Agenda Item:______ a second reading; and the annexation will be recorded and become final on December 15, 1993. (The first reading of the ordinance approving the annexation agreement will demonstrate a "good faith" effort on the City's part to complete the agreement with Cucamonga Development Co.) Annexation No. 1990-06 is "inhabited;' therefore, by State law, the City Council must approve the annexation If protests are filed by either 1) less than 25% of the area residents or 2) owners of property valued at less than 25% of the total assessed value of land within the area. If the percentage of opposition of either group is greater than 50%, the City Council must deny the annexation. There are no known persons or organizations opposed to this proposal. As a special note to the Council, if the annexation Is recorded by March 14, 1994, these residents would be afforded the opportunity to vote in the April 1994 General Municipal Election. RECOMMENDATION 1. Adopt Resolution No. 93-159, making findings regarding written protest; and 2. If the hearing results in Insufficient written protest and the annexation is approved, then direct staff to transmit Resolution No. 93.159 and appropriate fees to the LAFCO for final review and certification. Mayor announces decision 0 CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING REGARDING ANNEXATION NO. 1990-06 (COPPERHILL ANNEXATION) LOCATED NORTH AND EAST OF THE EXISTING CITY LIMITS, WEST AND EAST OF HASKELL CANYON ROAD, SOUTH OF COPPERHILL DRIVE, AND EAST OF THE LOS ANGELES AQUEDUCT PUBLIC NOTICE IS HEREBY GIVEN: A Public Hearing will be held before the City Council of the City of Santa Clarita regarding Annexation No. 1990-06 ("the Copperhill Annexation"), located north and east of the existing City limits, west and east of Haskell Canyon Road, south of Copperhill Drive, and east of the Los Angeles Aqueduct. The City is proposing to annex an approximately 210 acre inhabited area (consisting of 720 existing homes and 24 proposed homes) to the City of Santa Clarita. The purpose of the hearing will be to receive and consider all written protests of any residents or owners of land within the territory proposed to be annexed to the City of Santa Clarita. Grindey, CMC City Clerk RESOLUTION NO. 93-159 A RESOLUTION OFTHE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, MAKING FINDINGS THAT INSUFFICIENT WRITTEN PROTESTS HAVE BEEN FILED AND APPROVING AND ORDERING THE ANNEXATION OF CERTAIN INHABITED TERRITORY DESIGNATED AS "ANNEXATION NO. 1990-06" TO THE CITY OF SANTA CLARITA WHEREAS, the Local Agency Formation Commission of the County of Los Angeles adopted Its resolution, making determinations and approving the proposed annexation to the City of Santa Clarita of territory described in Exhibit A and mapped in Exhibit B attached hereto and by this reference Incorporated; and WHEREAS, the Local Agency Formation Commission of the County of Los Angeles has directed the City of Santa Clarita to proceed with the annexation following a duly noticed public hearing; and WHEREAS, the City Clerk set Tuesday, November 23, 1993, at 6:30 p.m, in the Council Chambers of the City Hall, 23920 Valencia Blvd., 1st Floor, Santa Clarita, California, as the date, time, and place for said hearing on the proposed annexation and the property owners in the said territory were duly informed of their right to file a written protest against the annexation with the City Clerk at any time prior to the conclusion of the hearing on the proposed annexation; and WHEREAS, the public hearing was duly and regularly conducted by and before the City Council at Its meeting of November 23,1993; and WHEREAS, the Local Agency Formation Commission approved this proposed annexation subject to the following conditions: 1) The subject territory would also be annexed to the Consolidated Fire Protection District; 2) The subject territory would be withdrawn from County Road District No. 5; and 3) The Certificate of Completion for this annexation would not be recorded until an ordinance providing for an annexation agreement by and between the City of Santa Clarita and the Cucamonga Development Co. has been submitted to the City Council for a first reading and has successfully passed to a second reading pursuant to applicable State law; and WHEREAS, the reason for this annexation is to promote sound planning and land use practices in the affected territory; and WHEREAS, the regular County assessment roll Is utilized by this City; and WHEREAS, the affected territory will not be taxed for existing bonded Indebtedness of this City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: RESOLUTION NO. 93-159 - Page 2 SECTION 1. The City Council hereby declares said territory is found to be Inhabited and a legal desciption of the boundaries of the annexation is set forth in Exhibit A and a map of the boundaries Is set forth in Exhibit B, attached hereto and made a part hereof. SECTION 2. In accordance with Section 57075 of the Government Code, it is hereby found that written protests, If any, have been filed and not withdrawn by less than 25% of the residents. within the territory or by owners of property valued at less than 25% of the total assessed value of land within the territory. SECTION 3. The City Council hereby orders the territory described in Exhibits A and B annexed and directs the City Clerk to transmit eight (8) certified copies of this resolution with applicable fees required by Section 54902.5 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Los Angeles County. SECTION 4. .The City Clerk shall cerify to the adoption of this resolution and certify this record to be a full, true, correct copy of the action taken. PASSED, APPROVED AND ADOPTED this day of 1993.
