Harris�P06,d� SUBJECT: PUBLIC HEARING REGARDING THE PORTA BELLA SPECIFIC PLAN AND DEVELOPMENT AGREEMENT AS WELLAS THE THREE APPEALS FILED CONCERNING THE DECISION ON JUNE 21, 1994, BY THE PLANNING COMMISSION TO ADOPT A STATEMENT OF OVERRIDING CONSIDERATION; TO CERTIFY THE FEIR AND ADDENDUM SCH 92-041041; TO ADOPT A MITIGATION MONITORING PROGRAM; TO APPROVE VESTING TENTATIVE TRACT MAP 51599 AND OAK TREE PERMIT 91-033; AND TO RECOMMEND THAT THE CITY COUNCIL APPROVE SPECIFIC PLAN 91-001 AND CONSIDER DEVELOPMENT AGREEMENT 93-003. DEPARTMENT; Community Development BACKGROUND On June 29, 1994, the City Council conducted a study session regarding the Porta Bella project, following the Planning Commission decision to approve the project on June 21, 1994. This was an informational item only, The Council began the public hearing for the Porta Bella project and related appeals on August 23, 1994. On August 23, Council directed staff to combine the Porta Bella Specific Plan and Development Agreement hearings with the appeals into a single item for future meetings. The Council also decided to conduct a field trip to the Porta Bella project area on September 24 and to hold a joint study session with the Planning Commission on October 4, 1994. In addition to these hearings directly related to Porta Bella, on September 14, the Council held a Study Session regarding the proposed General Plan Amendment to revise the Circulation Element and Network of Arterial Highways. At this meeting, Council approved the consultant for the project and directed staff to continue in the modelling efforts underway, including modelling the revised Porta Bella project with Magic/Princessa and the CTAC alternative. During this meeting, the Circle J community presented four alternative corridors for Magic/Princessa. Continued To: Li-_�— 9y Agenda Item: ANALYSIS The following presentations will be given at the Council meeting: 1. The City's environmental consultant will give a presentation on the Environmental Impact Report and Addendum to review the project impacts, mitigation measures, and alternatives. Particular attention will be paid to the Addendum, which specifically addresses the Magic/Princessa alignment which would impact designated open space of the Circle J community, and the overall issue of toxic/ hazardous waste. 2. The California Environmental Protection Agency --Department of Toxic Substances Control will send a representative to describe their work in reviewing the existing condition and in managing the ongoing clean-up of the site. The conditions and mitigation measures ;prepared in conjunction with the project will also be reviewed. 3. The City Attorney will discuss the applicant's appeal regarding the language of the conditions of approval and the relationship of these to the recently decided Dolan case. 4. Staff will provide an update on the status of the appeals. Since the initial public hearing on the project on August 23, staff has been primarily involved in preparing for and coordinating the study session for the General Plan Amendment to the Circulation Network on September 14, the Porta Bella site visit on September 24, and the joint Planning Commission/CityCouncil Study Session on October 4. Because of the lead time required to prepare the Council packet, this staff report was prepared prior to the joint study session. Staff will continue with a more in-depth analysis following the study session and additional direction from the Council at the next meeting on the project. RECOMMENDATION: Staff recommends that the City Council: 1. Receive staff report and reopen the public hearing; 2. Discuss the site visit, joint Planning Commission/City Council Study Session, and the public testimony received to date; 3. Provide direction to staff; 4. Mayor announces decision CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING REGARDING THE PORTA BELLA SPECIFIC PLAN 91-001, WHICH INCLUDES AN AMENDMENT TO THE GENERAL PLAN, AND DEVELOPMENT AGREEMENT 91-003. THE GENERAL PLAN AMENDMENT INCLUDES CHANGES TO THE HIGHWAY NETWORK OF THE CIRCULATION ELEMENT (INCLUDING OFF-SITE SEGMENTS), AND CHANGING THE SITE'S GENERAL PLAN DESIGNATION TO SPECIFIC PLAN IN THE LAND USE ELEMENT AND GENERAL PLAN MAP. PUBLIC NOTICE IS HEREBY GIVEN: A Public Hearing will be held before the City Council of the City of Santa Clarita regarding Master Case Noss 91-164 and 93.012 (Porta Bella Specific Plan), Including Specific Plan No. 91-001; Development Agreement No. 93-003; and Final Environmental Impact Report and Addendum SCH 92-041041. Concurrently, the City Council will begin the public hearing for the appeals filed against the Planning Commission decision to approve Vesting Tentative Tract Map 51599 and Oak Tree Permit 91-033 for the Porta Bella site on June 21, 1994. A separate public notice regarding the appeals will be mailed with this notice. The property, known as the Bermite site, is located south of Soledad Canyon Road, east of Bouquet Canyon/San Fernando Roads, north of the Circle J Ranch communities, and west of the Golden Triangle Industrial area. The ASSESSOR'S PARCEL NO.'S are 2836-012-010,011,012, and 019. The site consists of 996 acres formerly used for industrial purposes. The Specific Plan proposes 2,911 dwelling units, Including 1,244 single-family homes and 1,667 multi -family dwellings. The proposal Includes: 449 acres of open space and parks; 300 acres of single-family uses; 85 acres of multi- family uses; 56 acres of streets; and 106 acres of commercial, office, business park, and Institutional uses. The Vesting Tentative Tract Map proposes to create 76 master lots to be further subdivided in future tract maps. There are 182 oak trees on the site and the project may require the removal of up to 109 oak trees, Including as many as five of the ten heritage oak trees. The proposed Magic/Princessa corridor Includes an off-site segment within the designated open space of Circle J Ranch and another extending west from the project site to San Fernando Road. Honorable Mayor, Council Members, and Members of the Planning Commission: This, firm represents Hasa, Inc., owners of the property at. 23119 Drayton Street, Saugus, California (the "Hasa Property"), which is near portions of the Porta Bella development (the "Development") now being considered by the City Council of the City of. Santa Clarita (the "City"). This letter shall constitute Hasa's submission to the City concerning the road or bridge currently being contemplated that would connect Magic Mountain Parkway to the Development