SUBJECT: EAST ATWOOD BENEFIT ASSESSMENT DISTRICT - VERMONT AND EVERETT DRIVE DEPARTMENT: Community Development BACKGROUND Each rainy season the residents that live along Vermont and Everett Drive experience damage and significant amounts of storm water runoff from the area know as the East Atwood Addition. This runoff has accelerated the damage to Vermont and Everett Drives which are private streets. These problems have been aggravated by the development of the new homes in the East Atwood Addition. This issue has been a major concern since incorporation and existed under the County prior to incorporation. In response to several requests and a petition, City staff has been working with the residents in the area to address the problem. Staff has had several meetings in the field to discuss the Issues and at the last meeting the residents showed a significant Interest in forming an assessment district to resolve the Issues. The City has spent approximately $15,000 in consultant and direct staff costs to date working with the residents to resolve the issues. The consultant costs relate to the accumulated charges by the engineering firth which provided consultant service to the City prior to hiring In-house staff. The change In attitude on the part of the residents could be the beginning of resolving the problems. Staff proposes to retain the services of Willdan and Associates to develop a petition which would be used to document the cost of the Improvements for the property owners. It will also allow the City to determine the level of commitment the residents have to assess themselves for these costs. Once the petition was completed, staff would be able to work with the residents to determine the scope of Improvements that would be beneficial to the residents. Development of the petition Is a necessary step in the process If the City wishes to continue to work with the residents. ANALYSIS Funding forthe development of the petition Is available in the Community Development Department, Engineering Division Budget Account No. 01-5403-227. The City would be able to recoup the costs associated with the development of the petition if the district is established. The district once formed would finance the improvements determined by the residents and the City to'be beneficial. Once the Improvements are constructed, the City would accept maintenance similar to other public improvements within the City. Authorize the expenditure of $14,848 from Account Number 01-5403-227 and that this charge be included as part of an assessment district If formed. 3. Direct staff to work with the residents once the petition has been developed to determine the level of commitment and return to Council to formally approve a benefit assessment district which meets the needs and goals of the City and the residents.
