SUBJECT: CONCEPTUAL APPROVAL FOR ESTABLISHING A MAINTENANCE DISTRICT
FOR TWO UNDERCROSSINGS UNDER THE EXISTING RAILROAD TRACKS
ALONG SOLEDAD CANYON ROAD TO ACCESS A LAND -LOCKED PARCEL

BACKGROUND
The City was approached by the property owner (Penton Properties) of the land -locked parcel
shown on the attached sketch to form a district to cover the cost to operate and maintain two
proposed. undercrossings for the benefit of the property. The property was land -locked due to the
realignment of the railroad tracks near Soledad Canyon Road and Penlon Road. Penlon has
approached the City at the request of the Metropolitan Transportation Authority (MTA), Southern
California Regional Rail Authority (SCRRA) and the Public Utilities Commission (PUC), who require
the construction applicant for new railroad crossings be a public agency.
The construction of the two undercrossings are part of the proposed settlement between the
property owner and the MTA, SCRRA and Southern Pacific Transportation Company (SPTC) to meet
the concerns of all the parties Involved. The City may be able to Incorporate appropriate language
Into the settlement to protect the City from construction liability, tort liability and direct maintenance
costs due the construction of the undercrossings. The district would provide for the cost of
maintenance for the undercrossings. The property owner will do all of the processing and pay all
of the fees associated with processing the application.
The applicant has submitted a site plan to the Community Development Department for review.
Staff has given a conceptual approval for the locations of the two railroad undercrossings shown
on the attached sketch (see the attached letter dated December 3, 1992.) Based upon the
Information submitted by the applicant, staff indicated that the project may require two access
points on Soledad Canyon Road. The staff review was based upon the recently adopted one-stop
meeting process where a applicant can submit a site plan for comments that would reasonably
reflect the recommendations that staff would recommend to the Planning Commission for approval
of a particular project. The applicant was further advised that a CUP is required prior to any
development of this site. This Item requests Council direction regarding the request that the City
assume ownership of the proposed undercrossings subject to the terms of the recommendations
listed below and does not approve any specific project or development which will be subject to
standard City procedures and requirements.
RECOMMENDATION
Authorize staff to negotiate with the MTA, SPTC and Penlon to Include in the settlement
agreement the requirements that Penton will construct the undercrossings at no cost to the City
and that the City will through, the appropriate district, maintain the undercrossings.

2, Provide direction to staff that the settlement agreement and maintenance district shall Insulate
the City from construction liability, tort liability and direct maintenance costs for the
undercrossings.
3. Approve in, concept the formation of the district to maintain the undercrossings upon
completion of the construction, and authorize the City to be the applicant of record for
processing the approvals through the MTA, SCRRA, SPTC and the PUC.

RE: Proposed Driveways on the south side of Soledad Canyon Road, between
Langside Avenue and Camp Plenty Road
Dear Applicant:
This letter is to inform you that the Community Development Department has
conceptually approved the two driveways you have asked the City to review, as
shown on the submitted site plan. Please note that any future development of the
site will require a Conditional Use Permit (CUP). Also, any changes to the site plan
shall be subject to further review by the Community Development Department.
Depending on the size of the future "business park" project, the City Traffic
Engineer has indicated that the project may require two access points on Soledad
Canyon Road, and, if site -generated traffic creates significant impacts at other
intersections, some other connection via Whites Canyon Road/Via Princessa may
be required. Please note that any future project may require a full traffic impact
study to be reviewed andapproved by the City Traffic Engineer.
This conceptual approval shall be valid for one year and shall expirelon December