at the top of the hill to the East of the Hasa 'Property. The proposed road or bridge has been, and will be in this letter, referred to as "Magic Princessa.11 As you may know, the Hasa Property is located on Drayton Street, between San Fernando Road and Springbrook, and comprises an essentially rectangular parcel that runs to the North from Drayton Street along San Fernando Road. Until July 6, 1994, the location(s) for Magic Princessa being proposed provided that the road would run directly through the middle of the Hasa Property, but would avoid certain critical structures thereon. On that date, however, the Developer's Engineer amended the location by shifting it to the South, away from Keysor-Century. It is widely believed that the road was moved in response to the influence being asserted by Keysor- Century. The new proposed location avoids some mobile homes, trailers and an empty drum storage building on the Keysor-Century Property. However, the new location provides that the road will A City Council of the City of Santa Clarita October 11, 1994 Page 2 intersect, either above or through, Hasa's main production building at the very location where its production takes place - the north-east corner. In addition, the new location will also intersect with several other businesses on Springbrook Street that would have been avoided by the first alignment. For several reasons, Hasa objects to the proposed road in either of its incarnations, but more heatedly as to the most recent, which would effectively terminate Hasa's ability to operate its business at the Hasa property: I. The Pr000sed Proiect Is Not Plannarl Or T,nnararl Tn T},o M.n and Least Private Injury_ The City Planning Commission and the Developer have indicated that there are several locations for Magic Princessa being considered. As set forth above, the one currently being proposed would likely result in a complete condemnation of the Hasa Property and Hasa, Inc., as a viable entity. Other alternatives, including the first one proposed as well as the diversion of Magic Princessa to Drayton Street, are more compatible with the greatest public good (avoiding fee condemnations) and the least private injury. II. The Hasa Property Is Not Necessary for the Proposed Project. As there are several alternative locations for Magic Princessa being considered that would impact the Hasa property and neighboring landowners to a lesser degree, the location which sends the road through Hasa's property is not necessary for the project. III. The Pr000sed Location for Maaic Prinresaa rrnrrantly na;nn While at this early stage it remains unclear, the proposed bridge or road may violate the provisions of the Environmental Impact Report ("EIR") for the project. The EIR should be consulted prior to a decision by the City as to the location of Magic Princessa. It seems apparent that the only thing considered by the Planning Commission and the Developer in reaching the current proposal is the appeal that has been filed by Keysor-Century pertaining to this aspect of the project. For these reasons, Hasa urges the City to carefully consider all of these facts when making any decisions as to the location of Magic Princessa. Upon our review of the City and Developer's books and records concerning their activities in this aspect of the development, Hasa may have additional challenges to make and City Council of the City of Santa Clarita October 11, 1994 Page 3 concerns to express to the City. Due to time constraints and, moreover, the fact that information from the City and the Developer has only recently been disseminated pertaining to the recent road alignment, we have not been able to fully investigate the latter issues. The enclosed plan is transmitted in response to comments received at the October 19, 1993 Planning Commission Hearing for the Porta Bella Environmental Impact Report. The plan depicts an alternative to the road alignment(s) for Magic Mountain Parkway and Via Princessa. Northholme Partners continues to support the alignments for these two roads as originally proposed in the Porta Bella specific plan and vesting tentative map 51599. The original proposal is compatible with the Citizen's Transportation Advisory Committee's recommendation for the center city circulation network. The specific plan and CTAC recommendation are undergoing concurrent evaluation as the adoption of the specific plan is contingent upon the resolution of the center city network. During the Planning Commission hearing of August 17, 1993 specifically addressing the CTAC recommendation the Chairman stated that their center city network evaluation would consider all possibilities in spite of the current recommendation before them. Certain residents continue to disagree with the CTAC recommendation and advocate an unimpeded route through the city which conflicts with the Porta Bella proposal. These citizens again raised the issue at the first public hearing for Porta Bella. The enclosed modified alignments are submitted to reflect the concerns of the dissenting citizens with the CTAC and Porta Bella proposal. However, the present proposal (map of 9-19-94) impacts too many property owners and businesses. Business and property owners plus representatives of the city and Porta Bella met at the site to discuss the proposed bridge over San Fernando Rd on 10-6-94 at 1:30 p.m. (see attached list of attendees). The result of the meeting from the view of the pro perty owners and businesses was that the bridge could be directed to fly over a greater portion of Keysor's! temporary office trailers and storage building and would not so adversely impact the small businesses on, Springbrook and Drayton. (see map dated 10-7-94, Exhibit "A"). Should the bridge be constructed as shown on drawing dated 9-19-94, approximately 21 businesses and approxi- mately 120 employees, not including Keysor, would be affected. Sam Veltri of Porta Bella offered to study alternatives to the bridge alignment and present them to planning for their consideration before the council meeting of 10-11-94. In summation, we wish to work with the city to meet its goals without harming our small business community. We also wish to alert the city to the fact that a bridge over an area can impact the lives, livelihood, retire- ment prospects, investments already made, and well- being of many people. Let us not let the location and existence of the bridge be only of financial concern planned and dictated by outside sources. Our future and the city's future rests with your decisions.
