Harris SUBJECT: Ordinance No. 93-7, for approval of Prezone No. 93-001 (proposed Annexation No. 90-006), and Resolution No. 93-22, for approval of the Negative Declaration prepared for the project DEPARTMENT: Community Development BACKGROUND Prezone No. 93-001 (proposed Annexation No. 1990.06) is proposed to bring the project area Into conformance with the City's recently adopted Unified Development Code (UDC), which became effective on December 24,1992. The project area consists of approximately 210 acres of Inhabited land located adjacent to and outside the City limits, west of Haskell Canyon Road and south of Copperhill Drive (see attached map). Prezoning of the project area was reviewed by the Planning Commission and approved by the City Council prior to submission of the related annexation application to the Local Agency Formation Commission (LAFCO). Processing delays of the annexation application by the LAFCO and the adoption of the new zoning code have made the previously approved prezoning designations of R-1-5,000 (Single Family Residential, 5,000 square foot minimum lot size) and RPD -1-6u (Residential Planned Development, one acre minimum lot size, six units per acre) obsolete. Prezone No. 93-001 will change the prezone designations to the recently adopted designations of RL (Residential Low) and RM (Residential Moderate). Although the zoning terminology is different, standards within the existing and proposed zones are substantially consistent and, therefore, will not detrimentally affect land uses In the area. Prezone No. 93-001 has been reviewed pursuant to the California Environmental Quality Act (CEQA), and a Negative Declaration of no significant Impact Is proposed for the project. PLANNING COMMISSION ACTION Prezone No. 93-001, in conjunction with Prezone No. 93-002 and Zone Change No. 93-001,• was submitted to the Planning Commission on February 16,1993. The Commission reviewed the three projects together and adopted Resolution No. P93-04, recommending that the Council approve the Negative Declaration prepared for the project, and adopt the appropriate new prezone and zone designations for the three project areas. That public necessity, convenience, general welfare and good planning practice justify the prezoning designations of RL and RM. D. That the proposed prezoning designations of RL and RM are consistent with existing land uses In the area and would not result In a substantive change to the existing zoning of the subject site. E. SECTION 4. The City of Santa Clarita City Council has reviewed and considered the Initial Study prepared for the project and finds and determines as follows: A. Said study found that no adverse Impact to the existing and future environment of the area would result from the proposal. B. The proposed prezone would not have a significant adverse effect on the • environment and the proposed Negative Declaration was prepared, posted, and advertised on January 26, 1993, In accordance with the California Environmental Quality Act (CEQA). The City Council, based upon the determinations set forth above, hereby finds the Negative Declaration to be In compliance with CEQA and approves the Negative Declaration prepared for Prezone No. 91-001. Proposed Annexation No. 1990-06 prezoning area consists of 210 acres of land contiguous to the boundary of the City of Santa Clarita; Proposed Annexation No. 1992-01 prezoning area consists of 7.83 acres of land contiguous to the boundary of the City of Santa Clarlta; and Annexation No.1990-04 zoning area consists of 44 acres of land annexed to the City of Santa Clarita an November 24,1992. • SECTION 3. The City of Santa Clarita Planning Commission has reviewed and considered the Initial Study prepared for the project and finds and determines as follows: a. Said study found that no adverse Impact to the existing and future environment of the three project areas would result from the proposal. b. The proposed project would not have a significant adverse effect on the environmentand a proposed Negative Declaration was posted and advertised on January 27,1993, in accordance with the California Environmental Quality Act (CEGA). C. The Planning Commission, based upon the findings set forth above, hereby finds that the Negative Declaration is in compliance with CEOA and recommends to the City Council that It certify the Negative Declaration prepared for Master Case No. 93-001, consisting of Prezone No. 93-001, Prezone No. 93-002, and Zone Change No. 93-001. SECTION 5. The Planning Commission hereby recommends to the City Council that It approve the zoning requests as proposed for Prezone No. 93-001 to RL (Residential Low) and RM (Residential Moderate); Prezone No. 93402 to CCPD (Community Commercial -Planned Development); and Zone Change No. 93-001 to RE (Residential Estate). SECTION 6. The Secretary shall certify the adoption of this Resolution to the Departments of Public Works, Fire, and Parks and Recreation, and shall give notice of this recommendation In the manner prescribed by Section 22.60.190 of the City's Planning and Zoning 10 Code. P93-04 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA CLARITA, APPROVING MASTER CASE NO. 93-001, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF THE NEGATIVE DECLARATION & PREZONE NO. 93-001 TO RL & RM, PREZONE NO. 93-002 TO CCPD, & ZONE CHANGE NO. 93-001 TO RE WHEREAS, the City of Santa Clarlta has proposed and initiated Master Case No. 93-001, consisting of two prezones and one, zone change, to