CANYON BREEZE VILLAGE MOBILE HOME PARK
Community Development
The City Clerk has received a petition from Mr. Robert Eastman (the consultant for the owner of the
Canyon Breeze Village Mobile Home Park and the vacant lot at the corner of Soledad Canyon Road
and Sand Canyon Road) requesting to be heard by Council to discuss safety Issues on the Soledad
Canyon Street widening project. The petition Is signed by 143 of the residents of the park.
The petition indicates several areas of concern, Including unsafe conditions at the construction site
due to lack of temporary and permanent facilities at the Intersection of Soledad Canyon Road and
Sand Canyon Road. A single page of the petition Is attached. The remaining pages are available
In the City Clerk's office.
In response to the Issue raised in the petition regarding a pedestrian crossing at the Intersection,
the Indication that the protective barrier was placed across the crosswalk at the intersection, thus
prohibiting pedestrians from crossing at the corner, Is true. Once brought to the City's attention,
this situation was immediately rectified. The "K" rail was moved to allow foot traffic to utilize the
Intersection and a construction fence placed along the edge of pavement to separate and protect
pedestrians from the construction area. A pedestrian signal head and a safety street light were
placed on the temporary pole to assist pedestrians in crossing. Staff appreciates citizens bringing
forward concerns such as this in a courteous, cooperative manner and endeavor to accommodate
those concerns whenever possible.
With respect to future impacts on Sand Canyon Road, it is important to remember the purpose of
the project Is to widen Soledad Canyon Road. It was not Intended to Improve Sand Canyon Road.
The project will Improve the Intersection and place the curb returns, (the curved portion of the curb
which defines the corner) In their ultimate location. It will also construct a sufficient length of box
culvert to conduct the drainage through the curve from Sand Canyon to Soledad Canyon. The
project does not degrade the existing facilities on Sand Canyon Road, nor was it Intended to
enhance those facilities. No access was ever taken across the drainage ditch to the vacant land
on the corner, and no sidewalks or dirt walkways previously existed. The project will build ultimate
Improvements at the Intersection and will provide. handicapped access and improved pedestrian
safety.

While not directly related to the petition in question, staff also met with Mr. Maxey and Mr. Eastman
at the site to discuss their concerns regarding the project. Mr. Maxey Is requesting that the City
construct Improvements along Sand Canyon Road. Construction would Include relocation of the
existing driveway to the mobile home park approximately 350 feet to the north, extending the box
culvert, widening the road to two lanes with adequate transitions. Constructing curb, gutter, and
sidewalk would probably be Included as it would be a minor cost to the project. The estimated cost
for these improvements Is approximately $150,000. Mr Maxey is suggesting that he pay the cost
of constructing the new driveway which he estimates to be approximately $25,000 and that the City
front the costs for the remaining work and assess them against his property on a reimbursement
schedule similar to that used for the Soledad project. Payment would occur when the property Is
developed in the future and If development does not occur within 20 years the assessment is
forgiven.
City Policy regarding construction of improvements across undeveloped or underdeveloped
property is to have the adjoining property owner pay for and construct those improvements. At the
request of Mr. John Maxey, the owner of the mobile home park and the vacant lot, this Item was
placed before the Council at the meeting of April 28. Mr. Maxey agreed to pay $80,000, which he
estimated to be the cost of extending the Improvements across his vacant lot at that time. In
response to this agreement, a redesign of the plans to add this work was immediately started. Mr.
Maxey was unable to obtain financing for his frontage Improvements, and the agreement was
returned to City Council at the meeting of June 9, where Mr. Maxey's previous offer was rescinded.
The project plans were again reworked to return to the original design configuration.
As a point of Information there was a recent tragedy on Sand Canyon Road where a nine year old
boy was struck and killed while playing with friends. It appears that the boy darted from the
sidewalk where he was playing into the path of an oncoming vehicle. The incident occurred at 3:00
P.M. at a location approximately 1,400 feet north of Soledad Canyon Road. There Is no relationship
between this unfortunate accident and the Issue of safety at the Intersection raised In the citizen
petition.
It There are several options which may be pursued to alleviate public concern:
1) When the box culvert is completed, the edge of pavement could be widened with asphalt as
much as possible to provide additional walking area. This would not create a full width sidewalk
and would only slightly Improve the existing situation.
2) There will be sufficient room to construct a sidewalk east of the drainage ditch between the
existing fence and the ditch. This will allow pedestrian access directly from the Mobile Home
Park to the Intersection where Pedestrian Signals and Hand! -Capped ramps will be Installed. A
verbal presentation will be made at the Council Meeting discussing this and other options.
Cooperation from Mr. Maxey may be required to allow access from his property. This approach
will address the Issues raised In the petition at a cost of approximately $5,000.
3) The property owner could construct the Improvements along his frontage per the present City
policy.

4) The City could construct the frontage Improvements, now estimated to be In excess of $400,000,
with the property owner paying the associated costs. The additional Improvements could be
Included In the Assessment District for the Soledad Canyon Project; however, as assessments
are spread on a benefit basis and this work only benefits the adjacent land, the total costs would
be assessed against this one property. This would require the City to front the costs for the
additional work, and the property owner would reimburse the City per the existing agreement.
5) The City could Include a Sand Canyon Improvement project in a future Capital Projects Program.
If the Council were to consider this option It would be practical to view this as a complete project
whereby Improvements would be extended northerly on Sand Canyon to the City boundary. The
cost for such a project would be several million dollars.
RECOMMENDATION
Staff recommends that the residents be heard and that Council authorize funding and direct staff
to proceed with recommendation Number 2 to Install a sidewalk between the ditch and the existing
fence. Cost for this work is estimated not to exceed $5,000. '
