A Nondisposal facility is defined as any solid waste facility required to obtain a state solid waste facility permit other than a disposal facility or a transformation facility. The NDFE must identify all existing, expansion of existing, and proposed solid waste facilities which will be needed to implement local Source Reduction and Recycling Elements. The NDFE identifies the utilization of a yard waste composting facility, and also identifies two proposed facilities, a composting facility and a materials recovery facility, as Nondisposal facilities the City may utilize to implement its SRRE and meet the solid waste diversion requirements of AB 939. Consistent with the mandates of AB 3001, the public notice of this hearing has been posted in accordance with the law, this date has been published for a public hearing to adopt the City's Nondisposal Facility Element (NDFE). Upon adoption of this City's plan by the City Council, the plan will be submitted to the California Integrated Waste Management Board for this City's required filing, RECOMMENDATION Adopt Resolution No. 94 - 49 to accept public comment, adopt the Nondisposal Facility Element, and direct staff to submit our plan to the California Integrated Waste Management Board. In 1992, the California legislature enacted Assembly Bill 3001 (Cortese) which requires California cities and counties to prepare a Nondisposal Facility Element. The contents of the NDFE are regulated in the California Code of Regulations, Sections 18752 through 18754.5, which require that the NDFE identify all existing, expansion of existing, and proposed solid waste facilities which will be needed to implement local Source Reduction and Recycling Elements. The hearing will be held by the. City Council of the City of Santa Clarita on the 26th day of April, 1994, at or after 6:30 p.m., in the City Council Chambers at 23920 Valencia Blvd., 1st Floor, Santa Clarita, CA 91355. Mayor announces decision RESOLUTION NO. 94-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA ADOPTING THE NONDISPOSAL FACILITY ELEMENT - AB 3001 WHEREAS, the City of Santa Clarita is mandated by the California Integrated Waste Management Act, AB 939, to reduce its disposal of municipal solid waste into landfills 25 % by the year 1995 and 50% by the year 2000; and WHEREAS, the City of Santa Clarita adopted, by Council Action on September 24, 1991, the Source Reduction and Recycling Element; and WHEREAS, the Los Angeles County Local Task Force accepted the Source Reduction and Recycling Element on January 28, 1991; and WHEREAS, the City of Santa Clarita has submitted a copy of the final draft Nondisposal Facility Element to the Los Angeles County Local Task Force, as mandated by law; NOW, THEREFORE, be it resolved that the City Council of the City of Santa Clarita Nearby: 1. Accepts public comment; 2. Adopts the Nondisposal Facility Element; and 3. Directs staff to submit the Nondisposal Facility Elemnent to the California Integrated Waste Management Board. California Code of Regulations (CCR), Sections 18752 through 18754.5, require that the NDFE identify all nondisposal facilities, including existing, expansions of existing, and proposed nondisposal facilities, which will be used to assist in reaching the diversion mandates of PRC Section 41780.. A Nondisposal facility is defined as any solid waste facility required to obtain a state solid waste facility permit except a disposal facility or a transformation facility (PRC Section 40151). The City of Santa Clarita has prepared, adopted, and hereby transmits to Los Angeles County the City's NDFE, as required by PRC Section 41730. The City is also submitting a copy of its NDFE to the California Integrated Waste Management Board for review and approval. The City's NDFE will be appended to the City's SRRE at the time of the five year revision. This NDFE identifies the utilization of a yard waste composting facility, and also identifies two proposed facilities, a composting facility and a materials recovery facility, as Nondisposal facilities necessary to implement the City's waste diversion goals. Tables I,11 and III, attached, identify the Nondisposal facilities the City may utilize to implement its SRRE and meet the solid waste diversion requirements of PRC Section 41780. A draft of this NDFE was submitted to the Los Angeles County Local Task Force (LTF) in February 1994 for review and comment regarding the regional impacts fo the nondisposal facilities indentifred in this Element, in accordance with the requirements of PRC Sections 41734(a) and (b). As indicated by PRC Section 41735(a), the adoption or amendment of this element is not subject to environmental review under the California Environmental Quality Act (CEQA). Table I City of Santa Clarita NDFE Community Recycling and Resource Recovery Composting Facility Fact Sheet TYPE OF FACILITY The Community Recycling and Resource Recovery (CRRR) Composting Facility is a new composting facility which receives and processes loads of mixed waste, including yard waste, wood waste and produce waste. The yard waste is preprocessed in grinding operations that occur at CRRR's MRF in Sun Valley., The matefial will be transferred to the Composting Facility to be cured in windrows, The facility is currently operating with a Conditional Use Permit which permits acceptance of 250 tpd. The facility does not have a Solid Waste Facility Permit since it is currently in the permitting process. AMOUNT OF WASTE The City has initiated a pilot yard trimmings recycling SENT TO FACILITY program which began in October 1993 and includes 2,250 households in the first of three planned phases. The amount of green waste being sent to the CRRR Composting Facility from the City of Santa Clarita in this pilot program is unavailable at this time. The final phase of the pilot program will end in June 1994. At that time, the City will review the program to better establish a permanent yard trimmings program. EXPECTED The expected diversion rate for the City is unknown at this DIVERSION time. The City is expecting to eventually divert RATE approximately 17 percent of the wastes generated yearly in the City of Santa Clarita, based on information obtained from the waste generation study performed for the City in 1990. If a City-wide program is established, the eventual diversion rate could reach 17%. The total diversion for the facility will be at least five percent of the total volume of material received, as defined for facilities needing a Solid Waste Facility Permit. LOCATION 7261 East Bear Mountain Boulevard, La Monte in Kern County, about 70 miles north of the City of Santa Clarita. 2 Table 11 City of Santa Clarita NDFE Chiquita Canyon Composting Facility Fact Sheet TYPE OF FACILITY The Chiquita Canyon Composting Facilty is a proposed new composting facility at. the Chiquita Canyon Landfill which will receive and process loads of yard waste. The materials will be shredded and cured in windrows along with municipal sewage sludge after which it will be run through a screen to remove oversize fraction. The compost will then be stored until it can be distributed to markets. The facitlity will accept 560 tpd of compostable materials. The facility does not have a Solid Waste Facility Permit since it is currently in the permitting process. AMOUNT OF WASTE At this time, the amount of yard waste to be sent to the SENT TO FACILITY Chiquita Canyon Composting Facility from the City of Santa Clarita is not known. The pilot residential yard trimmings program is currently using the Community Recycling and Resource Recovery Composting Facility. The pilot yard trimmings program will be completed in June 1994. At that time, the City will review the program to better establish a permanent yard trimmings program. EXPECTED The Facility is currently in the permitting process, with the DIVERSION screencheck draft EIR out for review. The City will review RATE its options if the: Facility comes on line. The expected diversion for the City could reach 17%. The total diversion for the facility will be at least five percent of the total volume of material received, as defined for facilities needing a Solid Waste Facility Permit. LOCATION At the existing Chiquita Canyon Landfill, 29201 Henry Mayo Drive, Valencia, in the northwestern portion of Los Angeles County near the City of Santa Clarita just west of the Interstate 5 and State Route 126 junction. FFF�- Table III City of Santa Clarita NDFE Chiquita Canyon Materials Recovery Facility Fact Sheet TYPE OF FACILITY The Chiquita Canyon Materials Recovery Facility (MRF) is a proposed new materials recovery facility at the Chiquita Canyon Landfill which will receive and process loads of mixed recyclables from curbside collection programs along with paper rich commercial loads diverted to the MRF. The facility will accept 500 tpd of source separated recyclable materials. The facility does not have a Solid Waste Facility Permit since it is currently in the permitting process. AMOUNT OF WASTE At this time, the amount of waste to be sent to the Chiquita SENT TO FACILITY Canyon MRF from the City of Santa Clarita is not known. The City currently diverts 16% of its residential waste through its curbside recycling program. The City's franchised haulers are responsible for the processing and marketing of the recyclables, using the best economic resources available. If the Facility is pennitted, the haulers will have the option to send material there. EXPECTED The Facility is currently in the permitting process, with the DIVERSION screencheck draft EIR out for review. The City will review RATE its options if the Facility comes on line. The total diversion for the facility will be at least five percent of the total volume of material received, as defined for facilities needing a Solid Waste Facility Pennit.
