HomeMy WebLinkAbout1993-03-09 - ORDINANCES - NEWSRACK REGS (2)ORDINANCE NO. 93-6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING REGULATIONS FOR THE PLACEMENT OF NEWSRACKS AT THE CITY'S INTERMODAL TRANSIT CENTER (METROLINK STATION) THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. PURPOSE. The purpose of this Ordinance is to protect the health, safety or welfare of the citizens of Santa Clarita by regulating the placement and maintenance of newsracks, pursuant to Chapter 13.24 of the Santa Clarita Municipal Code, at the City's Intermodal Transit Center, referred to in this Ordinance as "Station." SECTION 2. NEWSRACKS PERMITTED. CRITERIA A. Except as provided in this Ordinance, newsrack placement and maintenance at the Station shall be permitted pursuant to Chapter 13.24 of the Santa Clarita Municipal Code. B. No person shall place or maintain a newsrack at the Station unless and until a newsrack permit has been obtained from the City Manager for each and every newsrack placed or maintained pursuant to the terms of this Ordinance and Chapter 13.24 of the Santa Clarita Municipal Code. C. Newsracks permitted at the Station shall be entirely located within the newsrack structure, located at the Station ("Structure"). Notwithstanding any provision of this Ordinance or Chapter 13.24 of the Santa Clarita Municipal Code, there shall be no more than eight individual newsracks located within the structure and at the Station at any given time. D. Each newsrack permit issued pursuant to this Ordinance shall contain the condition that the permittee shall execute a license agreement with the City and shall contribute to the cost of maintaining the Structure for the life of such permit. E. The criteria for the selection and placement of prospective newsrack applicants pursuant to this Ordinance at the Station shall be established as follows: (1) First priority shall be given to newsracks used for the sale of publications which have been ,j216.5 adjudicated to be newspapers of general circulation for Los Angeles County, pursuant to the procedure set forth in Division 7, Article 2 of the California Government Code. (2) Second priority shall be given to newsracks used for the sale of daily publications (those published on five or more days in a calendar week) which have not been adjudicated to be newspapers of general circulation for Los Angeles County. (3) Third priority shall be given to newsracks used for the sale of weekly publications (those published at least one, but less than five days in a calendar week) which have not been adjudicated to be newspapers of general circulation for Los Angeles County. As between newspapers included within any single category of priority above, the City Manager shall be guided by the following criteria of priorities: (1) First priority shall be daily publications (published five or more days per week). (2) Second priority shall be publications published two to four days per week. (3) Third priority shall be publications published one day per week. In the event that there is a conflict between newspapers within the same priority seeking the same location at the Station, and there are insufficient newsrack spaces within the newspaper structure remaining to accommodate the conflicting newspapers after first filling as many spaces as possible by utilizing the criteria set forth above, the City Manager shall assign the space or spaces at random by placing the names of all applicants for the remaining spaces at the Station into a container from which the names shall be drawn, one at a time until the Station's remaining number of unfilled newsracks have been filled. Such drawing shall be open to the public at a time and date designated by the City Manager. 43216.5 -2- SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published as required by law.
