APPROVAL OF THE MAP AND ACCEPTANCE OF THE OFFERS OF
DEDICATION
TRACT MAP LOCATION: 400 FEET WEST OF THE INTERSECTION OF VIA
PRINCESSA AND RAINBOW GLEN DRIVE
DEPARTMENT: Community Development
BACKGROUND
This project is the subdivision of 25.83 -acres Into five (5) lots for 56 condominium units. The
tentative tract map was tentatively approved by the Planning Commission on February 20,1990, by
Resolution No. 90-08.
The conditions of approval have been satisfied, the appropriate fees have been paid, and the Map
has been reviewed for technical correctness by the City Engineer. The Map Is ready for Council's
approval and acceptance of the dedications.
RECOMMENDATIONS
Part 1. Approve the Map.
Part 2. Accept the offer of dedication for public streets, the easements for storm
drain and sewer purposes, the offer of dedication of vehicular access rights
to Via Princessa and the grant and dedication of the sanitary sewer system
constructed as part of this tract.
Part 3. Make findings as follows:
a. That this project is consistent with the provisions of Sections 66474,
66474.1 and 66474.6 of the Subdivision Map Act and should be approved.
b. Thatthe proposed subdivision, togetherwith the provisions forthis design
and Improvement, Is consistent with the General Plan required by Article 5
(commencing with Section 65300) of Chapter 3 of Division 1 of the
Government Code, or any specific plan adopted pursuant to Article 8
(commencing with Section 65450) of Chapter 3 of Division 1 of the
Government Code.

c. That the development of the property In the manner set forth on the
subject division of land will not unreasonably Interfere with the free and
complete exercise of any public entity and/or public utility rights-of-way
and/or easements within the subject division of land, pursuant to
Section 66436(a)(3)(A)(1-vil) of the Subdivision Map Act.
Part 4. Instruct the City Clerk to endorse the Certificate on the face of the map of
Tract Map No. 44359-01, which embodies the approval of said map and
acceptance of the dedication shown thereon.
Part 5. Instruct the City Treasurer to endorse the Special Assessment Certificate on
the face of the map of Tract Map No. 44359-01, which Indicates that all special
assessments leviedbythe City have been paid.
Part 6. Accept the offer of dedication of Gilbert Drive, future street, within Lots 4 and
5, as shown on Tract Map No. 34367, filed In Book 1044, Pages 5 through 15,
of Maps for public road and highway purposes pursuant to Division 2, Chapter
4, Article 3, Section 66477.2 of the Subdivision Map Act.
Part 7. Instruct the City Clerk to record in the office of the County Recorder the,
acceptance described in Part 6.

Road Fees: Paid $669,200 In Bridge and Thoroughfare Fees
School fees and/or other school agreements or mitigation: The developer has entered into an
agreement with the school districts. School fees will be paid prior to the issuance of the building
permits.
