HomeMy WebLinkAbout1993-06-22 - AGENDA REPORTS - MOU LADOT EXTEND ROUTE 573 (2)AGENDA REPORT CONSENT CALENDAR DATE: June 22, 1993 SUBJECT: MOU With LADOT .To Extend Route 573 DEPARTMENT: Public Works BACKGROUND In 1991 the City of Santa Clarita requested Proposition C funding to establish an express bus route between Santa Clarita and the Westwood/Century City area of Los Angeles. The Los Angeles County Transportation Commission awarded funding to establish this service. The City opted to enter into an agreement with the City of Los Angeles Department of Transportation (LADOT) to extend LADOT bus route 573 from its current terminus in Granada Hills to Santa Clarita instead of creating a separate express bus route. This arrangement would permit more trips between Santa Clarita and Westwood/Century City and also does not require .the City to purchase additional bus equipment. This extension is fully funded for one year with assurance of full funding for subsequent years provided the extension generates sufficient ridership. Initially four trips will be provided between Santa Clarita and Westwood/Century City in the AM commute hours and five trips will return in the PM commute period. An exact starting date has not been established, however, service should begin this summer. In order to establish this service a Memorandum of Understanding (MOLT) needs to be executed between the City and LADOT. RECOMMENDATION Approve the MOU between the LADOT and the City, and recommend that the service to the Westwood/Century City area begin without delay. V WHEREAS, the Los Angeles County Transportation Commission, now the Los Angeles County Metropolitan Transportation Authority (MTA), is providing funding assistance to the City of Los. Angeles Department of Transportation (LADOT) for operation of four new COMMUTER EXPRESS routes under its Transit Service Expansion program for a period of two years from the inception of service; and WHEREAS, the MTA has encouraged LADOT to provide COMMUTER EXPRESS service to other jurisdictions and to work with those jurisdic�ions in sharing the cost of providing such service; and WHEREAS, as part of. this program LADOT currently operates COMMUTER EXPRESS Route 573 between Mission Hills and Westwood/Century City through a competitive contracting agreement with the RTD, an operating subsidiary of the Metropolitan Transportation Authority; and WHEREAS, SANTA CLARITA desires to provide express bus service between Santa Clarita and Westwood/Century City during the morning and: afternoon commuting hours; IT IS THEREFORE AGREED: p kS_iuii i 3lICi7# 1. Oversee the contract executed with the provider operating the transit service;. 2. Monitor the performance of the transit provider; 3. Submit an estimated annual budget for the service to Santa Clarita at least sixty (60) days prior, to the beginning of each fiscal year for their review; 4. Receive all invoices for payment from the transit provider, including the cost of extending. morning and afternoon COMMUTER EXPRESS service to Santa Clarita and transmit a copy to SANTA CLARITA for its approval of the .1 or pages . Submit requests for payment on an agreed upon schedule to MTA which will disburse Transit Service Expansion funds to the CITY for part of the costs of operating COMMUTER EXPRESS Line 573 as well as the part of the costs, net of associated fare revenue, of extending the service to SANTA,CLARITA. 6. Make minor service adjustments as necessary without prior approval of SANTA CLARITA to ensure the continued efficient operation of the service; 7. Notify SANTA CLARITA of any actions taken regarding the service on Route 573 and refrain from taking any actions requiring prior input or approval from SANTA CLARITA unless it is an action requiring immediate attention; 8. Defend, indemnify and hold harmless SANTA CLARITA, and any agents, employees and officers of against any and all damages, claims, liabilities, costs, suits or expenses, to•the extent caused by any negligent acts of the CITY, or its agents or employees arising from or connected with the,CITY's operations of service hereunder, including worker's compensation suits, liability, or expense arising from or connected with services by any person pursuant to this agreement; and 9. Fund the remaining cost of operating Line 573 service between Mission Hills and Westwood/Century City from Proposition A and C Local Return monies; * Associated fare revenue will be computed as follows: Cash fare adjustment - All Zone 3 cash adult fares received will be assumed to have been paid by Santa Clarita riders. The extra fare received for Zone 3 boardings (Zone 3 ($2.30) minus Zone 1 ($1.50) equals $0.80] shall be deducted from the extension cost paid by SANTA CLARITA. Pass fare adjustment - All Zone 3 cash adult pass boardings recorded by the transit provider will be assumed to be Santa Clarita riders. The extra pass reimbursement revenue LADOT receives from MTA (Zone 3 ($1.28) minus Zone 1 ($0.77) equals $0.511 for each Zone 3 boarding shall be deducted from the extension -cost paid by SANTA CLARITA. Direct the operator of COMMUTER EXPRESS Route 573 to accept each Interagency Transfer issued by Santa Clarita Transit as payment of the COMMUTER EXPRESS base fare of 11. Revise the schedule and route brochure for COMMUTER EXPRESS Route 573 to include information about service to Santa Clarita'and the use of Interagency Transfers when transferring to and from Santa Clarita Transit. 12. Publicize the extension of COMMUTER EXPRESS Route 573 to Santa Clarita in its advertising and publicity, including material directed at employers whose workers are served by Route 573. Not object to the operation of the transit service Within or through the recognized geographical boundaries of Santa Clarita by the CITY's contracted transportation provider; 3. Assist the CITY in the marketing of COMMUTER EXPRESS within Santa Clarita in an effort to promote public awareness of the service .and the benefits of utilizing mass transportation; 4. As its capabilities exist, agree to maintain and enhance the safe and efficient operation of the -transit service through its recognized geographical boundaries; 5. Maintain accurate records of transit funds authorized to be disbursed to the CITY by MTA; 6. Direct the operator of Santa Clarita Transit to honor SCRTD monthly passes within the City of Santa Clarita and to accept Interagency Transfers issued on COMMUTER EXPRESS Route 573 as payment -of its base local fare on its line 50.and 799. That the term of this agreement shall commence on June 15, 1993 and end on June 30, 1994. Either party may initiate an extension of this agreement. 2. To utilize vehicle hours -as the basis for computing individual net cost of service share; 3. To comply with all federal, state, and local laws and ordinances applicable to any work involved in this agreement; 4. To assure that no person shall on the ground of race, color, creed, religion, national origin, sex, age, physical or mental disability be excluded for participation in, or be subjected to discrimination under this project; 5. That this agreement is between the CITY and SANTA CLARITA and is not intended, and shall not be construed to create a relationship of agent, servant, employee, partnership, joint venture, or association, as between the CITY and SANTA CLARITA. 6. That this agreement constitutes the entire agreement between the parties hereto relatingO he subject ubagra ct matter stter hereof and supersedes any previous understandings. 7. That either party initiate a contract amendment. Contract amendments must be in writing and properly executed by both parties. B. That at any time during the term of this agreement either party -with or without cause may terminate this agreement upon giving the other party at least thirty (30) days written notice prior to the effective dateof such termination, which date shall be specified in such notice. That the CITY's contract coordinator shall be the General Manager, Los Angeles Department of Transportation or his. designee. SANTA CLARITAIS contract coordinator shall be the Transportation Manager of the City of Santa Clarita or his designee.
