DATE: February 23, 1993
SUBJECT: REGULATIONS FOR THE PLACEMENT OF NEWSPAPER RACKS
AT THE CITY'S METROLINK STATION
ORDINANCE 93-6
DEPARTMENT: Public Works
BACKGROUND
In October of 1992, City staff was approached by representatives of the Los Angeles Times with
a request to construct a structure at the City's Metrolink Station for the purpose of siting a
newspaper rack at the station. The construction of this proposed structure will be funded entirely
by the Los Angeles Times.
Following the implementation of Metrolink service, staff conducted a survey among commuters
in order to ascertain their desire for newspaper racks at the station. Approximately 90 % of those
surveyed indicated that they would like newspapers available at the station.
In response to these requests, staff has sought to facilitate newspaper sales at the Metrolink
Station in a manner which establishes guidelines for the placement of such a structure in an
aesthetically pleasing manner. It is the purpose of Ordinance 93-6 to protect the health, safety
or welfare of the citizens of Santa Clarita by regulating the placement of newsracks, pursuant to
Chapter 13.24 of the Municipal Code, at the station.
Specifically, Ordinance 93-6 provides that: 1) No person shall place or maintain a newsrack at
the station unless and until a newsrack permit has been obtained from the City Manager and;
2) Newsracks permitted at the station shall be entirely located within the newspaper structure,
and there shall be no more than eight individual newsracks located within the structure at the
station at any given time.
It is staffs desire to work cooperatively with the Los Angeles Times towards the construction
of a newsrack structure at the station (See attached structure design). In creating this Ordinance,
it was staff's intention to ensure that the provisions of Chapter 13.24 of the Municipal Code
apply specifically to the rail station, and to prevent the proliferation of newsracks similar to those
found outside CoCo's restaurant on Valencia Boulevard.

Further, a portion of this Ordinance has been drafted in a manner to provide the City Manager
with a method to establish criteria for the selection and placement of prospective newsrack
applicants at the. station. Based upon an ordinance adopted by the City of Glendale, the criteria
for selection of prospective newsrack applicants is content neutral and establishes that priority
be given to newsracks used for the sale of publications which have been adjudicated to be
newspapers of general circulation for Los Angeles County.
Second priority shall be given to newsracks used for the sale of daily publications (published on
five or more days in a calendar week) which have not been adjudicated to be newspapers of
general circulation for Los Angeles County. Third priority shall be given to newsracks for the
sale of weekly publications, meaning those published at least one, but less than five days a week.
Finally, if this proposed ordinance is acceptable to Council, please be advised that staff will be
moving forward with the creation of a licensing agreement between the City, Los Angeles Times
and the Daily News for the construction of a newspaper structure at the Metrolink Station. At
this time it is requested that Council authorize the City Manager to negotiate enter into a
licensing agreement with the Los Angeles Times for the construction of a newsrack structure at
the at the Metrolink Station.
That Council: 1) Introduce Ordinance 93-6, waive further reading, and pass Ordinance 93-6 to
second reading on March 3, 1993 and; 2) Authorize the City Manager to negotiate and enter into
a licensing agreement with the Los Angeles Times for the construction of a newsrack structure
at the Metrolink Station.
