SUBJECT: Emergency HVAC Repair Contract for City Hall Building
DEPARTMENT: Public Works
BACKGROUND:
The City of Santa Clarita faces an emergency situation based upon earthquake damage which
was suffered by the City Hall as a result of the earthquake which occurred on January 17,
1994 and subsequent aftershocks.
Damage to the City Hall resulted in a threat to public safety and prevented the safe use of
the City Hall without the accomplishment of urgent repairs to the City's heating, ventilation,
and air conditioning (HVAC) system. This agenda item identifies the processes to correct the
damage.
Heating Ventilation and Air Conditioning System:
Four contractors were given the opportunity to bid on correction of the HVAC system. The
results of the bids are listed below:
1. Honeywell
2. Intertex
3. Marco Heating & Air Conditioning
4. Al Ocean Breeze Air Conditioning

Intertex submitted the lowest, most qualified bid to complete the urgent repairs which will
enable City personnel to carry out the basic functions of City government.
Because of the urgent need to accomplish these repairs prior to an opportunity for City
Council approval, the City Manager (Director of Emergency Services), under the authority of
the California State Public Contract Code, Section 22035, Emergencies, Procedure (See
Attachment 1) entered into these contracts (See Attachment 2, pages 1-9) on March 3, 1994, to
be ratified by the City Council at the earliest opportunity.
RECOMMENDATION:
Staff recommends that the Council ratify said contract with Intertex of California, Inc. for
emergency repairs, not to exceed $90,000.. Therefore, authorize staff to expend $90,000 from
account 01-9999-999.

CONTRACT AGREEMENT
CITY HALL FACILITY
PROJECT NO. 94-0*
EMERGENCY SEISMIC REPAIRS
This Contract Agreement Is made and entered Into for the above -stated project this 2s day
of Fahrnar�z 19 94 BY AND BETWEEN the City of Santa Clarita, as
AGENCY, and TnrArtex as CONTRACTOR.
WITNESSETH that AGENCY and CONTRACTOR have mutually agreed as follows:
ARTICLE 1
That contract documents for the aforesaid project shall consist of the Notice Inviting Bids,
Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special
Provisions, Plans, and all reference specifications, details, standard drawings, special drawings and
appendices; together with this Contract Agreement and all required bonds, Insurance certificates,
permits, notices, and affidavits; and also including any and all addenda or supplemental
agreements clarifying, or extending the work contemplated as may be required to Insure its
completion In an acceptable manner. All of the provisions of said contract documents are made
a part hereof as though fully set forth herein.
ARTICLE 11
For and In consideration of the payments and agreements to be made and performed by AGENCY,
CONTRACTOR agrees to furnish all materials and perform all work required for the above -stated
project, and to fulfill all other obligations as set forth In the aforesaid contract documents.
ARTICLE 111
CONTRACTOR agrees to receive and accept the prices set forth in the Proposal as full
compensation for furnishing all materials, performing all work, and fulfilling all obligations
hereunder. Said compensation shall cover all expenses, losses, damages, and consequences
arising out of the nature of the work during its progress or prior to its acceptance Include those
for well and faithfully completing the work and the whole thereof In the manner and time specified
In the aforesaid contract documents; and also Including those arising from actions of the elements,
unforeseen difficulties or obstructions encountered In the prosecution of the work, suspension or
discontinuance of the work, and all other unknowns or risks of any description connected with the
work.
ARTICLE IV
AGENCY hereby promises and agrees to employ, and does hereby employ, CONTRACTOR to
provide the materials, do the work, and fulfill the obligations according to the terms and conditions
herein contained and referred to, for the prices aforesaid, and hereby contracts to pay the same at "
the time, in the manner, and upon the conditions set forth In the contract documents.
ARTICLE V
CONTRACTOR acknowledges the provision of the State Labor Code requiring every employer to
be Insured against liability for worker's compensation, orto undertake self -Insurance in accordance
with the provisions of that Code, and certifies compliance with such provisions. Contractor further
acknowledges the provisions of the State Labor Code requiring every employer to pay at least the
minimum prevailing rate of per diem wages for each craft classification or type of workman needed
to execute this contract as determined by the Director of Labor Relations of the State of California.
ARTICLE VI
CONTRACTOR agrees to Indemnify, defend and hold harmless AGENCY and all of Its officers and
agents from any claims, demand, or causes of action, including related expenses, attorney's fees,
and costs, based on, arising out of, or In any way related to the work undertaken by CONTRACTOR
hereunder.
ARTICLE VII
CONTRACTOR affirms that the signatures, titles, and seals set forth hereinafter In execution of this
Contract Agreement represent all Individuals, fine members, partners, Joint venturers, and/or
corporate officers having principal Interest herein.

together with the following aftershocks.
Said damage to the City'Hall resulted in a threat to public
safety and prevented the safe use of the City Hall without
accomplishment of urgent repairs.
The contractor has submitted a bid to accomplish the urgent
repairs to enable City personnel to carry out basic functions of
City government. Because of the urgent need to accomplishthese
repairs prior to an opportunity for City Council approval, the
City Manager (Director of Emergency Services)'will enter into
this contract to be ratified by the City Council at the earliest
opportunity.

REQUEST FOR PROPOSAL FOR HVAC EARTHQUAKE DAMAGE REPAIR
SCOPE OF WORK
1, Remove the air conditioning unit AC -2 from the roof,.
Physically remove the existing supporting I Beam structure
and install a new structure.
2. Install new seismic mounts on new supporting structure.
Weld mounts securely to structure. Remount air conditioning
unit on new mounts.
3. Weld air conditioning units securely to new seismic mounts.
41. Remove damaged seismic mounts on AC -1 and AC -2. Install new
seismic mounts.
5. Reseat all air conditioning units on support structures.
Securely weld seismic mounts to support structures. Weld
air conditioning units to seismic mounts.
6. Paint, all new steel work and welds.
7. Disconnect all electrical from each unit. Thoroughly verify
integrity of each high and low voltage wiring circuit from
air conditioning unit to power source. Replace any damaged
wiring and conduit. Reconnect all power after circuits are
verified.
8. Replace all flex conduit for high and low voltage on each
air conditioning unit.
9. Install seismic restraints on boiler'.
10. Install seismic restraints on both hot water pumps.
11. Adjust all seismic mounts and restraints, (AC Units, Boiler,
and Hot Water Pumps), for properoperation. All seismic
adjustments to be performed by factory 'representative.
12. Remove all pipe insulation from hot water system piping.
Repair any leaks. Lnstall new support structure for piping.
Reinsulate piping.
13. The above proposal includes all cranes, permits, and fees.
14. Perform startup and checkout on all heating and air
conditioning systems. Repair any minor problems found.
15. Balance HVAC airflow upon completion of work.

The preceding work will be performed for a not to exceed cost of
$90,000.
Not included in the above scope of work is the repair of any
major problems which may become evident when power is restored to
the air conditioning units. The units have been visually
inspected and no major problems are evident. If major problems
are found, a separate estimate for their repair will be
requested.