bring the project areas into conformance with the appropriate zoning designations of the City of Santa Clarita's Unified Development Code, which became effective December 24, 1992; and WHEREAS, the project areas are located as follows: Prezone No. 93.001 (proposed Annexation No. 1990-06), consisting of 210 acres of inhabited land, is located generally north and east of the existing City limits, west of Haskell Canyon Road, south of Copperhiil Drive, and east of the Los Angeles Aqueduct; Prezone No. 93-002 (proposed Annexation No. 1992-01), consisting of 7.83 acres of undeveloped land, is located generally west of the existing City limits, is located generally at the northwest comer of Newhall Ranch Road and Bouquet Canyon Road; and, Zone Change No. 93.001 (Annexation No. 1990-04), consisting of 44 acres of undeveloped land, is , located generally in the Sand Canyon area south of Iron Canyon Road, east of the eastern terminus of the proposed alignment for Warmsprings Drive, and north and west of the Angeles National Forest boundary; and WHEREAS, such zoning, mapped In Exhibit A (Prezone No. 93.001) and Exhibit B (Prezone No. 93.002), would become effective upon annexation; and WHEREAS, such zoning, mapped in Exhibit C (Zone Change No. 93-001), would become effective 30 days after adoption of the ordinance by the City Council; and WHEREAS, the City of Santa Clarlta Planning Commission did set February 16,1993, at the hour of 7 p.m., In the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita, California, as the time and place for a public hearing before said Planning Commission, and notice of said public hearing was given in the manner required by the Santa Clarlta Municipal Code; and WHEREAS, at said public hearing, said Prezone No. 93.001, Prezone No. 93-002, and Zone Change No. 93-001 were duly heard and considered; and WHEREAS= the Planning Commission of the City of Santa Clarita has considered all evidence, oral and documentary, and Is advised of the foregoing. as follows: THEREFORE, be it resolved by the Planning Commission of the City of Santa Clarita RESO P93-04 Page 2 SECTION 1. The City of Santa Clarita Planning Commission does hereby find and determine as follows: a. The purpose of Prezone No. 93-001 is to request a change from existing City of Santa Clarita R-1.5000 (Single Family Residential -5,000 square foot minimum lot size) and RPD -1-6u (Residential Planned Development, one acre minimum lot size, maximum six dwelling units per acre) zoning to recently adopted City of Santa Clarita Unified Development Code classifications RL (Residential Low), and RM (Residential Moderate) for the property Identified in Exhibit A for the purpose of annexation to the City; The purpose of Prezone No. 93-002 is to request a change from existing City of Santa Clarita C-3 DP (Unlimited Commercial -Development Program) to recently adopted City of Santa Clarita Unified Development Code classification CCPD (Community Commercial -Planned Development) for the purpose of annexation to the City of Santa Clarita; and The purpose of Zone Change No. 93-001 is to request a change from existing City of Santa Clarita A-1.2 (Light Agricultural -2 -acre minimum tot size) to recently adopted City of Santa Clarita Unified Development classification RE (Residential Estate). b. The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all comments received have been considered. The public review period was from January 27, 1993, to February 16, 1993. C. Public participation and notification requirements pursuanttoSections 65090 and 65351 of the Government Code of the State of California were duly followed. SECTION 2. Based upon the testimony and other evidence, if any, received at the public hearing, and upon studies and investigations made by the Planning Commission and on its behalf, the Commission further finds and determines as follows: a. That the proposed project, comprised of Prezone No. 93-001, Prezone No. 93.002, and Zone Change No. 93-001, is consistent with the General Plan, and that the proposed project complies with all other applicable requirements of state law and local ordinance. b. That a need for proposed Prezone No. 93-001 classifications to Unified Development Code designations RL (Residential Low) and RM (Residential Moderate) exists within the subject area for proposed Annexation No. 1990.06; That a need for proposed Prezone No. 93-002 classification to Unified Development Code designation CCPD (Community Commercial -Planned Development) exists within the subject area for proposed Annexation No. 1992-01; and RESO P93-04 Page 3 That a need for proposed Zone Change No. 93-001 classification to Unified Development Code designation RE (Residential Estate) exists within the project area of Annexation No. 1990-04, recorded November 24, 1992. C. That the subject properties for Prezone No. 93-001 are proper locations for the RL (Residential Low) and RM (Residential Moderate) prezone classifications as proposed; That the subject property for Prezone No. 93-002 is a proper location for the CCPD (Community Commercial -Planned Development) prezone classification as proposed; and That the subject property for Zone Change No. 93-001 is a proper location for the RE (Residential Estate) zone classification as proposed. d. Public necessity, convenience, general welfare, and good planning practice justify the proposed zone classifications for Prezone No. 93-001 to RL (Residential Low) and RM (Residential Moderate); Public