SUBJECT: ORDINANCE 93-11: SPRAY PAINT AND MARKING PENS SALES
DEPARTMENT: Public Works
At the February 11, 1992 meeting, Council adopted Ordinance 92-4. This ordinance required
that all businesses in the City, which offer for sale to the public aerosol spray paint, to place
such items in an area locked, secure or otherwise unavailable to the public without employee
assistance.
Ordinance 93-11 would extend this requirement to include marking pens with a marking tip
exceeding one quarter inch. Further, Ordinance 93-11 would establish that any person violating
this provision shall be deemed guilty of a misdemeanor.
It is staff's belief that there is a very high incidence of theft of aerosol spray paint and marking
pens, and that those who steel these items are the primary individuals who inscribe graffiti.
While Ordinance 93-11 alone will not put an end to graffiti in the City, it does represent a good
devise for stopping the problem at its source.
It is staff's intention to work with the Santa Clarita and Canyon Country Chamber of Commerce
to make businesses aware of this requirement. Further, staff anticipates a ninety (90) day grace
period to allow businesses to come into compliance with this requirement. Therefore, it is
anticipated that enforcement of this ordinance would begin on September 1, 1993.
Enforcement of proposed Ordinance 93-11 would consist of: 1) an awareness and education
program with regard to this ordinance and graffiti; 2) random inspections of targeted businesses
by the Code Enforcement Division, who will issue warnings to businesses not in compliance on
or after September 1, 1993 and; 3) citations issued by the Code Enforcement Division to those
businesses not in compliance following both oral and written warning from the City.

Similar types of ordinances have been adopted and. successfully implemented by various cities
within Los Angeles County. These cities include Los Angeles, Gardena, Bell Gardens, Downey,
and Glendale. The City of Glendale reports that since the adoption of this ordinance, with the
assistance of a very supportive businesses community, incidents of graffiti involving have
decreased drastically.
RECOMMENDATION
That Council introduce Ordinance 93-11, waive further reading, and pass to second reading on
May 11, 1993.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA,
AMENDING THE TITLE 11 OF THE MUNICIPAL CODE AT SECTIONS
11.12 AND 11.68 RELATING TO GRAFFITI
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, DOES ORDAIN
AS FOLLOWS:
SECTION 1. That the Santa Clarita Municipal Code is hereby amended at Title
11, Public Peace and Welfare, adding Sections 11.68.050 and 11.68.060, relating to graffiti, to
read as follows:
11.68.050 Sale of Aerosol Paint Containers and Markers - Storage
mquirements. Any business or establishment offering for We to the public
aerosol paint containers. or markers with a marking. tip exceeding one quarter
inch, containing anything other than a solution which can be removed with water
after it dries, shall keep, store and maintain all such aerosol paint containers or
markers in an area viewable by, but not accessible to the public in the regular
course of business without employee assistance, pending legal sale or disposition
of such marker pens or paint containers.
11.68.060 Penal . Violation of this shall be a misdemeanor. Any person
violating any of the provisions of Chapter 11.68 shall be deemed guilty of a
misdemeanor and each such person shall be deemed guilty of a separate offense
for each and every day, or portion thereof, during which any violation of any of
the provisions of this Chapter is committed, continued, or permitted.
SECTION 2. The City. Clerk shall -certify the passage of this ordinance and shall
cause the same to be published as required by law.
