HomeMy WebLinkAbout1993-01-26 - AGENDA REPORTS - REMOVAL OF GRAFFITI (2)UNFINISHED BUSINESS DATE: SUBJECT: DEPARTMENT: AGENDA REPORT January 26, 1993 City M ger Approve Item to be presented by: Jeff Kolin Denutv C' v Manager W-1 ORDINANCE NO. 93-1: REMOVAL OF GRAFFITI Public Works To facilitate the City's Graffiti Abatement Program, staff proposes that Ordinance 93-1, an ordinance relating to the removal of graffiti, amend Chapter 11"of the Municipal Code, at Section 11.68.030, to ensure that any graffiti placed within the.City will be removed in a timely manner. Currently, there is no provision within Chapter 11 of the City's Municipal Code which provides property owners with a specific time frame for the removal of graffiti from their property. The purpose of this proposed ordinance is to provide such a specific time frame, in order to facilitate the Code Enforcement Division and the City's graffiti abatement volunteers ability to remove such graffiti. It is proposed that Ordinance 93-1 provide that private property owners shall remove graffiti from the property within twenty (20) calendar days after receipt of written notification by the City to remove such graffiti. In November of 1990, the City of Glendale adopted a similar ordinance. Since its adoption, this ordinance has been proven to be an effective method to ensure the prompt removal of graffiti within the City. RECOMMENDATION -Adopt Ordinance No. 93-1. SECTION 11.68.030 OF THE MUNICIPAL CODE RELATING TO GRAFFITI THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the Santa Clarita Municipal Code is hereby amended at Title 11, Public Peace and Welfare, Section 11.68.030, relating to graffiti, to read as follows: 11.68.030. Abatement, A. A private property owner shall remove graffiti from the property within twenty (20) days after receipt of written notification to the property owner by the City to remove such graffiti. Failure to remove the graffiti shall result in the City filing a Notice of Violation against the property with the County Recorder B. If the City makes a finding that the graffiti or other inscribed material is obnoxious pursuant to Section 11.68.020 and the owner of the structure or the public entity having jurisdiction over the structure refuses to consent to the removal of the graffiti by the City, the City may declare the existence of a public nuisance and proceed to notice and abate said nuisance in accordance with Government Code Section 38770 et sea. and charge all costs in connection with the nuisance abatement proceeding to the owner or public entity. SECTION 2. The City Clerk shall certify the passage of this ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this day of , 1993.