necessity, convenience, general welfare, and good planning practice justify the proposed zone classification for Prezone No. 93-002 to CCPD (Community Commercial -Planned Development); and Public necessity, convenience, general welfare, and good planning practice justify the proposed zone classification for Zone Change No. 93-001 to RE (Residential Estate). e. The proposed prezone classifications for Prezone No. 93-001 zoning to RL (Residential Low) and RM (Residential Moderate) are consistent with existing land use In the area; The proposed prezone classifications for Prezone No. 93-002. to CCPD (Community Commercial -Planned Development) is consistent with the existing land use in the area; and The proposed zone classification for Zone Change No. 93-001 to RE (Residential Estate) Is consistent with the existing land use In the area. f. Proposed Annexation No. 1990-06 prezoning area consists of 210 acres of land contiguous to the boundary of the City of Santa Clarita; Proposed Annexation No. 1992-01 prezoning area consists of 7.83 acres of land contiguous to the boundary of the City of Santa Clarita; and Annexation No. 1990-04 zoning area consists of 44 acres of land annexed to the City of Santa Clarita on November 24, 1992. SECTION 3. The City of Santa Clarita Planning Commission has reviewed and considered the Initial Study prepared for the project and finds and determines as follows: a. Said study found that no adverse Impact to the existing and future environment of the three project areas would result from the proposal. b. The proposed project would not have a significant adverse effect on the environment and a proposed Negative Declaration was posted and advertised on January27,1993, in accordance with the California Environmental Quality Act (CEOA). C. The Planning Commission, based upon the findings set forth above, hereby finds that the Negative Declaration is in compliance with CEQA and recommends to the City Council that R certify the Negative Declaration prepared for Master Case No. 93-001, consisting of Prezone No. 93-001, Prezone No. 93-002, and Zone Change No. 93-001. SECTION 5. The Planning Commission hereby recommends to the City Council that It approve the zoning requests as proposed for Prezone No. 93.001 to RL (Residential Low) and RM (Residential Moderate); Prezone No. 93.002 to CCPD (Community Commercial -Planned Development); and Zone Change No. 93-001 to RE (Residential Estate). SECTION 6. The Secretary shall certify the adoption of this Resolution to the Departments of Public Works, Fire, and Parks and Recreation, and shall give notice of this recommendation in the manner prescribed by Section 22.60.190 of the City's Planning and Zoning Code. Grindey City Clark anmzlzcY3-001.na RESOLUTION NO. 93-22 A RESOLUTION OF THE CITY COUNCIL OF ------- THE __THE CITY OF SANTA CLARITA, CALIFORNIA APPROVING THE NEGATIVE DECLARATION PREPARED FOR PREZONE NO. 93-001 WHEREAS, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby make the following findings of fact: A. The City of Santa Clarita proposes to prezone approximately 210 acres of inhabited land (located 'generally north and east of the existing City limits, west of Haskell Canyon Road, south of Copperhiil Drive, and east of the Los Angeles Aqueduct) from R-1-5,000 (Single Family Residential, 5,000 square foot minimum lot size) and RPD -1.6u (Residential Planned Development, one acre minimum lot size, six units per acre) to recently adopted RL (Residential Low) and RM (Residential Moderate) to bring the project area Into conformance with the appropriate zoning designations of the City of Santa Clarlta's Unified Development Code, which became effective December 24, 1992. B. This proposal is determined to be a project per the California Environmental Quality Act (CEQA) and has been reviewed ° pursuant to Its provisions. A Negative Declaration has been prepared for the project based on the findings of the Initial Study, dated January 19,1993, and the determination that the proposed project will not have a significant effect on the environment, will not Impact resources protected by the California Department of Fish and Game, and that a finding of de minimus impact on such resources Is appropriate. SECTION 2. Based upon the above findings of fact, and upon studies and investigations made on behalf of the City Council, the City Council further finds as follows: A. Based on the Initial Study, the project does not have the potential to adversely effect the environment or resources under the protection of the California Department of Fish and Game, and no significant impacts are anticipated to result from the prezone. B. A proposed Negative Declaration was prepared for the, project based on the Initial Study findings and the determination that the proposed project would not have a significant effect on the environment. C. A notice of environmental assessment was posted and advertised, and the proposed Negative Declaration was made available for a 21 day review period in compliance with the City's adopted CEQA resolution. SECTION 3. Based upon the foregoing facts and findings, the City Council hereby determines that: A. The project is compatible with existing development in the area, consistent with the RL and RM zones, and consistent with the land use designations and policies of the City of Santa Clarita General. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: A. The City Council hereby approves and adopts the Negative Declaration prepared for the project. B.
