HomeMy WebLinkAbout1993-04-13 - ORDINANCES - AMEND ZONE MAP ZC 93 001 (2)ORDINANCE NO. 93-0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA AMENDING THE OFFICIAL ZONING MAP, (ZONE CHANGE 93-001) FOR THE AREA LOCATED SOUTH OF IRON CANYON ROAD, EAST OF THE EASTERN TERMINUS OF THE PROPOSED ALIGNMENT FOR WARMSPRINGS DRIVE, AND NORTH AND WEST OF THE ANGELES NATIONAL FOREST BOUNDARY IN THE CITY OF SANTA CLARITA WHEREAS, the City of Santa Clarlta has proposed and Initiated rezoning of approximately 44 acres of vacant land located south of Iron Canyon road, east of the eastern terminus of the proposed alignment for Warmsprings Canyon Drive, and north and west of the Angeles National Forest boundary following annexation of the project area to the City of Santa Clarita (Annexation No. 1992.04); and WHEREAS, such zoning, as described In Exhibit A and mapped In Exhibit B, will be designated upon the Zoning Map Incorporated within and made a part of the City's Unified 'Development Code; and WHEREAS, the City of Santa Clarlta City Council set March 23, 1993, at the hour of 6:30 P.M., in the City Council Chambers, 23920 Valencia Boulevard, Santa Clarlta, California, as the time and place for a public hearing before said City Council, and notice of said public hearing was given In the manner required by the Santa Clartta Municipal Code; and WHEREAS, at said public hearing, testimony was received, it any, for, and/or against the proposed zone change; and WHEREAS, at said public hearing, said zone change was duty heard and considered. THEREFORE, be it resolved by the City Council of the City of Santa Clarlta as follows: SECTION 1. The City Council does hereby find and determine as follows: A. The zone change Is from City A-1-2 (Light Agricultural, two acre minimum lot stze) to RE (Residential Estate, OA to OS dwelling units per acre) In order to bring the project area Into conformance with the newly adopted Unified Development Code. B. The Initial Study prepared for the project has been circulated for review and comment by affected governmental agencies and the public, and all comments received have been considered. The public review period was from January 26, 1993, to February 16, 1993. C. Public participation and notification requirements pursuant to SaFtI0nS 65090 and 65351 of the Government Code of the State of California were duly followed. SECTION 2. Based upon the testimony and other evidence, H any, received at the public hearing, and upon studies and Investigations made by the Planning Commission and the City Council and on their behalf, the City Council further finds and determines that the project consistent with the General Plan and complies with all other applicable requirements of State law and local ordinance. Ordinance No. 93.9 Page 2 SECTION 3. In acting on the zone change application, the City Council has considered certain principles and standards, and finds and determines as follows: A. That a need for the zone designation to RE exists within the project area. B. That the subject property Is a proper location for the RE designation. C. That public necessity, convenience, general welfare and good planning practice justify the prezoning designation of RE. D. That the proposed prezoning designation of RE Is consistent with existing land uses In the area and would not result In a substantive change to the existing zoning of the subject she. E. That the project area consists of approximately 44 acres of vacant land located In the Sand Canyon area of the City, south of Iron Canyon Road, east of the eastern terminus of the proposed alignment for Warmsprings Drive, and north and west of the Angeles National Forest boundary, as Identified In Exhibit A. SECTION 4. The City of Santa Clarita City Council has reviewed and considered the Initial Study prepared for the project and finds and determines as follows: A. Said study found that no adverse Impact to the existing and future environment of the area would result from the proposal. B. The proposed zone change would not have a significant adverse effect on the environment and the proposed Negative Declaration was prepared, posted, and advertised on January 26, 1993, in accordance with the California Environmental Quality Act (CEQA). C. The City Council, based upon the determinations set forth above, hereby finds the Negative Declaration to be In compliance with CEQA and approves the Negative Declaration prepared for Zone Change No. 93-001. SECTION S. Based upon the foregoing, the City Council does hereby ordain that the application for a zone change Is approved, and that the Official Zoning Map of the City of Santa Clarha Is hereby amended to designate the subject property RE. SECTION 6. This ordinance shall become effective at 121 a.m. on the thirty-first day after adoption. SECTION 7. The City Clerk shall certify as to the passage of this Ordinance and cause It to be published In the manner prescribed by law: Ordinance No. 93.9 Page 3 1993.
