SUBJECT: Resolution of the City Council to Establish Parking Penalties and Other
Related Charges for Parking Violations

Assembly Bill 408, adopted into law on September 29, 1992, decriminalizes parking violations,
removes parking violation processing from the courts, and establishes a system of administrative
adjudication procedures for these violations. The bill is intended to eliminate the costly processing
of parking violations as criminal cases whereby complex criminal court processes and appearance
of enforcement officers at appeals are required.
AB 408 requires that the transfer of parking violation processing from the courts to the issuing
agency take place as soon as possible after July 1, 1993, but not later than January 1, 1994. To
provide for the orderly transfer of parking violation processing, several procedural steps must take
place. Beginning July 1, 1993, all reference to parking violations as criminal offenses whereby a
"bail" amount is set must be modified and referred to as civil penalties. Therefore, the City must
establish a schedule of parking penalties and other related charges for parking violations in lieu of
a bail schedule as provided for in AB 408.
Resolution 93-90 adopts the current bail schedule administered bythe Newhall Municipal Court for
parking violations as the City's Schedule of Parking Penalties. No changes to the existing bail
schedule has been made with the exception of those required under AB 408.
Other procedural steps remaining include the adoption of a City Administrative Review Process to
replace the current judicial review process of parking citation appeals and an agreement with the
courts for the transfer of parking citation processing responsibilities. Staff will return to Council
for approval of these items prior to January 1, 1994, when the transfer must be completed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
CLARITA TO ESTABLISH PARKING PENALTIES AND OTHER RELATED
CHARGES FOR PARKING VIOLATIONS WITHIN THE CITY
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Santa Clarita does hereby find, determine and
declare that:
A. Assembly Bill 408 was adoptedintolaw on September 29, 1992, and is operative as of
July 1, 1993. AB 408 makes certain amendments to the State Vehicle Code with respect
to the processing and enforcement of parking violations; and
B. Pursuant to Vehicle Code Section 40200, amended by AB 408, any violation of a parking
law established under the Vehicle Code, federal statute or local ordinance is subject to a
civil penalty; and
C. Pursuant to Vehicle Code Section 40203.5, amended by AB 408, the City must establish
the amount of parking penalties, late payment penalties, administrative fees, costs of
collection, and other related charges for those parking violations occurring in the City; and
D. Vehicle Code Section 40200.3(a), as amended by AB 408, requires the City to include in
each parking penalty the sum of $2.50 for the County Courthouse Construction Fund and
the sum of $2.50 for the County Criminal Justice Facilities Construction Fund.
SECTION 2. The City Council of the City of Santa Cladta hereby resolves as follows:
The amount of parking penalties, late payment penalties, administrative expenses, costs of
collection and other charges related to parking violations shall be the amounts set forth in the
schedules attached hereto as Exhibit "A' and incorporated herein by reference.
SECTION 3. The City Clerk shall certify the adoption of this Resolution and shall provide a copy
to the Court Administrator for the Municipal Court, Newhall Judicial District.
